OSHA would say the rails werent at the correct height, fine the contractor, then tell workmans comp that the worker must be blood tested before any claim can be validated.
What were the injuries of the aftermath? Every year construction workers fall not necessarily big heights but with permanent injuries! Both workers are not wearing any harness or retraining what so ever.

Exxon employees didnt have to wear anything. Bc therr safety official even said a harness will do nothing at this elevation . Finaly after 2 wks they let us ditch the harness. Theres grey areas were whatever is under could possibly do more damage by having one on and letting it snatch. 4 days later the turnRound was over but we won that battle in long run!!!

This is a perfect example of the rewards of stupidity, and not understanding your body's limits properly. At least he managed to lessen the damage by grabbing hold of the scaffolding before slamming into the ground. That fall could have ended far worse for him.
This guy was NOT a construction worker. He was never on scaffolding per say. we scaffolding builders know the signs of a ground guy and a guy that works off he ground

Sometimes fear is a form of protection. If he had height phobia he would have been more careful.
Basically, doing something which could've been done safety from the ground is one of the first considerations that was ignored here.

doesn’t look like he was seriously injured; his left hip seems to have taken the brunt of the fall, and it’s pretty strong
