      That's not quite true what you're saying they do polute if charging of the grid and especially in a fire .The fire brigade don't know how to handle it and the disposal of the burnt ones is ridiculous and if people who have petrol cars are pay tax that fixes the roads why ain't EV drivers especially when there cars are twice as heavy and NSW charges rego on weight because of damage to the roads from weight. Lahiana Hawaii residents have been told don't go near or touch the burnt EV because they are highly toxic after that fatal fire . There's a problem with EV at this point seems alot of euro EVs have problems especially under fast charging and could take out large numbers of cars with it. Pray to God they don't take a residential apartment block . Once it starts run from the smoke .

      Received an email from the Greens taking credit for this. Below is some of what the email read.
      "Labor’s ridiculous tax on electric vehicles was described as “the worst electric vehicle policy in the world”.
      The Greens fought this tax tooth and nail in the parliament, and we’re glad to see this outcome for our climate and community.

    Congratulations and great thanks to you, Chris and Kath, for the great efforts you have put in. As a very new EV owner I have been concerned about this, and wanted it repealed as it was a grossly unjust and environmentally unethical law.
    What a dog's-breakfast we have in Australia, highlighted after this High Court ruling on road-use charges being applied to EVs to make up for the perceived state governments' loss of revenue from reducing fuel-excise tax revenue from incrreased sales of EVs.
    Our roads are largely the responsibility of state governments (and local councils) to build and maintain. But the states are dependent upon Commonwealth government grant funding to pay for their roads bill. The Commonwealth government makes a great show of these grants being paid for by a Federal fuel-excise, distributed out on a 'sort of' per-capita basis to states. In fact several of the smallest-population but larger-area states get far more grant money on a per-capita basis than the larger population states, resulting in excellent highways in the remote outback, and really crappy roads in many of the heavily populated settled areas and major cities.Now with the High Court ruling that the fuel-excise is unconstitutional, the state governments are all in a tizz over how they will be able to pay for roads, or even meet their budget as other consumption taxes could be deemed excises and ruled as unconstitutional (gambling taxes, general vehicle registration etc). It is clear here that as the Commonwealth government is the one that has the power to levy such taxes, then they must take on the role of simply funding roads in all states, irrespective of fuel tax revenue. After all the reality is that taxes do not fund the Federal government spending. The government spends, and then the money is created to pay for that spending.
    Alternatively the state government should design a suitable road-use charge, based on distance travelled and the type of vehicle, and charge ALL motor vehicles on an equitable basis (trucks and buses higher of course). None of this 'one-rule-for-EVs, another-for-fuel-vehicles' idiocy.
    We shall await the outcome, and hope very much that it is:
    1. Equitable
    2. Environmentally sustainable.

    Well done guys, I’m glad I contributed to this fight, I bought my first ev in July 2021 just in time for the new tax. My rego is due next month & am moving to qld, with any luck this ruling has prevented me from paying another lot of the world’s worst tax

    Well done Chris and Kathleen. I'm not living in Victoria but originally from there. The law was backwards and a disincentive to own an EV. Once we hit mass adoption then yes look at ways to cover the fall in the taxes derived from ICE vehicles.

    EV drivers would have received this email from Vicroads today advising motorists to continue paying the unconstitutional road-user tax. What are your thoughts on this?
    "High Court Decision
    The High Court has handed down its decision in relation to the Victorian zero & low emission vehicles (ZLEV) road-user charge.
    The Government is reviewing the High Court’s decision to understand its implications and how the ruling will be implemented.
    Motorists who are due to renew their zero and low emission vehicle (ZLEV) registration should continue to do so.
    We are in the process of contacting all ZLEV customers directly to explain what the decision means for them and any next steps.
    This page will be regularly updated as details of how these changes will be implemented are confirmed."

    Electric vehicles have the same impact on our roads as ICV's - why shouldn't they be taxed based on their usage? Agreed the rule for PHEV's is clunky, but that doesn't mean that EV's should get a free kick.

    Now that the law is exposed as being unconstitutional, it must surely follow that the taxes already claimed have been obtained illegally, as the law is invalid. I suppose we wait to see how the Vic Gov responds, but I expect they will try to keep the money already paid. Is a class action to recover the illegally obtained money next?

    🎉 thank you so much for all your effort. This was a terrible tax created by a State government.
    Ultimately there will need to be a usage charge, but it should only be executed nationally once EV adoption is wide scale and the benefits they bring are being reaped by the community.

      @@chrisvanderstock I get my first EV delivered to me here on KI next week - a Polestar 2 - and have been doing my bit of convincing locals to make the switch. We did need fewer not more hurdles, especially in regional areas.

    I guess this means WA will have to shelve their plan for this before it even began :) It was going to particularly suck for me as I have a PHEV so would be paying twice (fuel excise plus the EV tax), especially when they offer NO EV incentives here at all.

    As the government pressures to penalize EV users, it's important to remember... "Some of Australia’s largest and most profitable businesses are actually able to claim their fuel tax bills back under a rebate scheme. In total, $7.8 billion was paid out in fuel tax credits in 2019-20. Oil, coal and gas giants claimed $14.5 billion in fuel tax credits between 2006-2007 and 2019-2020".

    Thanks for your efforts, my donation was well worth it. As the tax was technically illegal are you going to chase refunds through the Supreme Court of Victoria if they are not forthcoming?

      The Courts findings are in 393 page document. They're working through it.

    Does this mean that Australia doesn’t have the EV road user charges that NZ now has?

    I want a refund on the road user taxes I paid. A total of 45,000km worth = $1,260. It was unconstitutional from the start so they have no right to keep the money.
