As simple as these engines are, they're very different than modern engines and many mechanics screw them up by not knowing their intricacies. I have one right now that was rebuilt and lasted only a few miles because they screwed up, now I'm trying to resurrect it for the guy.

Technically no because the plaintiff did not purchase the van from the defendant. That would be the only reason for the defendant to get the van back. However it was the mysterious lady who previously owned the van that, I’m guessing, purchased the van from the defendant. She sold it to the plaintiff, so now the plaintiff gets the full price of what he paid for the van since the defendant totally took apart the van, tried to fix it back together, failed, as such the plaintiff needs to be made whole by getting the price for what he paid for the van originally, especially since the van is not able to run.

If the previous owners son burned out the clutch, the clutch is NOT the engine. And you're not going to overheat the engine by revving it up too much to change gears. You can overheat it other ways but not by shift revving for a second or three or even 10 if driver doesnt know how to shift. Also, white smoke would indicate coolant and an aircooled engine doesnt even have coolant. Burning oil if a gasket or seal was bad or the heads warped would come out blue. Unless mandated by law, his warranty just has to say non-transferable and plaintiff would have no case. Couldnt believe defendant said he would buy him a new engine in a text. As for the plaintiff, as much as I think old VW vans are beyond cool, not something I would want my 16 year old daughter driving. Total and complete death-trap.

She stated that even if it was voided the defendant went into a new contract warranty with the plaintiff, which he never had to, but he kept making it seem like he absolutely did, as such the defendant locked himself into a new warranty that now screwed him over because he took in the defendant took in the van to fix it despite him and his workers not knowing how to fix it in the first place.

At the end Harvey says that the work has to be acceptable or the consumer wins. Technically the plaintiff isn't the consumer since he never had any contract with the defendant. With all of that said though, sounds like the defendant is an idiot that probably shouldn't be in business if he can't even rebuild a VW air cooled 4 cylinder. An engine whose design dates back to the 1930s and is super simple. I have owned a couple in dune buggies and have taken them apart in the woods and replaced rings and seals in horrible conditions. This guy should have been able to get it fixed in an actual shop.
The judge said that the defendant did enter into a new contract with the plaintiff when he agreed to fix the vehicle. He definitely didn’t need to, but because he took it in, that was the new contract that was made between him and the plaintiff.
