As a customer if you're getting something like countertops worked on, you should always ask questions to the person who is giving the service. Another thing was the plaintiff could have even looked up on the internet about how to take care of granite countertops and what she should do so the color won't change. Also, the plaintiff could have been putting certain chemicals and other things on the counters so she can't blame it all on the defendant. He did his job.

Natural stone is such high maintenance!! I imagine it's possible the defendant's wife told the plaintiff's witness that they didn't have to seal it because they sealed it in installation. But that doesn't mean it would never need to be sealed again! We all need to learn to do better research and ask better questions.

I've been researching countertops for kitchens for the last 3 years and one of the things I've found is it tells you there's a lot of work if you want to have marble or granite countertops. So I'm considering a composite of courts for example. I don't know how this lady jumped up and made a purchase without reading anything without asking inquiry it's a big investment it requires you to care about the money you're spending on the investment. It shows what you value in the things you invest in.

No we installed these countertops (that’s me and my father) the book is somthing we give to our builders who sell finished homes so they remember to tell their customers how to care for the tops since we aren’t around when the home sells. We verbally tell all of our customers how to maintain their countertops, and the do’s and don’t’s even though it’s the most asked question we get. It’s very simple and straightforward process.
I have had granite installed numerous times and have never been told I had to seal it. I have sealed mine because I looked up on the internet how to care for granite, but that’s it.

When you buy wood furniture, like a table, it’s stained and sealed. But every so many months your supposed to wax or seal the wood so it doesn’t get discolored/scratched/etc.) (Not yelling, just stating my view. He should put a sample on the floor room of a tile sealed and unsealed so customers can see and be aware. Also could give a small sample bottle to customers when they make a purchase. Lady buys a new car , doesn’t change the oil for three years and the engine develops problems. She goes back to were she bought car and says my engine is bad , they investigate and say you never change the oil and her response is you never said I have to change the oil. While I don’t know if certain types of granite have to be resealed, you can see the difference in photos and it was probably from what she used to clean used areas of counter top vs areas not exposed to substances she used to clean . After three years it’s on you lady. Husband didn’t say a word, he’s done with the whole counter top since days after it was installed.
Most contractors I have had have a section of the contract describe any regular/required maintenance and that if not done it voids any warranty. I know many people do not read their whole contract - but thats their problem. I am currently having issues with casement windows that were installed - the warranty will be voided if have shutters or horizontal windows installed (required some minor drilling into the pvc).... Ultimately I know I will have voided the warranty when that gets done - because I signed something saying that. The salesman and owners said they would be reasonable if something happened that was clearly not a result of the drilling (like if a pane of window falls out or something)... that being said I see a lot of people in here saying she should have known - just because she should look it up on the internet and find out. I really don't think I would have thought about this - and my parents wouldn't they would just continue to wipe the counters down the same way they did before (I'll admit that in retrospect I would probably think "dammit I should have looked this up" )

And for proof I would actually create and hand out a manual on how to clean and upkeep your new stone countertops! No. It's the customer's responsibility to maintain something he bought in good condition. If it wasn't we would end up with nonsense lawsuits thar everybody would demand a refund for anything he bought. They didn't tell me I had to clean my frige, I want my money back after 2 years. They didn't tell me I had to take care my air condition, I want my money back after 3 years. We would end up with millions of lawsuits from angry customers asking for refunds or a new frige for free.

The defendant is not at fault here, but just to really guarantee that he doesn't get sued again, he should mention the sealing of the counter in the contract that the customers sign, that way there's no room for argument.
As a contractor.. WHAT?!?! Never have i come across marble or granite that needed to be sealed. That is assumed and included. Why would it not be if the customer is expecting top notch results. At least with all my subs they know. Why would they give half assed jobs? No bueno in his part too for not doing it right. If he stated it not be sealed then fine and she shouldn't get a free job.
They say that it was sealed but in the three years, it was never resealed or had any proper maintance done do it which is why there's a discoloring from where it was and wasn't colored. It's not like the installed it unsealed and walked away. Everything needs to be maintained, from hardwood flooringw ith special cleaners, to tile to get the grout done, to wood that needs to be varnished with heavy use. If I had hardwood floors put in and I used cheap dollar store wipes meant for cleaning bathrooms, it wouldn't be the contractors fault for the results of my poor maintance. The judge even said that most people don't reseal their countertop but also don't mind when it gets darker, the plantiff didn't care for it, didn't do research, and her own evidence showed she was at fault because of this.

I don’t agree with the verdict. You’re making an assumption that a homeowner just knows what to do to take care of a counter top. I guarantee that there are plenty of new homeowners who have never purchased granite and would never know that anything has to be done other than cleaning as needed. If a company is selling a product, it’s up to them to also explain in detail what the upkeep is. I’ve purchased cast iron grills and it’s very clear on the package or from the vendor, what you have to do to clean them. If I want told, I would just throw the grill in the dish washer unknowingly.
It was sealed the day we installed the top as we do with every top we install. Sealer doesn’t last forever and is recommended to reapply ever 6-8 months (depending on the stone and sealer). This customer never sealed her top so the seal we put on wore away and stained (etching) over the course of 3 years of improper care. This is me and my father in the video, probably 7 years ago since we were on peoples court and still our only time ever being sued for negligence done by the homeowner.

Whenever we have an upgrade or remodel or even recently house painted, I always ask the full run through of keeping it in good shape. The instruction on shampoo was design for people like these plaintiff.
Who would ever think that a natural non-porous product like granite would need monthly maintenance with a sealer. And who would think that the installer wouldn't do the first sealer as part of his installation! If I'm paying a professional, I don't expect to become a DIY person and have to do the sealer myself. Hmmmm she should have been educated on what she had installed. Not every installer can direct speak to a customer but when that is the case they leave a paper explaining it With rest of the small jug of sealant. At least in my experience.

It takes 5 minutes. It's just wiping on a scellant. But yes, that's why granite is dated and people opt for low-maintenance quartz.

Same. I have that speckled granite looks great after 12 years. I don’t use an products but damp cloth. Ridiculous. It’s stone.

I totally disagree. I think it’s his responsibility to tell customers they must seal it. And for proof I would actually create and hand out a manual on how to clean and upkeep your new stone countertops! But I don’t think it’s necessarily a lawsuit especially because she can’t prove he didn’t tell her. But question….why wouldn’t he do the first seal for her?
Idk I think someone should have said something but it took her 3 years to bring it up?
A manual could get them in more trouble if someone “followed” it and got unexpected or poor results.

I would ask the customer if they're familiar with maintenance of the product.
And the guy said his contractors were supposed to tell people the counters need to be sealed... But who knows how well trained they are, or are paid enough to care past installation
Thing is on cleaners I've seen, on the back with directions it lets you know what "surfaces" are safe for it's usage

No. It's the customer's responsibility to maintain something he bought in good condition. If it wasn't we would end up with nonsense lawsuits thar everybody would demand a refund for anything he bought. They didn't tell me I had to clean my frige, I want my money back after 2 years. They didn't tell me I had to take care my air condition, I want my money back after 3 years. We would end up with millions of lawsuits from angry customers asking for refunds or a new frige for free.
Growing up my mom had a granite table and prolly 2 or 3 years later the seal started to rub off but she never cared to seal it again😭
These chics think they know more than the owners of the store 😅
The real question is if it always has to be sealed why don't THEY seal it?

She was supposed to put the water on the side that said sealed not sealed so she could see the difference. She put it on the side that was all sealed.
The defendant is not at fault here, but just to really guarantee that he doesn't get sued again, he should mention the sealing of the counter in the contract that the customers sign, that way there's no room for argument.

As a contractor.. WHAT?!?! Never have i come across marble or granite that needed to be sealed. That is assumed and included. Why would it not be if the customer is expecting top notch results. At least with all my subs they know. Why would they give half assed jobs? No bueno in his part too for not doing it right. If he stated it not be sealed then fine and she shouldn't get a free job.
They should either seal it or leave an instruction sheet and the sealer with the client. But no way should she get a totally free bench top.

They say that it was sealed but in the three years, it was never resealed or had any proper maintance done do it which is why there's a discoloring from where it was and wasn't colored. It's not like the installed it unsealed and walked away. Everything needs to be maintained, from hardwood flooringw ith special cleaners, to tile to get the grout done, to wood that needs to be varnished with heavy use. If I had hardwood floors put in and I used cheap dollar store wipes meant for cleaning bathrooms, it wouldn't be the contractors fault for the results of my poor maintance. The judge even said that most people don't reseal their countertop but also don't mind when it gets darker, the plantiff didn't care for it, didn't do research, and her own evidence showed she was at fault because of this.
@Thom ah point taken. I half ass heard it on my way to work. All I heard was it was not sealed 😅 and at the end he stated "because it was NEVER sealed" is what threw me. Get what I'm saying. He stated it was never sealed

The seal wears away over time due to cleaning. The customer needs to reseal it periodically
@@lukerinderknecht2982 exactly reseal. I get taking care of your things and wear and tear over time but I think they should initially do that first seal to be that would be completing their job. Then let the customer know in time they will have to do it again themselves or maybe provide or offer another service and charge people to go out and reseal after x amount of time has passed

In this day and age we have information at our fingertips. There is no excuse for not knowing.

I don’t agree with the verdict. You’re making an assumption that a homeowner just knows what to do to take care of a counter top. I guarantee that there are plenty of new homeowners who have never purchased granite and would never know that anything has to be done other than cleaning as needed. If a company is selling a product, it’s up to them to also explain in detail what the upkeep is. I’ve purchased cast iron grills and it’s very clear on the package or from the vendor, what you have to do to clean them. If I want told, I would just throw the grill in the dish washer unknowingly.
But this is like if you removed the packaging, used it, threw it in the dishwasher after a couple of years and then complained you didn't know.
Maybe learn how to properly take care of & clean the Granite countertop..🙄

It should be sealed AT installation
It was sealed the day we installed the top as we do with every top we install. Sealer doesn’t last forever and is recommended to reapply ever 6-8 months (depending on the stone and sealer). This customer never sealed her top so the seal we put on wore away and stained (etching) over the course of 3 years of improper care.
This is me and my father in the video, probably 7 years ago since we were on peoples court and still our only time ever being sued for negligence done by the homeowner.

Whenever we have an upgrade or remodel or even recently house painted, I always ask the full run through of keeping it in good shape. The instruction on shampoo was design for people like these plaintiff.
Who would ever think that a natural non-porous product like granite would need monthly maintenance with a sealer. And who would think that the installer wouldn't do the first sealer as part of his installation! If I'm paying a professional, I don't expect to become a DIY person and have to do the sealer myself. Now I know to avoid granite...
Just because granite is polished doesn’t mean it’s not porous.

As a homeowner myself I can sympathize with the plaintiff because I don't believe the defendant told her that the granite needed to be sealed during installation.

it is sealed at the workshop when the stone is prepared before it is brought to the house. And we asked after installation how to maintain it.

Hmmmm she should have been educated on what she had installed. Not every installer can direct speak to a customer but when that is the case they leave a paper explaining it With rest of the small jug of sealant. At least in my experience.
