God! Prior is nasty. Exhuming Tammy was not an affront to the family and I’m sick of him insinuating such. She was exhumed due to a murder investigation.

I dont know what point he thinks he is making, as every time he says it, he just reinforces to the jury that her kids didn't give a toss about her, and were quite happy to let her murderer go free. They don't care that she was murdered, its all about Chad, like so what if he killed her!

Hi GiGi! I'm so sick of Prior repeating "When they dug up Tammy from the ground" every single chance he gets. It sounds terrible and he knows it! That's why he says it. It creates a picture of a couple of grave-robbers desecrating her resting spot for sinister purposes or something. When in reality it was professionals trying to seek justice for the poor woman. I agree.

You HAVE to check for wind-speed and direction when you are going to conduct controlled burns on ditch and canal banks in order to protect yours and other peoples properties. From what was said, the smoke and fire would have gone over to where Emma was living. Covering for her father meant that if it came over her way she could report that it didn't thus protecting him. Garth thinking he was just protecting his dead mothers honor, kept this secret and then was locked in by threat of imprisonment is he deviated from it. Emma? That girl KNOWS what happened. Sure it would be nice to hear from him again, but judge B didn’t allow it because he knows damn well that the prosecutors don’t need his testimony to bring this case home and if he DID let him take the stand, it could give Chad a great reason to overturn the verdict on appeal. I think, based on the co-workers testimony, that she was dead downstairs by 1am. Chad was ‘asleep’ UPSTAIRS, having completed the dirty deed, abetted by Alex Cox, whom he had earlier collected from Salem Church to get the job done. (During which time Alex turned his phone off). Based on the circumstantial evidence provided, and which the Defense have been so desperate to disprove, it would seem that Chad had been sleeping upstairs for some time (which would lend credence to the fact that he and Tammy had become somewhat estranged), or perhaps he just snored loudly! I don’t think he expected Garth to find her until morning, and when he found her earlier, asked him to hold off so he could maintain the facade of the ‘marital bed’…. I don’t think Garth lied for nefarious purposes.

The last thing that anyone needs is the family making a scene at an exhumation. There was a court order to have the body exhumed, so, it was going to happen whether the family liked it or not. The medical examiner doesn't need the family yelling at her while she is trying to do her job. Especially when the family already made it clear that they didn't want an autopsy. If a family member were to physically act out in an attempt to prevent the exhumation, which may likely occur since they don't want the autopsy, law enforcement would have to restrain or arrest them. Nobody wants that because they are victims. Law enforcement is under no obligation whatsoever to inform the family. This is a murder investigation!!! I wish that the prosecution had made this clear to the jury. They didn't address it at all.

A bit on Perjury from an old, retired criminal defense lawyer/ prosecutor....
The crime of Perjury applies when a person KNOWINGLY AND INTENTIONALLY makes statements under oath in order to intentionally mislead or deceive the Court (meaning the Judge, the jury, and the opposition.) People ARE fallible. We DO forget details or mis-remember things.
So LEGALLY, there's a pretty big burden in proving Perjury, rather than simply being mistaken.
Also, some people who don't remember parts of events sometimes "fill the gaps" in their own minds. They can convince themselves these things are factual. Again, not Perjury.
BUT. In cases like this, where there's already a VERY strong indication of family members having been "coached" or that they colluded to "get their stories straight," THAT IS PERJURY. It's also WITNESS TAMPERING.
But again, the bar is pretty high to reach the CRIMINAL level of Perjury.

Before I explain my thought, I will note that I do believe that co-worker who said Garth told him he was the one who found his Mom dead with no one around. The part im having a hard time with is the "why" behind why exactly Garth changed his story. Obviously its bc Chad told him to but why?
If Chad said "Hey Garth you need to tell everyone that I was there and called for your help" etc; (aka the story we all know)... but why?
The only thing I can come up with is this: Chad allowed Alex entry and left the home so Alex could kill Tammy.
Perhaps Chad was scared his kids would see him with Alex in the home and that would be blatantly suspicious, given the time and the fact it would have been when Tammy died.
Maybe Chad really wasnt there but he didn't want to look suspicious for being mysteriously gone in the middle of the night/morning so he asked Garth to lie and made the story we've all been told.
Think about it- it would look extra suspect if the police were told Chad wasnt there. Considering he lives there, and that was his Wife and pattern.
I think Chad left and Alex went in to kill her. Then while Chad was still gone, Garth discovered his Mom dead. Chad probably didnt think Garth would notice, he probably assumed it would appear as if Tammy was just sleeping. especially that early in the morning. Im sure Chad had a plan to "discover" Tammy himself. But instead Garth noticed first.
This leaves us with so many new questions in this already complexed and incredibly nuanced case.
One thing I do know: Chad and his kids are not believable. At all.
    What do you think?

    • @sarahchamp1
      @sarahchamp1 4 месяца назад +2

Was Tammy‘s body found in the cozy cone or in the bedroom of the main house? If it was in the cozy con, then it would be easy for Alex to just come in and kill her without anyone really hearing a struggle. It would’ve been easy for Chad to do it as well, but he was too, scared of being caught and Alex did tell Zulema that he wondered if he was the fall guy.

Cellphone data would help, if any. I think that Chad would never lower himself to commit an act of murder; he’s an exalted one, remember! I hope he goes to prison for the rest of his life as I’m positive he directed this whole theatre of madness, but he would not lower himself to commit murder and risk tarnishing his eternal soul (Mormons are big on eternal souls) they got Alex to do all the killing, and they were probably only involved in the disposal for some insane last rites purpose. His family seem very complicit on what was going on. But answer me this! I always resented that this happened just before covid, I’m 100% sure that his kids have all sat in quarantine believing he’s right about the end of days. How do you convince them otherwise? That also is another sign Alex was really about to be a "fall guy."

If I were a juror on this case, I’d think Prior calling in the last witness today (the examiner who looked at Tylee’s charred bones), didn’t help Chad at all. I’d be sitting there thinking, it’s probably more than likely Chad was able to set fire to Tylee and burn that much of her in the time frame. He knew how. He’d worked around mortuary science for many years. He’d know exactly what heat source to use and what accelerant if any to use (such as plenty of wood if not gasoline, etc). He knew exactly how to do this, what to use and where in fact to get his hands on material, tools and equipment to do so.
