These dispatchers were not bad as they were trying to make sure the police and emergency people were not headed into some sort of ambush.

Yep! My sons dad and I had an altercation he dragged me down about 11 stairs I made it to the kitchen and got a knife stab him ( He lived) first thing the officer said when I was handcuffed remember you came to his property.
Yeah I’m not sure about Michigan laws but in some states just going on someone’s property with a visible gun gives the owner the legal right to shoot.

Pretty much, that's the moment when you lose self defense status. Just watched another video where a lady showed up to fight some guy, and when that wasn't going as well as she thought, she pulled out a gun and killed him, and tried to claim self defense lol.
They didn't need to drive to the guys house so his wife could prove she was ending the relationship in front of her husband. It could have been done on speaker phone. No guns needed.
I hear they'd ended it years before this happened.

This story is kind of confusing. At least for me it is. Why not just call 911 and get your love ones to safety, Danny? Why would you even agree to go there, Kimmy? I mean, I get they’re gun holding upper middle class individuals So, guns and stand your ground laws (instead of keeping your family safe) are their first option. But, this just sounds dumb.

@@fernfunk A small percentage of domestic murders are carried out with a gun. Also the anti gun crowd loves to ignore how many people save themselves and family members by owning a gun. It's a pretty good equalizer and deterrent when you don't have the physical stature to fend off a bigger stronger aggressor.

I might be able to hold my own with a 5ft5 man but even that would be difficult. I've never met a man smaller than me so it's pretty safe to say most men are bigger than me. And usually a ft or more taller than me. It's pretty scary to not own a firearm when I spend most of my time alone at home and in public. I'm middle aged as we speak and have been cheated on, Weed and booze was involved as well, also I came from a broken home, my dad cheated, he was an alcoholic, smoked weed,had a temper and carried a gun, this was many years ago, I was a teenager when all this was going on. Exactly! A lady from a town I lived in died in a flooded car bc the dispatcher was so impatient with her while telling her to “calm down” and “relax” delaying the time response for location. It was so sad.
I don’t normally judge descriptions but when they released the dispatchers photo, she looked like someone who was not empathetic at all.

Matthew forgot about one key thing in his Super Marksman Target Shooting and Hunting experience: Those targets and animals can't shoot back like Daniel could.

I am always amazed that the spouse who is being cheated on....always blames the affair NOT on their spouse, but on the new person. I think that if a marriage is solid and loves each other for all the right reasons, that anyone can attempt to get in between any of the two and fail.

Yes!! It is the spouse who made the vows to you and also kept up the lies to you. Often, the other man (or woman) doesnt know the whole situation in your marraige or even IF there is a marraige.
It comes nowhere close to being 100% one way or the other. BUT in the scenarios that it does they subconsciously know that they are doing something to drive their spouse in the arms of another. There's often time little to no logic used but with this case the slain wife was also giving money to the guy she was messing around with.

Typically more than one dispatcher will assist with this call. One dispatcher will continue to have the conversation with the caller while another dispatcher sends units. I do agree with the callous attitude though
100% correct! People simply don't understand how the system works. Dispatchers are the most misunderstood emergency responders on the planet. Thank God for them!

He may very well be in pain but he also chose to drink and take substances, chose to assault his wife, chose to take a firearm and a second magazine with him to confront his wife’s lover and chose to shoot that weapon at others. He is the cause of his own misery and the cause of his wife’s death. I am not at all uncomfortable mocking him.

The only thing I don't grasp is they thought it was a good idea to go there; she could have called to break it off for good and put him on speakerphone and had a short discussion. They were definitely impaired at least a little to make that decision. Which is probably why it didn't sound like an absolutely horrible idea to them -- but I believe they wanted to move forward from the affair. The whole thing is unfortunate.

@@auzieblo - We all react differently. I got the news that my mom died, called my boss and my husband, packed my bag, got gas and food, and was on the road toward home for about three hours before it hit me.
My mom died when I was 8 and I didn't have such kind of tantrum. I have had many losses in my life of my loved ones and never ever felt like throwing this kind of tantrum.

No surprise they aimed to charge HIM for his wife's murder, and not her lover. She may well be still alive BUT FOR his persuading her to go there, and then aggravating the situation (In England we call it the BUT FOR test). Did they establish who it was who shot first? I imagine Daniele (not Daniel?) was entitled to 'stand his ground'. upon his own property.
But Matt, well, he pushed Kim to go over there and end it, right in front of Matt. And Matt went there armed, like he was ready to shoot if need be. Matt wants to come over like he's innocent, like they all do, but he needed to calm his temperament. Adding alcohol and drugs to the moment exacerbated the mood, he was not backing off.
The way he went on after learning Kim died, felt like a put on, so the cops would go easy on him. That emotional mind again, with access to a firearm. He's quite a shot, a hunter, hitting bullseye after another at the range. He went armed and he was not backing down, he, for me, was more the aggressor. And this time, it didn't hit the bullseye.
I think the wife tipped off Daniel, that they were coming. With the amount of drink, drugs and guns involved, I'm amazed only one person died.

I know this is kind of besides the point, but "Daniele" is Italian for Daniel. From his surname, I imagine he had an Italian background, and it's simply written like the Italian name.
I sincerely disagree - its simply wrong to shoot at someone running away. If you are not in fear for your life or that of others there is no justification for deadly force.
People get in arguments and emotional altercations all the time - that doesnt make it ok to shoot at someone when your life isnt under threat.
No crime would happen "But For" people being born, hows that argument. the whole "but for" approach just breaks down in the end
@@jamesf8507 Well, the fatal bullet that killed Kimberly was fired by Daniele, not Kim's husband. Yet Kim's husband was found guilty of her manslaughter, not Daniele for murder nor manslaughter. So why was that?
You said it was not OK to shoot at someone when your life is not under threat. Not my point, and irrelevant here. It was reported the husband and Daniele exchanged gunshots, not which one fired first. So, if the threat was not perceived to have been around at the time, why was Daniele not prosecuted?
I'd say it was because the husband remained a threat until he was off the driveway and down the road. He was not. He was still on the driveway when Daniele shot the fatal shot. The threat was still there, Daniele was seen as justified in shooting to defend himself and his property.
Now, I suggested the 'BUT FOR' test, because why else was the husband convicted for his wife's death? She would probably still be alive today, BUT FOR the fact he forced her to confront Daniele for the husband's contentment. And the husband went there armed, as if to expect he would shoot if need be. Or wanted to. And he did.
Yes, people get into altercations a dime a dozen. I've always said an emotional mind coupled with access to a firearm eventually explodes into a shooting. The husband was a prime example of that in the above incident. A very good regular shot, he went armed, he was highly emotional. Why did he go there with a firearm?
And how has my BUT FOR test theory broken down, when applied to the incident, and the ensuing conviction, makes sense? Like I said, why else did they convict the husband for his wife's death? Was that therefore an unsafe conviction?

First of all he didn’t shoot her, the other guy did, so he is not the guilty one, technically, so he’d have nothing to fake reactions for, second of all of course he fell down, he just found out someone he spent every day with died, I doubt it was fake.

When I found out my husband was fooling around, all I could think of was, getting away from him. Yes, I still thought i loved him, but I knew no matter what there was trouble brewing, and needed time to think through things. When your husband is involved with another woman, you have to realize, no matter how you feel or what you want.....it's over. My feelings are, don't walk..."run" as fast and as far as you can. Go find a place where you can cry yourself out and begin to think.

That was a bad play by the detective. He should've never made him wait and shouldn't have told him the truth. In other interrogations they just say they're at the hospital being worked on, and they'll let them know when they find out. To avoid the theatrics, and the suspect giving a different version of events. Like oh crap, this could be murder now.

I don't believe for one second it was that lady's idea to go break it off with this guy in person, with her husband with her. I mean, if she was on coke and weed and drinking- maybe, ppl do weird stuff when they're out there like that, but no woman I know would do that. That said- I've seen plenty of jealous guys who would demand their wife do something like that- right in front of them- or it's over. Especially if they're wacked out on weed, coke, and booze. I think that's far more likely. I also think when they got there, and he got out of that car and approached this guy he probably looked super pissed and was being very aggressive. And I think this guy was probably about half expecting him to show up, knew he kept a gun on him, and was afraid he was there to kill him. What a mess.

I had to hold my breath when that cop first came in to take the cuffs off the larger and clearly agitated man while his holstered gun was sticking out for the maniac to do something stupid. Why do some departments allow guns in interview rooms? Serious question that i ask a lot but never get a good answer.
The gun probably would have been surrendered 1) because he's in a police station (although I have heard of stories about people firing shots in pole stations) & 2) because it may be included as evidence in a trial.

Maybe easier for some than others. Not sure if you caught the end where it said the day or so before this incident, the husband had hit the wife in the head with a heavy glass picture frame, leaning damage, and that she had other marks and abrasions on her body. I'd guess that she might be terrified to try to leave- he'd "forgiven" her for cheating once because she stayed with him and he treated her like a possession. Which is probably why he didn't hurt her (or hurt her worse since we don't actually know when he found out and what may have happened then) this time and wanted to go over with his gun to intimidate his wife's lover in front of her- to show she was still his and to maybe scare her further, maybe even threatening to kill any guy she ever talked to again. One thing is true- the most dangerous time for someone in an abusive relationship is when they try to leave.
