Insurance companies are horrible. They never want to pay what it takes to fix the car. Loopholes in the customers contract. I work at a body shop. Make sure you’re properly covered. The insurance companies that advertise on TV are the worst for dragging their feet during repairs.
He has to sue the insurance company in small claims court. By traffic law in most states, when a car hits another in the rear, they are deemed to be at fault. The court will make the insurance company acknowledge the law and should rule in his favor.
What if they pay the court officials?

You have to file a suit against the driver. Even if you sue the insurance company, if the policy holder does not call to request a defense it is still a non cooperation denial. But yes, a lawsuit does help. It helps when they get served and triggers a call to their insurance company.
So all your saying is if I rear end someone all I have to do is not talk to my insurance to be not at fault
Dude just get a lawyer. Insurance companies never want to pay, they just take your premium religiously.
No shock that a women at fault won't talk to the Ins company b/c she knows she's at fault.

true but also its good to know that many that due bad business like this just change their names so that they start with a clean record. There should be a review for insurance companies.

He needs to file a complaint with the Dept of insurance for bad claims practice on united auto , that insurance company is the worst in Florida .
Insurance companies are crooks. But it's really sad because a lawyer will not touch his case unless there is considered body/medical injury.
I've been through a similar situation before and if there's only property damage insurance companies do not want to pay out.
Since he was on Uber , the driver & passenger can file a claim under the uber policy for any bodily injury claim, if the at fault party does not carry bodily injury coverage .It called UM
he could pay for a lawyer out of pocket then sue the at fault person in small claims court for the lawyers fees. go through legal aid services.
wait wait...so he paid 2,500 and was given 1,900 to fix his car????? what the crap kind of insurance is that. I would sue both the insurance and the other driver.

@@jaywires717 in texas i was able to get in touch with legal aid and they got me connected with a lawyer that allowed me to pay out of pocket to take my case with a small retainer. hope he can do the same.
Unless there were injuries, lawyers will literally hang up on him.

I went through the same thing in 1995. I called and wrote my state senator, and both my own and the other party's insurance company. He wouldn't speak with them, so my senator demanded they admit fault for him.
They did.
Later, he sued me(he got the ticket) and my insurance paid him 12 grand to make him go away.🙄

This is why you need a dash cam in your car both front and back of the car. be your own witness. Protect yourself.
You are a commercial driver while working for Uber and Lyft.Same thing if you’re a pizza driver.Make sure you have the correct insurance
damn Uber seems like a bad side job all around, you put your car, put miles on the car, maintenance, cleaning, gas, need a separate insurance, and have to deal with people. we need better public transportation .

he should have gotten a lawyer. insurance companies are not their to help you. they are their to make money by denying, delaying, and defending every claim is what i was told.

The insurance company should by default make her responsible and pay the claim then up her insurance or cancel her! I mean she is obviously responsible bc she failed to stop an assured clear distance! I think this needs to go viral so that other current and potential customers of this insurance company are forwarded about how this insurance company refuses to pay thru either policy.
A similar situation happened to me, although I was not driving for Uber or any other platform. And I asked if I had any recourse online, and insurance adjusters told me to stop whining, suck up the rate increase from my comp claim, or get a bicycle.
Which insurance company so I will not use them.
I think this is something that should get National press. This happens everyday.
I was hit point blank by a dui driver that failed to yield right of way...totalled my car. She got arrested. Same insurance company "lizard" written on police report. I sent them police report, I constantly called for updates. No help, no advice .I had uninsured motorist plus comprehension but no collision. Totally expecting her insurance to cover my car. Oh, sorry , I JUST find out after 2 weeks of calling for claim updates that her insurance expired 6 months ago and they just sent out a cancelation notice.. Meanwhile my car at the auto repair yard is racking up $ 85. 00 a day and my insurance says they're not responsible for that? Why does it take two weeks to find that she's no longer insured with them???? Fishy & Total fubar. If I take to small claims , I hear I may win but most likely never get a dime because they don't enforce them to pay.
This is hilarious this same company iOS doing the same thing, there insured don’t want to talk about the accident so they won’t be able to pay my car damaged.
Insurance companies make billions of dollars every year. I have very little sympathy for them.
It’s also because the insurance company legally doesn’t get involved when the Uber App is on !

The new scam is insurance when you file a claim will get your claim going but not all the way in the system than they will change your insurance coverage to state your not covered wait 3 days to have policy changed so they won’t answer your phone calls or your lawyers but they know it takes time for subpoena to go through usually 4 days because lawyers move slow and whatever is changed in insurance company records now is considered fact (even if they change it). So usually on 3rd day they finally answer your call and your all of sudden not covered and they get away with it
