Great information! My son backed into my moms car in my driveway. Her car sustained damage and she has comprehensive. His car didn't and he has liability only. Frankly, I parked my mom's car behind his instead of garage like usual and it was too dark to see so I can assume some of the blame. Based on what I heard from you, best way to file claim would be to file claim through my mom's insurance (I'll pay for her deductible).
2 years ago, my neighbor backed up into me from his driveway while my vehicle was moving. His insurance was expired so I had to pay my deductible for my insurance to fix my car under uninsured motorist coverage. My insurance went after him but the case was eventually closed for whatever reason. I believe the guy walked free and I never got my deductible back.

Very clear and concisely explained. I was the victim of a car accident on 11/21/2021, the at fault driver got a citation. My Jeep was not driveable because the bolts on my tire was hit, so I wasn’t able to put a spare on. My insurance was made aware, the vehicle stayed at the tow company for 1 week, then transferred to my insurance collision center to be estimated for damages. It stayed out there another 2 weeks, bearing’ in mind all this time I am paying a total of $260 out of pocket for rental fees, for an accident that wasn’t my fault. I reached out personally to the at faults driver insurance and they stated my insurance will have to pay for everything because their clients insurance has a limit, I do not know what that means. So my insurance has proceeded to send my vehicle to a garage of my choice later on this week, but they reminded me that I will have to pay for all damages! What should I do? In the meantime I have to continue paying for rental! The damages estimated only $1200. I will end up paying much more for rental..I am lost for words
It depends on your coverage. If you have only liability coverage and no collision or other than collision (comprehensive) coverage, no rental reimbursement, then this is why everything would be out of pocket for you. 2nd, a limits issue is not a denial. They are simply saying (for example) we only have $10k of coverage, we believe your damages + loss of use will exceed that limit. When you have completed your repair process and paid for the rental, send us the total costs along with estimates, photos, invoices, and receipts. We will review and pay what we can up to our $10k limit. If your total was $13K, then you will need to determine how you will recover the $3K from the at fault party directly. There is a lot to unpack in what I’ve said, but each claim is merit based, so it may not look or sound anything like I said. You have to communicate with the adjusters for the insurance company to confirm how to get payment.

anyone can claim any vehicle hit them and dictate the license plate so without further proof on the scene itself, then your option is to report to insurance maybe even police. this will will allow them to search out, and once they find the vehicle, inspect if it has damages that can be related to yours. paint embedding, location of point of impact, etc., these are things they look out for. the key here is you got the license plate. good job.
What is u had a hit and run police report says hit and run not at fault but insurance is trying to put it under collision insurance instead of non-insured motors
Hi Amber. Not entirely sure I understand your question. If you're asking if you still have to pay your deductible, so far as I've seen, if you use your own ins co you end up paying that deductible. But it might be different in your state.
In a case when a cyclist hit me by running through a stop sign on a tree lined bike trail, yes. Insurance couldn't recover my deductible in court. But I was just glad that the person wasn't injured.

I got rear ended, the highway patrol did not provide me with the report, they helped me get the other driver's insurance and DL who was at fault. I have started claim with my insurance to fix the car and I started a claim with the other driver's insurance. The other driver is not responding to the insurance company. What should be done? Also, my car value went down after this accident, how can I get that from insurance company? The driver's DL was expired when accident happened.
Sounds like you're doing all the right things... You can make a claim for 'diminished value' of your vehicle. I never did a video on that topic but if you look it up online you'll find plenty of info about it..
Hi, Just yesterday in Fullerton Ca. I was rear ended by a Uber that got rear ended by a truck. I did not realize how much damage I actually had to my vehicle until the next day. I have a partial license plate number of the car that hit me. Other than that I do not have any other information on the other parties involved. Uninsured motorists coverage through State Farm states I at least have to have the information of the uninsured motorist for that to apply. I contacted the Fullerton Police to advise them of the situation which they recommended I file a report but I don’t have the information on the other drivers.

A week is not that long when dealing with an ins co. Have you considered using your own ins? Not sure what 'they need confirmation for his insured' means.

I was rear-ended over 2 months ago. No police or witnesses available at scene but I took photos and driver insurance info-Liberty Mutual(LM). My insurance filed claim to LM. I've been dealing with LM for over 2 months to get them to take the liability. They are stalling the claim due to their insured not responding to their letters/calls/emails. I then filed a police report and a complaint to DOI of California last month(1 month after the accident). What other things I can do to get the LM to admit liability? Hire an auto injury lawyer to fight LM? If I have my insurance covered the repair, would I get my $1000 back eventually? Would my auto premium goes up due to this accident? Please advise! TIA!
Hi, I've seen it where if the insured does not respond to the ins co the ins co will deny the claim. Did you file with your own ins co as well? If it were me, that's what I personally would probably do and then let your ins co go after LM for reimbursement. You might (or might not) get your $1k back. As far as ins premiums, that I can't comment on. I just don't know what the policy of your own ins co is and how they handle premiums.

Yes, I first reported to my insurance-Travelers and they said if LM didn't respond, I can reopen my case and they will cover my property damage after I pay my deductible. Hello! I have a question. My vehicle was hit on the freeway late at night and the other driver was at fault (he received a citation and on the police report it listed him as the “wrecker driver”) here in TX. I was not driving the vehicle, my friend was as I was very sick that same night. I called the at fault drivers insurance company and they said there’s already a claim open and they gave me the insurance adjusters contact information and said they would be calling soon. Am I to still report this to my insurance company or will the other company handle it? I’m not worried about it taking awhile as I have two vehicles but just didn’t know if I needed to report this to my personal insurance company. Also, I’ve switched insurance companies and the one the at fault driver took a photo of is not the accurate one as Im no longer with Liberty, I’m with GEICO. my son hit boulders that came off a hillside from rain , couldn't see them due to cars in front of him...they have yet to take the car to the garage and look at the damage underneath but said they're gonna right out a check for the tires and wheels damage. but if its cashed wont that cancel them looking underneath it...can we send it to get looked at on our own ...i have full coverage and pay 315 monthly. its just seems shady to me. i ask him this question...he says if there is damage later they will cut another check ...i feel their lying
Sounds like it could depend on the laws in your state. Having said that, I have had supplemental estimates before after they pull the car apart and more damage is found....

My parked car was hit my a dump truck. There were witnesses and they accepted fault. The insurance company is refusing to pay for the rental for all the days I was without a vehicle. I’ve had to miss multiple days of work because I had no transportation. I’ve emailed the insurance company a reimbursement request and if they don’t honor it I will take it to small claims court. An SUV driver backed into the side of my newer car. I called his insurance and filed a claim. gave them all the info and pictures they requested. I called my insurance to let them know what was going on incase I had to file a claim though mine. My insurance kept nagging them until a month later I get a determination and his insurance pays for my car to get fixed. When you have a lease though, it really complicates things on your end. Edit: my deductible at the time was $1,000. If I had gone thought my insurance, I would have paid the full amount of the repair and some.(repair was only $800)
Recently I was involved in a car incident. I was hit from behind at a red light. I called both her insurance company and mine. My insurance company said, if the damages are at the deductible or below, they will not subrogate. Meaning they will not attempt to recover said deductible from her or her insurance. First, if you got rear ended you're going to file a claim with the insurance for the driver who hit you. Second, if the car is totalled, then the insurance company will come up with the "Actual Cash Value" of the vehicle in their eyes and they will pay that to the finance company. Then, if there is a balance left over, you'll have to work that out with the finance company.
Hello. I was just involved in a car accident. I was hit by a young 19 year old on a dirt bike on a residential street in the city. My SUV sustained front end damage. I have full coverage, my deductible is $750. Apparently, the young guy has no insurance, no license, and no registration. He tried to flee but Police got him. Police said he is at fault. Well... it's going to be based on the actual cash value of the car. And for a 2009, that could be minimal. Not to say you have to automatically accept it. You have options like appealing the decision etc etc.
I was involved in a hit a run, my parked car was hit and a police report given . In that police report , which my insurance now officially has, it has the info of the car who hit me , license plate number and vin number . Considered hit and run because the driver ran away from the car after the collision . So literally hit and run lol. In my case, because they have all the info on the car, but not the driver who ran away, do I stand a good chance at getting my deductible back? They impounded that car who hit me , but the driver just ran off. So it could have been a drunk driver scared to man up and face charges, or a stolen vehicle...or another complicated issue ... NOT insured himself .
Hi, depends on the deductible. You need to check what your insurance policy says. The adjuster is the best person to ask that question. Sorry I couldn't be more help. You're probably right that he fled the scene due to drinking etc.

@@alexandergonzalez8814 Yes I did have to pay the deductible, 1000 bucks I believe it was. I got that money back but later on down the line. That’s the annoying thing about it. You pay the 1000 or whatever your deductible is, but you don’t actually get that money back until later. If I remember correctly, it was actually when the car repairs were already done.
Hello, I have a question may be you or someone can answer. I had car theft, and thieves stole catalytic converter from my honda accord 2006. I have comprehensive insurance with $50 deductible, my inusrance company gave me estimate using after market parts and asking me to pay $574. Their argument is car is old and parts are new, so i will have to for that reason. To my understanding, i am liable to only pay $50 (deductible amount), want to check your thoughts if i will have to pay $574?

Hi. Thanks. Listen, if you didn't suffer any injuries, then hiring a lawyer probably is not an option. So I'm not sure what State Farm is talking about. If you want to try and seek reimbursement you can file a lawsuit against the other driver in small claims court. But chances are you won't be able to recover to be honest with you. Unfortunately, most of the time in a small case like this where the driver has to pay the deductible, you will get stuck having paid the deductible and will not get reimbursed. Hi, if you use your ins you'll have to pay the deductible. You'll likely get it back. That's the major difference. But yes each co's #'s will likely be different.
Generally speaking, if the defendant can't be found and you file a claim with your own insurance company, then yes, you would have to pay your deductible.... It's part of the system....
Hi Barry! We ran into an accident last week. I was driving straight in a busy highway when a car at the right lane attempted to change lane and subsequently struck the passenger side (my wife's seat). Fortunately, nobody was injured but the car, on its right side, suffered severe dents and scratches. We already have a copy of the police report specifically stating that it was not our fault and called the insurance company (same insurance company as ours) of the other driver to file a claim. When we called to ask for updates, the adjuster told us that the liability investigation is still on going since the driver at fault is not yet responding and the approval of our claim depends on the cooperation of the other driver. Worst case scenario, if the other driver does not cooperate, what is the best thing that we can do? By the way, after the accident, someone pulled over and offer himself as a witness for the report and insurance claims. Can we make use of it to support our claim?
Hi, well if you have the same ins co I would think they would accept liab. Have you considered using your own ins to cover the damage - and ask them to waive the deductible since you both have the same ins co. And sure you can use the witness' statement if you need it.

Hi, just to be clear, you were in an accident, you did not cause it, and you did not yet report it to the police? I would check your local state laws to see what is required. There may be a law that says something like if you have $1500 in damage you have to report it etc etc. So it's hard for me to know what to advise you here. But I can say that very generally speaking, I always advise people to report accidents to the police after they happen.

The reason I recommend people call the police is because stories change all the time. Someone who was so friendly at the scene of the accident can change their story when they call their ins co. So I always say to get the police to document what happened......

If his insurance wont act, you can either use your own insurance to get your property damage fixed and let them go after the other side. Or, you can file a lawsuit against the other party

My girlfriend sideswiped another car when she borrowed my truck. There was very little to no damage at all but a scratch on the sideview mirror of the plaintiffs vehicle. They swapped insurances. She recieved a letter in the mail from the plaintiffs insurance to fill out details on the accident. I haven't heard anything from the plaintiffs insurance ever since and haven't notice an increase in my rate sense it was pretty much her fault. Does that mean the plaintiffs insurance did not proceed to cover the damages? This was way back in December of 2019 and it's July 2020.

Hey Juan, you can definitely try. I almost always recommend people use their own insurance if they can. Yes you'll have to pay your deductible up front. But the repairs will get fixed much quicker. In this case, your own insurance may not total the vehicle. Bring them the body shop's estimate and see what they say.... Barry

Morning - in that situation - where both parties have the same insurance, I have seen insurance companies waive the deductible. Have you asked them to do that yet?

I had an accident last 2/13/2020 where me and my wife was dropping off a co- worker at her home, and we were parked as she was going out of my car, when a car backed up on us , damaging the door on the drivers side. The driver of the car owned to the accident and a police officer arrived on the scene for the report. A copy was given to me which I gave my insurance company together with the pictures of the damaged door. I paid the deductible to the repair shop. Should I be reimbursed the deductible? Thank you.
I've had mixed results. Sometimes your ins co will seek reimbursement of the deductible and you'll end up getting a check. But also seen times that reimbursement did not occur. Sorry I can't give you a concrete answer on this one. Ask your ins adjuster for a more precise answer is my suggestion. Barry

Hey Berry I work for the USPS, and I am a licensed armed security on the side as well,just so happen a tractor trailer came down the wrong way again on the coda sack outside the gated property cause strict policy if you are carrying you have to park outside the gate. So me I tell the driver as he was inching closer to the parking lot entrance did you see the no tractor trailer entrance signs on the beginning of the road,he replied no it's my first time here. @@satwindersingh9457 I would get a quote for the damage. If the cost to repair is reasonable, I'd pay it. If not and its thousands of dollars and your deductible is modest, like $500 then it's best to use your insurance.

Yesterday a lady was trying to switch lanes and she ended up scratching my car door really bad. I contacted my insurance and they ruled it as a not at fault collision claim. I had questions about how the whole deductible is going to play out in my situation. If we both have the same insurance what happens when it’s ruled as a not at fault collision claim? It’s probably a disputed facts of loss that resulted in a word vs word decision based on a lack of evidence to objectively support one position over the other. Very common with lane change incidents.

@@LawFull my insurance company SF has offered an amount (actual cash value ) for my vehicle … which to my understanding their subrigation department will go after Farmers to get their money. After I provided comps they adjusted the amount up by $1500 which I believe to be fair. And they have already paid my remaining loan balance. They want me to sign a Reg 262, which encompasses odometer disclosure, bill of sale, and POA. My question is, In signing this am I then closing out my claim with SF? Thus giving up my rights to perhaps use my own insurance if the other insurance company fails to pay in some way? Or is it just a DMV form?. It does state the $ amount. I am not against signing it as i feel it will be needed to get my money for my car. But is there good reason to wait? Thank you.

I received a letter now from my own insurance company saying I am now 51% at fault due to failing to maintain proper lookout. That seems crazy to me as I completely had a green light (with witnesses) and he crossed in front of me violating a red light to go onto a freeway on ramp. I had no reaction time. Is this something that can be argued directly with my insurance company or at this point do you recommend an accident lawyer. If so any suggestions.

Hi, no lawyer will get involved in a case of this size most likely.... Why don't you just file a lawsuit on your own against them in small claims court? That's what small claims are for - cases just like this.
My car was hit while parked. The person who hit me claims the other party ran the stop sign causing him to swerve and hit my vehicle. 2nd party involved claims she did not run the stop sign and proceeded as normal. Both insurance companies are going back n forth on liability. I have a police report that states just that. A couple things here I would like to clarify. First...the deductible is the amount of financial risk the insured agrees to take on themselves in favor of a lower premium. The lower the deductible is the more financial risk the provider is taking...thus higher premiums. Second...all premiums are based on risk. If you have gone 20 years without an accident and you are involved in one, most likely there will be no increase based on the accident but there may be increases for other reasons such as a chance in the crime rate, accident rate, weather changes in your area, and so forth. However, if a person is rear ended, for example, ten times in a calendar year that individual poses more of a financial risk to the company even though the individual may not be at fault for any of those accidents. I know that is an extreme example. I work in claims and I have to explain such things to people on a daily basis. Now about having to pay the deductible...it is not legal to go through subrogation for potential financial loss which is why the deductible has to be paid and then reimbursed through the subrogation process by the other parties provider.

Hey, depends. Is the vehicle totaled? If so, either insurance company is going to pay for the actual cash value (ACV) of your vehicle. They will not "pay it off." They'll just pay what it's worth. If the car is just damaged and not totaled, then this is not an issue. Does that clear it up?

What if they used the same insurance company? Someone backed into us and fled the scene but was caught on camera and the cops caught them as well... We have still not heard back from the insurance company about the claim even tho we have left messages. I thought it would go quicker since both parties had the same insurance but can't get an answer from them.
Generally if you use your insurance you pay the deductible. Could be different since you both have the same insurance company. Yet to be determined. Ask your adjuster.

If you only went to a chiro then the other insurance company has the right to deny the bills - chiro is not a dr and not deemed medically necessary in any state court, therefore you can be held responsible for the bills. Go see an actual dr

@@LawFull Yes. Their insurance informed me that since I hit their bumper, they would only pay 70 percent. I swerved to avoid frontal impact to my vehicle. The driver pulled out in front of me, while I was driving along a main street. They were leaving a private parking lot. There is NO way I could have avoided hitting the driver. The police report states that they are at fault. I want to emphasize, had I not swerved (they pulled out in front of me and stopped) the damage to their vehicle would have be significant. My vehicle received major damages.
Just fyi, your lawyer may not want to file suit right away. Also, if you do file suit and dont get your insurance to pay for the da.age, you're going to be without a car for a long time.

Driver A hit Driver B. Minor bump, no bumper deformation or dislocation. Scratches are probable, but it looks like they were pre-existing, also possible from wear and tear. Driver B cannot tell either. Police arrives. Police inspect. Days later police report acquired. Report says NO damage to BOTH vehicles. Driver B already filed a claim against Driver A for damages. Will insurance pay Driver B for lack of solid evidence that it was Driver A who caused the damage? Will insurance suspect Driver B of fraud such as exaggeration of the accident?
Hi, insurance will pay for modest damage most likely. This is not an irregular situation. People try to take advantage of a situation to get some work done on their car. As far as the fraud question, that is out of my domain. They will likely be skeptical but accusing of fraud is a big leap.

Hi, I'm not sure I understand your question. Bottom line, if you want to use your insurance, you're going to pay your deductible. If you don't want to use your insurance, go after the other guys insurance. If they deny you, you will have to file suit.

Hi, why would you have to wait on your own insurance? File a claim with the guy who hit you then you don't have to pay the deductible is what I would recommend. If you do use your insurance, you pay your deductible but your insurance company will likely subrogate so that you'll eventually hopefully get it back.

My 2 teenage kids were involved in an accident. The other vehicle was at fault and insured by Progressive. I pay their Health insurance and their mom pays for the auto insurance. Recently I received a letter from my health insurance company demanding to be repaid $5,000 for the bills that they paid related to this accident. I forwarded this information to my ex wife. She now says that since she has to pay back this money, their copay were not covered so I have to reimburse her my 66% of the co pays that she paid out. Hi, the part between you and your ex I am not sure what to say about it. I can tell you that the health insurance subrogation or lien has to be paid. But you can negotiate that down many times. At least we always tried to. Depends but you can often get 1/3 reduced. You didn't hire an attorney? S/he would have taken care of that for you...
Hey Kenneth - I don't know FLA law specifically. However, generally speaking if you can show that you lost those 4 hours - you should theoretically be able to recover them. Just get a letter from your employer verifying it. Or somethign to document it and I think you'll probably be able to recover them.

Hi, normally if you pay the deductible, your insurance company does not reimburse you right away. Chances are they will 'subrogate' against the insurance of the party that caused the accident. Then once they get reimbursed, you will get a check back.
@@indarramrattan7017 Not exactly sure what "towards your policy" means - but in short, you do not get your check back. You have a deductible which is your contribution to getting the car repaired. IF your insurance company gets reimbursed by the insurance company for the driver of the other car, then you should get that money back. And not until then. Now, if the insurance company says you will not get that check - then that I do not understand. And I would ask them to show me where in your insurance policy it says that.
Why dont some attorneys educate you on what you should do when you don't know. My daughter was in an accident...7/15...guy was clearly in the wrong...received ticket and all...our attorney who wasn't communicative just call today to say they went back and forth only to say the other insurance company only wants to pay 60%...the attorney offered none of what you're saying before and its like pulling teeth now to get them to give advice or suggestions or walk us through...im now about to file a claim with my insurance company and i want a new attorney. The attorney did say we should take them to court which could take up to year. My daughter car is gone she good...seen doctor for a week only. I think i need a new attorney?
Perhaps you could speak with your attorney and ask for a little more information moving forward. She/he can probably at least get their paralegal to give you regular updates....

Hey there how’s it going, My car recently got hit by a car and made a claim with own insurance. This was my first collision so I wasn’t sure what to do. I got the persons ID, license plate and phone number but i didn’t call the police because I wasn’t sure what to do. I’m now realizing it’s really recommended to make a police report. If the person claims the accident wasn’t his fault can I still prove it was without a police report? I’m not sure if I should pay the deductible now or wait. I rather pay it now but Idk how it will play out. I don’t want to pay if I won’t get it reimbursed. (minor damage no injuries)
Hi, you can still show they're at fault by the evidence - if for example you were rear ended... If it were me, I'd pay the deductible. You may or may not get reimbursed but you'll get your car fixed a lot quicker. But that's just my personal opinion....
@@LawFull I was hit on the side of the car driver side, on the door closer to the tire.wheel well was bent a bit and door arm area dented and his car got damage on his front bumper since he ran into me. He was making a right turn but wasn’t paying attention and didn’t complete the turn and hit me. Do u think that alone sums it up? In your opinion. I have photos of the area and the damage. We had to move our cars cause it was a parking lot holding up traffic so the cars aren’t In the picture.

@@LawFull they are saying if the car is stolen they will not pay a penny but if it is not stolen they'd only pay $10 thousand, which is the limit in NY According to what the adjuster told me. But since my car is total loss, they should pay the fair cash value of the car. But it should not matter which state the accident happened right?, the rental company should be responsible for all the total loss + property damages right?

Thank you for this educational video using examples from your client. I got into a fender bender and my insurance adjuster estimate the fix at $700 with a $500 deductible. GEICO cut me a check for $200. Since I was not at fault, I paid the deductible and will pursue reimbursement of my deductible through subrogation.

Great information! My son backed into my moms car in my driveway. Her car sustained damage and she has comprehensive. His car didn't and he has liability only. Frankly, I parked my mom's car behind his instead of garage like usual and it was too dark to see so I can assume some of the blame. Based on what I heard from you, best way to file claim would be to file claim through my mom's insurance (I'll pay for her deductible).

2 years ago, my neighbor backed up into me from his driveway while my vehicle was moving. His insurance was expired so I had to pay my deductible for my insurance to fix my car under uninsured motorist coverage. My insurance went after him but the case was eventually closed for whatever reason. I believe the guy walked free and I never got my deductible back.

I was the victim of a car accident on 11/21/2021, the at fault driver got a citation. My Jeep was not driveable because the bolts on my tire was hit, so I wasn’t able to put a spare on.
My insurance was made aware, the vehicle stayed at the tow company for 1 week, then transferred to my insurance collision center to be estimated for damages. It stayed out there another 2 weeks, bearing’ in mind all this time I am paying a total of $260 out of pocket for rental fees, for an accident that wasn’t my fault.
I reached out personally to the at faults driver insurance and they stated my insurance will have to pay for everything because their clients insurance has a limit, I do not know what that means. So my insurance has proceeded to send my vehicle to a garage of my choice later on this week, but they reminded me that I will have to pay for all damages! What should I do? In the meantime I have to continue paying for rental! The damages estimated only $1200. I will end up paying much more for rental..I am lost for words

It depends on your coverage. If you have only liability coverage and no collision or other than collision (comprehensive) coverage, no rental reimbursement, then this is why everything would be out of pocket for you.
2nd, a limits issue is not a denial. They are simply saying (for example) we only have $10k of coverage, we believe your damages + loss of use will exceed that limit. When you have completed your repair process and paid for the rental, send us the total costs along with estimates, photos, invoices, and receipts. We will review and pay what we can up to our $10k limit. If your total was $13K, then you will need to determine how you will recover the $3K from the at fault party directly.
There is a lot to unpack in what I’ve said, but each claim is merit based, so it may not look or sound anything like I said. You have to communicate with the adjusters for the insurance company to confirm how to get payment.

Take the license plate to the police department and file a report. Then take it to your insurance company to pursue

anyone can claim any vehicle hit them and dictate the license plate so without further proof on the scene itself, then your option is to report to insurance maybe even police. this will will allow them to search out, and once they find the vehicle, inspect if it has damages that can be related to yours. paint embedding, location of point of impact, etc., these are things they look out for.

Hi Amber. Not entirely sure I understand your question. If you're asking if you still have to pay your deductible, so far as I've seen, if you use your own ins co you end up paying that deductible. But it might be different in your state.
In a case when a cyclist hit me by running through a stop sign on a tree lined bike trail, yes. Insurance couldn't recover my deductible in court. But I was just glad that the person wasn't injured.

I got rear ended, the highway patrol did not provide me with the report, they helped me get the other driver's insurance and DL who was at fault. I have started claim with my insurance to fix the car and I started a claim with the other driver's insurance. The other driver is not responding to the insurance company. What should be done? Also, my car value went down after this accident, how can I get that from insurance company?
The driver's DL was expired when accident happened.
Sounds like you're doing all the right things... You can make a claim for 'diminished value' of your vehicle. I never did a video on that topic but if you look it up online you'll find plenty of info about it..

Hi, Just yesterday in Fullerton Ca. I was rear ended by a Uber that got rear ended by a truck. I did not realize how much damage I actually had to my vehicle until the next day. I have a partial license plate number of the car that hit me. Other than that I do not have any other information on the other parties involved. Uninsured motorists coverage through State Farm states I at least have to have the information of the uninsured motorist for that to apply. I contacted the Fullerton Police to advise them of the situation which they recommended I file a report but I don’t have the information on the other drivers.

A week is not that long when dealing with an ins co. Have you considered using your own ins? Not sure what 'they need confirmation for his insured' means.

I was rear-ended over 2 months ago. No police or witnesses available at scene but I took photos and driver insurance info-Liberty Mutual(LM). My insurance filed claim to LM. I've been dealing with LM for over 2 months to get them to take the liability. They are stalling the claim due to their insured not responding to their letters/calls/emails. I then filed a police report and a complaint to DOI of California last month(1 month after the accident).
What other things I can do to get the LM to admit liability? Hire an auto injury lawyer to fight LM?

Hi, I've seen it where if the insured does not respond to the ins co the ins co will deny the claim. Did you file with your own ins co as well? If it were me, that's what I personally would probably do and then let your ins co go after LM for reimbursement. You might (or might not) get your $1k back. As far as ins premiums, that I can't comment on. I just don't know what the policy of your own ins co is and how they handle premiums.

Hello! I have a question. My vehicle was hit on the freeway late at night and the other driver was at fault (he received a citation and on the police report it listed him as the “wrecker driver”) here in TX. I was not driving the vehicle, my friend was as I was very sick that same night. I called the at fault drivers insurance company and they said there’s already a claim open and they gave me the insurance adjusters contact information and said they would be calling soon. Am I to still report this to my insurance company or will the other company handle it? I’m not worried about it taking awhile as I have two vehicles but just didn’t know if I needed to report this to my personal insurance company.

my son hit boulders that came off a hillside from rain , couldn't see them due to cars in front of him...they have yet to take the car to the garage and look at the damage underneath but said they're gonna right out a check for the tires and wheels damage. but if its cashed wont that cancel them looking underneath it...can we send it to get looked at on our own ...i have full coverage and pay 315 monthly. its just seems shady to me. i ask him this question...he says if there is damage later they will cut another check ...i feel their lying
Sounds like it could depend on the laws in your state. Having said that, I have had supplemental estimates before after they pull the car apart and more damage is found....

My parked car was hit my a dump truck. There were witnesses and they accepted fault. The insurance company is refusing to pay for the rental for all the days I was without a vehicle. I’ve had to miss multiple days of work because I had no transportation. I’ve emailed the insurance company a reimbursement request and if they don’t honor it I will take it to small claims court. An SUV driver backed into the side of my newer car. I called his insurance and filed a claim. gave them all the info and pictures they requested. I called my insurance to let them know what was going on incase I had to file a claim though mine. Recently I was involved in a car incident. I was hit from behind at a red light. I called both her insurance company and mine. My insurance company said, if the damages are at the deductible or below, they will not subrogate. Meaning they will not attempt to recover said deductible from her or her insurance. Her insurance company is dragging their feet and keep saying they are "investigating". My question is, is my insurance company correct that they can legally not get involved if the damages are below the deductible?

First, if you got rear ended you're going to file a claim with the insurance for the driver who hit you. Second, if the car is totalled, then the insurance company will come up with the "Actual Cash Value" of the vehicle in their eyes and they will pay that to the finance company. Then, if there is a balance left over, you'll have to work that out with the finance company.

My car got hit last July 5th and my i filed it to my insurance and report it to the one who hit my car as well. Well... it's going to be based on the actual cash value of the car. And for a 2009, that could be minimal. Not to say you have to automatically accept it. You have options like appealing the decision etc etc.
I was involved in a hit a run, my parked car was hit and a police report given . In that police report , which my insurance now officially has, it has the info of the car who hit me , license plate number and vin number . Considered hit and run because the driver ran away from the car after the collision . So literally hit and run lol. In my case, because they have all the info on the car, but not the driver who ran away, do I stand a good chance at getting my deductible back? They impounded that car who hit me , but the driver just ran off. So it could have been a drunk driver scared to man up and face charges, or a stolen vehicle...or another complicated issue ... NOT insured himself .

You pay the 1000 or whatever your deductible is, but you don’t actually get that money back until later. If I remember correctly, it was actually when the car repairs were already done.

I have comprehensive insurance with $50 deductible, my inusrance company gave me estimate using after market parts and asking me to pay $574. Their argument is car is old and parts are new, so i will have to for that reason. Hi. Thanks. Listen, if you didn't suffer any injuries, then hiring a lawyer probably is not an option. So I'm not sure what State Farm is talking about. If you want to try and seek reimbursement you can file a lawsuit against the other driver in small claims court. But chances are you won't be able to recover to be honest with you. Unfortunately, most of the time in a small case like this where the driver has to pay the deductible, you will get stuck having paid the deductible and will not get reimbursed. Hi Barry! We ran into an accident last week. I was driving straight in a busy highway when a car at the right lane attempted to change lane and subsequently struck the passenger side (my wife's seat). Fortunately, nobody was injured but the car, on its right side, suffered severe dents and scratches. We already have a copy of the police report specifically stating that it was not our fault and called the insurance company (same insurance company as ours) of the other driver to file a claim. When we called to ask for updates, the adjuster told us that the liability investigation is still on going since the driver at fault is not yet responding and the approval of our claim depends on the cooperation of the other driver. Worst case scenario, if the other driver does not cooperate, what is the best thing that we can do? By the way, after the accident, someone pulled over and offer himself as a witness for the report and insurance claims. Can we make use of it to support our claim?
Hi, well if you have the same ins co I would think they would accept liab. Have you considered using your own ins to cover the damage - and ask them to waive the deductible since you both have the same ins co. And sure you can use the witness' statement if you need it.

Thanks for giving me the idea on the possibility of the deductible being waived due to having same insurance company. If the other driver does not cooperate, we will try doing that instead.

Hi, just to be clear, you were in an accident, you did not cause it, and you did not yet report it to the police? I would check your local state laws to see what is required. There may be a law that says something like if you have $1500 in damage you have to report it etc etc. So it's hard for me to know what to advise you here. But I can say that very generally speaking, I always advise people to report accidents to the police after they happen.

My girlfriend sideswiped another car when she borrowed my truck. There was very little to no damage at all but a scratch on the sideview mirror of the plaintiffs vehicle. They swapped insurances. She recieved a letter in the mail from the plaintiffs insurance to fill out details on the accident. I haven't heard anything from the plaintiffs insurance ever since and haven't notice an increase in my rate sense it was pretty much her fault. Does that mean the plaintiffs insurance did not proceed to cover the damages? This was way back in December of 2019 and it's July 2020.

Hey Juan, you can definitely try. I almost always recommend people use their own insurance if they can. Yes you'll have to pay your deductible up front. But the repairs will get fixed much quicker. In this case, your own insurance may not total the vehicle. Bring them the body shop's estimate and see what they say.... Barry

I had an accident last 2/13/2020 where me and my wife was dropping off a co- worker at her home, and we were parked as she was going out of my car, when a car backed up on us , damaging the door on the drivers side. The driver of the car owned to the accident and a police officer arrived on the scene for the report. A copy was given to me which I gave my insurance company together with the pictures of the damaged door. I paid the deductible to the repair shop. Should I be reimbursed the deductible? Thank you.
I've had mixed results. Sometimes your ins co will seek reimbursement of the deductible and you'll end up getting a check. But also seen times that reimbursement did not occur. Sorry I can't give you a concrete answer on this one. Ask your ins adjuster for a more precise answer is my suggestion. Barry

Hey Berry I work for the USPS, and I am a licensed armed security on the side as well,just so happen a tractor trailer came down the wrong way again on the coda sack outside the gated property cause strict policy if you are carrying you have to park outside the gate. So me I tell the driver as he was inching closer to the parking lot entrance did you see the no tractor trailer entrance signs on the beginning of the road,he replied no it's my first time here. It’s probably a disputed facts of loss that resulted in a word vs word decision based on a lack of evidence to objectively support one position over the other. Very common with lane change incidents.

@@LawFull my insurance company SF has offered an amount (actual cash value ) for my vehicle … which to my understanding their subrigation department will go after Farmers to get their money. After I provided comps they adjusted the amount up by $1500 which I believe to be fair. And they have already paid my remaining loan balance. They want me to sign a Reg 262, which encompasses odometer disclosure, bill of sale, and POA. My question is, In signing this am I then closing out my claim with SF? Thus giving up my rights to perhaps use my own insurance if the other insurance company fails to pay in some way? Or is it just a DMV form?. It does state the $ amount. I am not against signing it as i feel it will be needed to get my money for my car. But is there good reason to wait? Thank you.

I received a letter now from my own insurance company saying I am now 51% at fault due to failing to maintain proper lookout. That seems crazy to me as I completely had a green light (with witnesses) and he crossed in front of me violating a red light to go onto a freeway on ramp. I had no reaction time. Hi, no lawyer will get involved in a case of this size most likely.... Why don't you just file a lawsuit on your own against them in small claims court? That's what small claims are for - cases just like this.
My car was hit while parked. The person who hit me claims the other party ran the stop sign causing him to swerve and hit my vehicle. 2nd party involved claims she did not run the stop sign and proceeded as normal. Both insurance companies are going back n forth on liability. I have a police report that states just that. A couple things here I would like to clarify.
First...the deductible is the amount of financial risk the insured agrees to take on themselves in favor of a lower premium. The lower the deductible is the more financial risk the provider is taking...thus higher premiums.
Second...all premiums are based on risk. If you have gone 20 years without an accident and you are involved in one, most likely there will be no increase based on the accident but there may be increases for other reasons such as a chance in the crime rate, accident rate, weather changes in your area, and so forth. However, if a person is rear ended, for example, ten times in a calendar year that individual poses more of a financial risk to the company even though the individual may not be at fault for any of those accidents.
I know that is an extreme example. I work in claims and I have to explain such things to people on a daily basis.
Now about having to pay the deductible...it is not legal to go through subrogation for potential financial loss which is why the deductible has to be paid and then reimbursed through the subrogation process by the other parties provider.

They came from a side street to my right trying to turn left back towards the way I was coming. My front/right side of the bumper is pushed in & their front bumper is gone. My car insurance canceled me on the 27th, it is now the 12th.

Hey, depends. Is the vehicle totaled? If so, either insurance company is going to pay for the actual cash value (ACV) of your vehicle. They will not "pay it off." They'll just pay what it's worth. If the car is just damaged and not totaled, then this is not an issue. Does that clear it up?
Same thing but my car was parked and she have GEICO and they gone see if it could be fixed or is it a total loss! But I still owe credit acceptance 25k smh I hope they pay it off so I can keep the car or get a new one

Hi, Im not sure I understand your question. if you go ahead and agree to pay them back, you can discuss potential repayment plans with them. If you can't afford to pay anything tell them and see what they say. Does this answer your question?
What if they used the same insurance company? Someone backed into us and fled the scene but was caught on camera and the cops caught them as well... We have still not heard back from the insurance company about the claim even tho we have left messages. I thought it would go quicker since both parties had the same insurance but can't get an answer from them.
Generally if you use your insurance you pay the deductible. Could be different since you both have the same insurance company. Yet to be determined. Ask your adjuster.

If you only went to a chiro then the other insurance company has the right to deny the bills - chiro is not a dr and not deemed medically necessary in any state court, therefore you can be held responsible for the bills.

was t boned today at a light, 25 yr old girl in jeep didnt stop at her red light and t boned me. I had green light and was smacked on the driver side. @@LawFull Yes. Their insurance informed me that since I hit their bumper, they would only pay 70 percent. I swerved to avoid frontal impact to my vehicle. The driver pulled out in front of me, while I was driving along a main street. They were leaving a private parking lot. There is NO way I could have avoided hitting the driver. The police report states that they are at fault. I want to emphasize, had I not swerved (they pulled out in front of me and stopped) the damage to their vehicle would have be significant. My vehicle received major damages.
You only have 3 options: 1. accept 30% fault 2. Use your insurance 3. File a lawsuit

Just fyi, your lawyer may not want to file suit right away. Also, if you do file suit and dont get your insurance to pay for the da.age, you're going to be without a car for a long time.

Driver A hit Driver B. Minor bump, no bumper deformation or dislocation. Scratches are probable, but it looks like they were pre-existing, also possible from wear and tear. Driver B cannot tell either. Police arrives. Police inspect. Days later police report acquired. Report says NO damage to BOTH vehicles. Driver B already filed a claim against Driver A for damages.
Will insurance pay Driver B for lack of solid evidence that it was Driver A who caused the damage? Will insurance suspect Driver B of fraud such as exaggeration of the accident?
Hi, insurance will pay for modest damage most likely. This is not an irregular situation. People try to take advantage of a situation to get some work done on their car. As far as the fraud question, that is out of my domain. They will likely be skeptical but accusing of fraud is a big leap.

Hi, I'm not sure I understand your question. Bottom line, if you want to use your insurance, you're going to pay your deductible. If you don't want to use your insurance, go after the other guys insurance. If they deny you, you will have to file suit.

Hi, why would you have to wait on your own insurance? File a claim with the guy who hit you then you don't have to pay the deductible is what I would recommend. If you do use your insurance, you pay your deductible but your insurance company will likely subrogate so that you'll eventually hopefully get it back.
LawFull unfortunately I didn’t took the other guys informations personally(stupid of me). But the police officers did. I was a bit panic being as it was my first ever accident so all I did was call the police and waited for them to come. The only thing I did was take a pic of his license plate.

My 2 teenage kids were involved in an accident. The other vehicle was at fault and insured by Progressive. I pay their Health insurance and their mom pays for the auto insurance. Recently I received a letter from my health insurance company demanding to be repaid $5,000 for the bills that they paid related to this accident. I forwarded this information to my ex wife. She now says that since she has to pay back this money, their copay were not covered so I have to reimburse her my 66% of the co pays that she paid out. I asked her for the claim # and contact for Progressive so that I can dispute myself, but she refuses to do so.
Hi, the part between you and your ex I am not sure what to say about it. I can tell you that the health insurance subrogation or lien has to be paid. But you can negotiate that down many times. At least we always tried to. Depends but you can often get 1/3 reduced. You didn't hire an attorney? S/he would have taken care of that for you...

Hey Kenneth - I don't know FLA law specifically. However, generally speaking if you can show that you lost those 4 hours - you should theoretically be able to recover them. Just get a letter from your employer verifying it. Or somethign to document it and I think you'll probably be able to recover them.

Hi, normally if you pay the deductible, your insurance company does not reimburse you right away. Chances are they will 'subrogate' against the insurance of the party that caused the accident. Then once they get reimbursed, you will get a check back.

@@indarramrattan7017 Not exactly sure what "towards your policy" means - but in short, you do not get your check back. You have a deductible which is your contribution to getting the car repaired. IF your insurance company gets reimbursed by the insurance company for the driver of the other car, then you should get that money back. And not until then. Now, if the insurance company says you will not get that check - then that I do not understand. And I would ask them to show me where in your insurance policy it says that.
Why dont some attorneys educate you on what you should do when you don't know. My daughter was in an accident...7/15...guy was clearly in the wrong...received ticket and all...our attorney who wasn't communicative just call today to say they went back and forth only to say the other insurance company only wants to pay 60%...the attorney offered none of what you're saying before and its like pulling teeth now to get them to give advice or suggestions or walk us through...im now about to file a claim with my insurance company and i want a new attorney. The attorney did say we should take them to court which could take up to year. My daughter car is gone she good...seen doctor for a week only. I think i need a new attorney?
Perhaps you could speak with your attorney and ask for a little more information moving forward. She/he can probably at least get their paralegal to give you regular updates....

Hey there how’s it going, My car recently got hit by a car and made a claim with own insurance. This was my first collision so I wasn’t sure what to do. I got the persons ID, license plate and phone number but i didn’t call the police because I wasn’t sure what to do. I’m now realizing it’s really recommended to make a police report. If the person claims the accident wasn’t his fault can I still prove it was without a police report? I’m not sure if I should pay the deductible now or wait. Hi, you can still show they're at fault by the evidence - if for example you were rear ended... If it were me, I'd pay the deductible. You may or may not get reimbursed but you'll get your car fixed a lot quicker. But that's just my personal opinion....
@@LawFull I was hit on the side of the car driver side, on the door closer to the tire.wheel well was bent a bit and door arm area dented and his car got damage on his front bumper since he ran into me. He was making a right turn but wasn’t paying attention and didn’t complete the turn and hit me. Do u think that alone sums it up? In your opinion. I have photos of the area and the damage. We had to move our cars cause it was a parking lot holding up traffic so the cars aren’t In the picture.

Hi, when you say this: "Hertz insurance adjuster using tactics to not pay for the total loss." - do you mean they are offering you less than you think the car is worth? They will offer you the "Actual cash value" of your car - not what you owe on the car.
@@LawFull they are saying if the car is stolen they will not pay a penny but if it is not stolen they'd only pay $10 thousand, which is the limit in NY According to what the adjuster told me. But since my car is total loss, they should pay the fair cash value of the car. But it should not matter which state the accident happened right?, the rental company should be responsible for all the total loss + property damages right?
