  • The plaintiff says she hired the defendant to replace her roof. She claims the defendant ran off with her money and never fixed her roof, so she’s suing for a refund on her deposit and lost wages. The defendant argues he went to the plaintiff’s home several times to do the work, but she made it impossible for him.

    This defendant reminds me of some of these delivery companies who claim they "attempted" a delivery but never rang the doorbell or knocked.

      Fed ex did this to me not to long ago. Here I am stalking them on the app to see where the truck is. I turn the beaters on for ten freaken minutes for a cake and I managed to miss them. I swear he ninjad his way onto my porch to leave that sticky 😂

      They do that because some homes have been flagged for claiming they never received their package too many times. If a house or environment around it doesn’t look safe, they can refuse to deliver it and they put a note on your door. Another reason, customers don’t answer the door fast enough. The drivers don’t have all day to stand there and wait around for the customer to answer the door which is probs the main reason lol 😂 they have other packages to deliver. Oh and some packages require a signature.

      @@P3rmissionD3ni3d Fed Ex is a bunch of douches. The pull this crap all the time. Also, a few years ago one of their delivery trucks t-boned my husband and I - totally their fault. They were HORRIBLE our car was totaled, they didn't comp us a rental or anything.. And then it took OVER 3 YEARS to finally settle, and they got off pretty easily at that. They have some sheisty crap like their drivers don't really work for them, they're all independent contractors so FedEx itself isn't liable for them. Un freaking believable. Sooo...yeah, they're definitely on my "Crap I could do without" list lol.

      he should have taken the 50 bucks for gas going there twice and then gave her back 650 when she offered it , but now he has to give her back the whole 700 plus court costs .

    So before she sued him he was trying to negotiate how much she owed him for his 'time', yet he had spent NO TIME doing anything, she offered him $50 and he turned her down, now he's realising that was better than the big fat zero he got in court ha ha ha.
    I don't believe for a second he came by because he would have started unloading the equipment while waiting for her to come home to remove the car but since he was never even there, that's why he never phoned her to ask her to remove the car...

    Outrageous! She should have never, ever parked in the driveway forever as long as there was a possibility that he could maybe possibly sort of show up sometime. It's completely normal to pay someone to do a big job and then not be around on a scheduled date. He clearly deserved to be paid to be an irrational jack*ss. 👍

      im a painter and i have had many cases where the people knew exactly when i was coming but they still had not moved any furniture or wall pictures out of the way when i arrived there to start painting . its part of the job to tell people to move their stuff out of the way .

      It's not like he even did any pre-job work ... doing up plans, hiring people, buying supplies, having to pay for re-stocking fees when it was canceled, like how some other cases claim! He literally did NOTHING to earn even the deposit!

      He went to her house, talked to her kids, and told them to have their mom call him....she didn't call him. I think they're both to blame. She bashed him on FB and that's probably why he didn't give her the money back.

    The defendant is full of excuses, excuses that lasted a whole year. Even if he did make a specific appt (which he can't really prove he made) all he or his crew needed to do was to get off their butts and go knock on the door to have the car moved. And he has some nerve at rejecting her offer letting him keep $50 for his time, but to return the rest of the money, considering he did nothing. Terrible way to treat his customer.

      I have been a repair technician for 15 years and I cannot count the number of times the owner’s son or daughter was supposed to let me in but never answered the door. No matter now many door bell rings or how hard I knocked they couldn’t hear me through the loud music or the headphones or the pillow.
      It is completely believable his guys knocked and couldn’t get anyone. What is not believable is how unprofessional this guy is in the scheduling process and business practices and still be in business.

      yeah, but the judges point was that the plaintiff didn't have a "lawn" to put the materials. i can 100% understand the contractors not wanting to do the job if the car was there because they didn't want to work around it and didn't want to damage it.

    Been a roofer for a few companies, you could have your roof replaced with snow already on your roof. There being a car wont matter you try and see if it can be moved but placing a few toe boards across the section and you hand clear it as you go. Even having to walk the materials too the roof by ladder is always do able. Bottom line this guy is nothing but excuses!! 😊

      My kid usually doesn't answer the door, either, unless I specifically tell him beforehand that I'm expecting someone or something that needs a signature. Even then he still sometimes "forgets". 🤦🏽‍♀️

    I was a production manager for a roofing and siding company. This is what happens when general contractors use subcontractors. The subcontractors could care less about customer service as long as they get more work. Before I got there, there was a load of these types of miscommunications. I threatened the crews that I will stop giving them jobs before the one they have is done and confirmed. I threatened the material company that we will go elsewhere if they do not give me a delivery window so that I can communicate with the customers. It's not rocket science. I just asked myself, "what would I want as a customer..."

    Weather does not have a huge bearing on roofing, people think it sets better in Warmer temps but thats not really proven.

      What ! Have you ever been on a wet roof? A roof also protects rain from coming inside of home. I’ve never meet a roofer who works when it’s raining or going to rain, maybe a flat commercial tar and paper roof done for quick leak repair and a steep roof residential temporary repair , but in general roofers work when weather is clear.

      @Bill Moran I'm not speaking about rain, I should have been more clear instead of just saying weather, I'm speaking about weather as far as Temperature. My husband is a contractor, done alot of roofs, he definitely doesn't work in rain on a roof. I mean that a lot of homeowners want to do roofs in summer because they think it seals shingles better than in fall or spring. I understand wet roof is dangerous and also laying shingles in rain is bad because mold/mildew can build up. I understand any moisture at all can have negative effects. If u have wet felt paper after rain, cover it with shingles while really wet it will mold mildew which will move to wood. I am speaking on weather, heat/temp, in NC.

    Lady already had $700 invested to get her roof done. If the contractor gave her a date and told her she needed the car out of the driveway, she would've had the car moved.
    On the flipside, a contractor wanting to make money isn't going to set aside an entire day to do a roof, then send his crew home when the customer has a car in the driveway. The contractor would be calling the customer. Not only would the contractor be losing out on the rest of the money for the completed job, but they'd be losing out on money from another job they could be doing that day, plus wages for the employees that went there to do the roof.
    Guy is a joke.

    My very first time with a contractor, a guy who did stucco said he could have my house done in a week. 3 god dam months later I'm calling him on the phone to find out where the hell he is and why he's not doing my house. I've since learned about the ' time is of the essence ' contract clause and those guys will never bloody well do that to me again. Once is too much.

    The defendant’s excuse for not roofing was ridiculous! My ex was a roofer, and they didn’t let anything get in the way of getting the job done. Something so simple as knocking on a door to get someone to move a car is not a viable excuse!

    Here’s the problem with even the judges responses. He has to prove that he let her know her cars were in the driveway when he tried to complete the roof. A person has a right to park their cars in their driveway when they don’t know when a person performing services on their homes are coming to perform said services. To lecture the women on her “cars” being in the front yard is ridiculous when he didn’t prove he told her they were coming that day or even showed up. The biggest problem is, he could have sent her a text message to schedule a time and make sure the cars, if they were really in the driveway, are moved. The guy is lying like most contractors because he didn’t have the time to complete the roof due to over booking.

    Never have I seen a judge scream at a layperson litigant because they want to show evidence. Fair enough if he is rude, belligerent or uncooperative but not because he is trying to prove his point.
    I would rather go to a proper court win or lose.
    I bet her 'retirement' as judge was so swift because of that exact attitude flaw. He husband was a very successful judge who presided over major cases and his demeanour is very different

      ... what do you mean "because he wanted to show evidence"? When did she scream at him for asking to show evidence? The only time she screamed at him was when he was yelling over her which is extremely rude. It was very clear that she was only yelled at him because he talked over her.. not because of "wanting to show evidence" she literally tells him as she's screaming why she is screaming and that he cannot yell over her.
      Soo...? I'm just not sure how it confused you so much when she said the reason in the episode... and it wasn't that.

    So let me get this straight him and his associate goes to the house, rings the doorbell knock on the door whatever the case may be. See the son, daughter and the alleged son's car that's in the way and instead telling the son, "hey if you can give your mom this message and if you can do me a favor. I'm coming on this day at this time could you move your car out the driveway so we can put the roofing material in the driveway."

    Decades ago we were working on a Paving crew. There was a lady that didn't want to move her car we told her no worries we'll just slip the payment under your car To this day don't know if she got the sarcasm or not. Same thing here-all she had to do was negotiate a week the roofer guy would be available "the car will be out of the driveway all this week", come when you get the materials together.

    Here's an idea. Tell the son to NOT PARK in the driveway for the next ( time? } Or set up a method for contact which the son is involved in. He cannot have been sleeping every time. Very inefficient all round. Maybe she didn't have the money.

    How dare she allow her son to park in her driveway during the year that defendant might decide to show up one day!! Seriously though, defendant is incredibly rude and obnoxious. He had a lot of nerve refusing to return her money when he didn't do a whit of work for a YEAR. Here's a tip: KNOCK ON THE DOOR IF THERE'S A CAR IN THE DRIVEWAY. Bunch of lazyass bums.

    It’s her sons car. Give roofer sons or house phone number. The communication with every single party was super lame. Roofer depending on teenagers to deliver messages is silly.
    Sons in shower etc Wait 20min start knocking on door again.
    Calling her at work is ridiculous especially “hey call me back”
