  • This is a 2004 Documentary about Jean MacColl's quest for Justice For Kirsty. Her campaign (see www.kirstymaccoll.com/communi...) ran for another five years before being wound down - see the final statement from the campaign team here:

      It was clearly explained the fine is based on the income of the guilty party, and a boathand in Cozumel makes nothing. It might seem like little to us, but to the boathand might not be.. The judge is following the law. If the law has to be changed, thats another issue.

      @Jacob Fenrir I saw it completely. I did not expect that the whole thing was about how much money we can get. That is not necessarily justice.. The whole documentary has a tone of "Those 3rd world Mexicans are all corrupt" thing going. "We British will go show them how proper things are done".. With all due respect and I understand her loss, but the lady expects a country to stop and all pay attention to her. Sorry, just been candid here. I put a LOT of blame on the markers not been deployed.

    Dear Mrs. MacColl (who passed away in 2017), how much I admire and respect you for your tireless campaign to avenge your daughter's death. My beau's son was contracted AIDS from a tainted blood transfusion when he was two and he died at 11. You were right: there's never closure. There's just acceptance that one cannot change what's happened. I pray you're with Kirsty now, dancing and singing.

    It is so repulsive, criminal and tragic that no one was held responsible for her death. The life of a mother and young artist was ended in a matter of seconds, and that's it? Say no more, or what?
    I hope her brave mother was united with her when she also past away after battling for truth and justice. This world really, really, sucks. R.I.P. Kirsty ❤️

      Mexico is a very corrupt country. In the 1980's Presidents de La Madrid and Salinas are mentioned in Cathy O'Briens book "Trance Formation of America". Cathy was a victim of the CIA's MK-Ultra Project Monarch program.

      @@Smudgeroon74 oh that's interesting to know. I was led to believe that Kirsty's death had more to it. I was told something about a rockefeller connection, but having watched this, I'm not sure where they got that from... I've never read Cathy O'Brien's book, but I did watch a couple of her talks... there arebmo words that can describe how horrific the things she and her poor daughter went through were.
      It's a very important book, but I'm not sure if I'm strong enough to read it, moreso now that I'm a mother myself.

      @@Smudgeroon74 and you're right about the corruption in Mexico, it seems to be the same all over South America as well. It was also something I noticed in Mediterranean countries and in Eastern Europe.
      In reality it's no more corrupt than England, it's just so much more blatant. A Bulgarian man I was talking to the last time I was there put it well "the government is just as corrupt in your country right at the top and in the middle, but here it goes right to the bottom"
      Not so long ago there if you wanted to drink drive, you just made sure you had 10lv in your pocket in case you were stopped. It was just like a tax you paid to the police.
      In some countries you still have that petty, low level corruption going on as well and it just seeps into every part of society. When that's what you're up against, how do you fight it? Money talks, but it talks a lot louder in poor countries!

    Nothing but ADMIRATION should be sent to Kirsty’s mother, Jean, and everyone else who so graciously spent so much of their time and effort trying to seek justice for Kirsty’s death.

    Disgraceful cover up. Shame on them seeing an elderly lady hobbling around in an effort to achieve justice & finding a despicable criminal cover up at the highest level. Not only was a crime committed resulting in death, they allow lies to be heard & unpunished because they can't be arsed to serve subpoenas. They stinks the lot of them.

      My thoughts as well. It’s very difficult with countries with different cultures and law - look at Turkey, Dubai, Greece, Portugal and Egypt. These countries are very happy to accept British holiday makers money, but will not help out if things are let’s just say a “little contentious” especially if high profile local individuals are implicated in committing crimes against said holiday makers or if their lucrative holiday industry may be damaged - it absolutely disgusts me.

    Remember as little kids me and my brother met Kristy at the Heineken music festival in Portsmouth. My family had access to the backstage area and we kept running up to her every few minutes asking for her autograph. After the 4th time she ask "what you doing with these?" We said we are selling them to your fans through the fence for a pound. She laughed and said good on ya but this is the last. Thank you for being so kind Kirsty! RIP sweet lady!

    My cousin aged 19 was killed by a drunk driver , here in Ireland , the man who killed my cousin was a doctor , and lied about driving said his wife was driving , but there where loads of witnesses who seen him kill my cousin and guess what that murderer went on to be a doctor 💔

      Destroyed the diving instructor's life too by the sound of things. This goes to show that I don't think it's necessarily Mexico's justice system that's totally at fault. The whole system on a global scale will bend to the will of a rich psychopath which I would bet senor Gonzalez is. Most of these high level CEOs are psychopath's it's how they get were they are, lawyer's are the gate keepers of injustice. Money talks, pay enough money to grease the justice system to facilitate an outcome that suits the man paying. The is no justice against rich powerful people it just is. The words reveal everything.

My friend Geoff's dad was murdered in Puerto Rico when he was the same age as Kirsty's boys and the killer walked away scott free in that case as well (fanbuzz.com/pro-wrestling/bruiser-brody-death/) and you can sense that a huge part of him will never fully recover...

      I'm sure it did take a great toll on Jean, but it also gave her a purpose and brought her in touch with people who loved Kirsty. So very sad that she didn't get the right outcome. Just very, very sad.

    I cried when Kirsty died and I cried again watching this. She wasn’t one in a million or even billion. Kirsty was a totally unique individual with a beautiful voice and a fantastic song writer. The strength her mother had to continue the fight for justice was incredible. It’s a shame she didn’t see justice done before she too passed away. My thoughts are with Kirsty’s sons, family and friends. The only positive thing I can think of is that at least we have her body of work and beautiful voice to listen to forever. R.I.P. Kirsty.

      Yeah he shld have been made to pay compensation... and also to the diver who spent many years of his life helping her mum to get justice ..it wld have been a horrific sight ...a captain will go down with his ship.. if he was saying he eas responsible for the boat as owner , OK we know it was accidental but it was careless and wreckless and cld have been avoided .... and he shld have took responsability for the sake of the money..wich he can't take with him

      @@The000clash000 I can't help but think the people, on the deck or at the helm of the Percalito, should have avoided tearing into an area where there were other boats stationary - flags or no flags. It's meat headed arrogance that killed Kirsty. It's the same kind of arrogance that puts drivers behind the wheel in SUVs with bull bars etc. Their only thought is, "Well - I'LL be unharmed."

      @@The000clash000 True that was an error, even so the area they were diving in was heavily restricted for boats. The boat owner well knew that and the lack of flags wasn't an excuse for his actions. It's a bit like saying, I know I'm driving through a 30mph zone but I can't see any pedestrians so I'll put my foot down and do 50mph. If you do that and hit someone you are liable, even if the pedestrian made a mistake of stepping out without looking properly. I feel sorry for this guy because he did make a mistake of not putting out the flags and that has clearly haunted him ever since.

      Ditto. It always been one of my very favourite Christmas songs. It's a raw, brutally honest ballad, without all the all the commercial Xmas dressing.

      I agree, that kind of integrity is sadly scarce in this world now. Most want to turn a blind eye to wrongdoings and misgivings in our ever descending society

      He wasn't an Instructor. He was a Divemaster. This means, all the divers in the water were qualified Open Water divers. Although mistakes were made by ALL parties, and as a Divemaster myself i will say this.
      The correct protocol for all qualified divers on returning to the surface in open water after a dive are as follows:
      Before making an assent, the diver should deploy an SMB (Surface Marker Buoy) displaying either the 'Alpha Flag' or the 'DAN Flag' to warn above boating traffic that there is a diver (or divers) below... regardless if the area is a restricted to boating traffic.
      This SMB is an inflatable flotation device that the diver inflates with air and sends to the surface on a line.
      After the SMB is deployed the diver ascends to a depth of 5 meters to perform a 15 min safety stop. During the safety stop the diver listens for boat traffic. Water conducts sound 4 times faster than in air so, you will hear a boat at depth sooner than you would at the surface.
      After the safety stop the diver or divers ascend staying as close to the SMB as possible.
      So in my view, these were the things that went wrong.
      A) The Dive Boat were not displaying the correct flags showing that there where divers in the water.
      This is the responsibility of the Captain. So he or she has some of the responsibility of Kirsty's death.
      B) The boat that struck Kirsty also has some responsibility. And that responsibility stops with it's Captain regardless who was at the helm or who was posted as lookout. Captain carries the can (ALWAYS) even if he or she where below decks.
      How this can be disputed is beyond me because it is Global Maritime Law.
      C) All divers holding Open Water qualifications where responsible for not marking their ascending position in the water column known to boating traffic.
      There was no instructor present, right? Only a Divemaster therefore, under PADI regulations all divers would have been qualified Open Water Divers and responsible for themselves.
      As a consequence, EVERYONE failed in their responsibility. The dive boat Captain, The Captain of the boat that stuck Kirsty, the Divemaster and all the divers in the water... resulting in a death.
      As a Divemaster myself for best part of 20 years i have witnessed many deaths. Too many! SCUBA diving is the most dangerous of all extreme sports. Far more dangerous than parachuting or mountain climbing.
      Water kills! Dive at your own risk.
      If you participate in this sport... follow every regulation and rule to the letter.
      That said, in all of the fatalities i have ever witnessed... in all cases, someone flouted the rules. And when this happens... people die.
      My heart goes out to all involved. It's sad... but sadly, it happens every day in this sport.

      He was a dive master, not an Instructor in this case. This is an important distinction. Dive Masters are often supervising inexperienced divers per their professional license allowable duties. They are not particularly well paid, and in some places, this job is the best paying job on the beach. The poor man lost a career, because of the actions of 2 people that day. The boat owner for going at a speed above 5knots within 50m of a dive boat operator, and then letting an untrained person helm the boat at great speeds. At 15-20knots, there is very little the DM could have done anyway. Even if he heard it coming underwater, and he stopped the ascent of the divers, I don't think he could have done it in time, because stopping an ascent takes planning and preparation. I am not convinced the dive boat didn't have appropriate flags flying. Any half decent operator will have one. I believe that is an excuse for the boat owner and driver used to cover poor water craft safety practices.
      I am a PADI Master Scuba Diver Trainer #477213 - the views above are based on my own professional assessment of the situation as presented through experience, training, and education. Thankfully, I have not lost any of my students or customers to such a horrible set of circumstances, and even though it is 20 years after the event, the courage that Dive Master is exhibiting by telling his story, I would employ him in a heartbeat, because he has integrity.

    As a music journalist, I just once interviewed Kirsty MacColl... There was an absolute light, indeed a delight, around and about her. (That isn't always the case and it isn't what a journalist expects...) However, I was very taken with her, I found her hugely attractive and very feminine in the best sense of those terms and indeed it fell to her to rather put me at my ease as we talked. (I wanted and would have run away with her had she asked... She was truly beautiful in every way.) I got the impression that this wasn't unusual for her and she bore with my genuine crush with a kind of amused kindness. I have interviewed everyone from Bowie to Beyonce and it's not the job of an interviewer to 'crush' on the interviewee. (That's actually rather unprofessional.) As ordinary a woman as she was, she had a kind of special sparkle about her, she was warm, funny, very knowledgeable, kind, engaging, beautiful and yes, incredibly attractive. (I absolutely fell a little bit in love with her...) Her amused reaction to me only later caused me to think that she probably got that a lot... Rest her special soul. xx SF

      What a wonderful tribute. She was truly loved. A wonderful artiste who wrote some amazing lyrics. She also did great credit to other writers work especially Day Davies and Billy Bragg. In These Shoes is an amazing song. What a very sad loss.

    So very sad. I’m watching this in November 2020. I was unaware of how Kirsty died and was shocked to know that her family did not see justice for her death, that being the responsibility of a wealthy businessman in a third world country. Money is power, and this story goes to confirm that theory.

    It reminds me of the young English man who was killed riding his motor bike. The woman who killed him was driving on the wrong side of the road. The woman was the wife of an American diplomat & she left the UK claiming diplomatic immunity. She is still in America & she has got away with killing that poor lad. Kirstys death is similar in that the killer got away scot free. I didn't know the details of Kirstys death until I watched the video, but it was a terrible tragedy.

    Kirsty is a hero. My mother abandoned me at age 6, so I grew up not knowing or remembering my mom. Since I learned about her death, I celebrate her on Mothers' Day for having made the ultimate sacrifice for her children. Kirsty died for her sons, there's no greater love a mother could give.

    May God richly bless that divemaster- he is a good, good man. When he showed them the spot to lay the wreath, & was standing right beside her mom as she broke down, & put his arm around her... wow... he didn't have to do that. He didn't have to help her bear her burdens... but he did. Deeply moved me to tears. If only everyone had a heart like that.

      Precisely! Just appalling. Kirsty's totally avoidable, violent death was the most appalling tragedy, but the multi millionaire who caused it compounded his sin by refusing to accept any responsibility. Instead he bribed a low paid member of his staff to take the rap for him.
      Carlos Gonzalez Nova was a poor excuse for a man and human being. I hope Kirsty's death weighed on his conscience in his last moments on Earth, and that he has now faced the ultimate judgement!

    She reminds me of Sharon Tate’s Mother Doris. Even though her killers were caught, Doris was at every member of the Manson Family parole hearings. A tough woman who while her and her other daughter were still alive, they kept these people in prison. 🙏🏻 Rest In Peace Tate Family.

    So sad for all concerned. I think the Mexican authorities treated Jean terribly. I loved Kirsty’s songs she was very talented. I saw her perform with the Pogues in Leeds and I will always remember how much We, my son and daughter enjoyed it.

      When I went into labour in 1987, my partner had tickets for a Pogues concert and I said, go, go, don't miss the Pogues. He caught up with me around 2am in the local hospital and our son was born at 7am. Fairy Tale of New York is one of my favourite songs and it is such a remarkable song because of Kirsty's vocal.     Imagine how many more cases like this all covered up that we may never know about. We know about this incident because she was famous enough for people to know about it, and because her mother continuously sought to find the truth no matter how far she had to go to get it. Had either of these things not been the case we'd never know the truth. There's probably so many other incidents like this that we'd never hear about. I hope that this incident causes more awareness of other ones too and makes more people search for the truth when these sorts of things happen.

    I thought she drowned while trying to save others drowning. I had no idea it was like this. Thank you for sharing this and putting me right. Oh my goodness that was heart wrenching. Her mother is completely heartbroken I do hope she find peace. I hope the boys flourish and live long lives and happy ones. Kirsty’s voice will live forever and surround the family with love. Her partner and ex husband as well. So many questions so few answers another family left trying to do the Home Office’s work.

    It genuinely made me want to cry. Those poor children who witnessed this terrible tragedy. Then Jean. Kirsty's mum still in the midst of grief and doing such good for her daughter. It was and is a heartbreaking ending to a lady who was a real raw talent. I am playing the best of Kirsty MacColl in my car at the moment it is I just love her music. A lasting legacy to her talent and Kirsty's sons are a credit to her. It is just a tragic loss. RIP Kirsty MacColl.

Dear Jean wherever you may be god bless you and all those fighting for truth and justice then and now. Im a Mexican born individual, many decades In Britain and in complete allegiance with British values, as I am with good Mexican values (Family, etc) . I fully understand your struggles. I am happy you managed to come across incorruptible helpers in Mexico. I apologize on behalf of good mexicans for unnecessary failings which hindered the progress of your investigation, adding insult to injury in the process . I hope you all found some sort of closure, in as much as any closure can be had.     My mother loved Kirsty and told me this story when I was a kid. Then years later, my mum found herself in the same situation as Kirsty's mother, when my little sister was killed by a train in 2015. This was heartbreaking to watch.

      @@patsyhodge9071 No culpability for the poor divemaster there, his responsibility is specifically the 3 divers, not the surroundings. Clearly the lunatic at the controls of the boat that hit KM was simply going way too fast, either he knew the area so would have known the boats were dive boats likely to have divers nearby, or didn't know the area so shouldn't have been going so fast in unfamiliar waters near other, stationary boats.

But, there were more than 3 people diving from the other boat and it was mentioned that the diving bouys were not put out as they should have been. Its a universal diving code all over the world when tourists are involved. Its so very sad for the Divemaster. I understand his suffering and regret. And Kirstys 2 boys who saw it all happen, omg the trauma will always be there. Kirsty's mum doesnt blame him at all, but yes he should have put the diving bouys out to protect his divers. That part was kinds skipped over.

    The campaign was eventually wound down without any satisfactory resolution other than raising awareness of safety at the resort. In the end and despite high level government support, the campaign was unable to get far enough with the Mexican authorities to directly affect the case, but Jean MacColl never gave it up and sadly passed away without a happy ending.

    Kirsty had such a unique and earthy voice that touched your heart. Her beloved Mother who fought so hard for her is with her now in paradise. The selfish boat owner who has never once expressed guilt or even sorrow for her young promising life will one day have to face the ultimate Judge.

    My God I didn't know any of this had happened . I got here via the Pouges and decided to find out more about Kirsty and her carrer. I love her voice and indeed was a bright light taken way before her time 🙏 ❤️💕

    What an interesting documentary.Kirsty Mc Coll was much more than a singer of an iconic Christmas song.Jean was a strong,devoted parent.Wonderful courageous lady.Kirstys son's are a credit to her and their father.Very sad story altogether.☘️

    What an extraordinary mother you were in your fight for justice for Kirsty , her strong & beautiful sons & all her wider family, friends & musicians. Respect to the brave men / diving instructors who spoke out in this program. Kirsty MacColl's music is the sound of my adolescent years & i'm in tears today for a family & a world that is missing such a beautiful woman. May this loss weigh heavily in the souls of those responsible.... who didn't have the conscience to take responsibility for their actions.

    I was totally unaware of her demise, so very sad and cruel, those poor children must have suffered nightmares for years to come 😢 She was such a very talented lady.

    Tears are a sad and a pure lament to the life of the one you loved, your pain honours the existence of that life also. That's what I think when I miss my mother who died aged 42 and loved Kirsty Mccoll. Thankyou for the days.

    Can't believe they missed out she played a hand in the Madchester indie rave scene back in the late 80's with her classic vocals on Happy Mondays - Hallelujah track what a point in music history to miss out !

      pretty sure that was tremaines 1986 track "in the morning" they used on hallelujah. its pretty well known, the acapella came out on the bootleg lp "acapellas anonymous vol1" which every dj in the world was using (including messers pickering and park). in fact there wasnt a mix tape between 1988 and 1990 that didnt have that lp on it somewhere in one form or another.

      She sang on countless classic pop tracks including Ask by The Smiths which also isn’t mentioned but I think the main focus of the programme is on her tragic end and life behind the music.

      I didn’t know she was on Hallelujah. I’m in such awe of her. Her hands were all over the eighties. in North America she isn’t well known but she chose the track order for the Joshua tree as well.. yes U2. because lillywhite worked on that album. And then the pogues of course, smiths, Tracey ullman, Billy Bragg. She just seemed like an angel and so talented

    I have listened to Kirsty’s music and never knew this happened. This needs to be more prominent in the media. I hope this isn’t another tragic incident that fades into history. She was an amazing talent, her mum is amazing. To her children, you’re mum would want you to live rich lives, remember her, but enjoy your lives.

      It already has faded for the Mexican authorities. Kirsty died 2000. That film was 2004. Her Mum died 2017. The CEO never faced justice. Never will. Isn’t having mullions great!

    At the time , her death had a huge impact on me. It was distressing to me that her sons were so young when she died. That hit me hard

    I’d forgotten all about that gem...” there’s a guy works down the chip shop “ I thought she was incredible but then she vanished. Thank you for reminding me of an incredible talent.     Remember listening to fairy tale in New York as a kid and like many others you new it was Christmas and it still breaks my heart when I hear it but Christmas wouldn't be the same without it.

    As soon as I heard that the captain was rich and succesful ,I thought immediately '' he'll never get convicted. why is it always the rich and powerful always walk away from these things. It's rhetorical and i get it. God bless her mother and the diving instructor and everyone else involved in pushing this investigation.
