    If a jury member didn't show up, they would be arrested, if an defendant didn't show up, a bench warrant is written out, why the hell would a prosecutor think they have the right to just not show up

    The fact that one of the victims is an 11 year old child whose first encounter with the judicial system has FAILED them MISERABLY. This WILL FOREVER damage this child, physically, mentally and emotionally. SHE NEEDS TO GO TO JAIL.

    I do about 5 felony cases a year in the City of St. Louis. Last year I think I had 3 or 4 pending. After those cases were done, I resolved to not take another case where her office is the prosecutor. She is a complete disaster and her Assistant Circuit Attorneys try for the most part, but they really have no support from her office. I am appalled at what has been going on there. It is horrible. It is the talk of the St. Louis area legal community. She is an elected prosecuting attorney. I am a member of her party but there is no way she has widespread political support. Do a little googling and you will see instance after instance of her incompetence.

      Every lawyer is late? Speaking for myself, he can go f himself. One thing I will say is that many dockets are scheduled at the same time in every courthouse I have been in. But, we know to contact each clerk, check in, let them know “Hey, I am in DIV 6, I will be be back as soon as I get some continuances.”. Then you hustle over to DIV 6 and most of the other attorneys will let you skip the line and get the signature from the Judge that you need so you can hustle on over to whatever Division that we need to be in. BUT, if I have a trial set to go in one division, I damn well know whether I am first out or second out and plan accordingly. If I am first out, I arrange for others to cover for me in the other divisions so there is no chance I am late for the trial. I do that as a solo practitioner. Yet, a whole office of ACAs can’t figure out how to cover each other? What arrogance. Trial lawyers have to hustle to meet all of their obligations and that is part of our job. By the way, this particular Judge is probably the most respected Judge in that courthouse. Thank you for posting this. I missed it when it was being aired live.

    Kim Gardner has submitted her resignation letter Thursday effective June 1st. She was facing a hearing to have her removed from office. This coming after a recent incident where a 21 year old man, who was out on bond despite the fact that he violated the terms of his release on at least a dozen times and his bond was never revoked, was speeding down the street when his car slammed into a parked car pinning a 17 year old girl ,who was in town for a volleyball tournament ,between both cars doctors had to amputate both her legs. While investigating Gardner it ,was also discovered that she was taking nursing classes at SLU while her office was seriously understaffed which constitutes a conflict of interest as an elected official she swore an oath to dedicate 100% of her efforts in service to the office she was elected, an oath she has neglected on numerous occasions. My fear is that if Gardner does get a position in the medical field she will continue to show her complete incompetence and actually cause harm to someone in her care.

      I will never understand why the USA have judges who are elected. That isn't the kind of position I want filled by someone whose only qualification is winning a popularity contest decided by people who don't even know the difference between civil and criminal law.

    The back story here is that some 65 lawyers have quit from the circuit prosecutor office since Gardner took office. So one might expect something like this to eventually happen. Now, Kim Gardner may well be the cause for all those lawyers quitting, so this does in no way let her off the hook.

      I like it! You can tell he is compassionate about a situation like this! He seems like a real top notch guy. He knows how to have a good time, and he knows when to be serious, when needed. I’ve never heard him boast about his self. Very humble! Which from what I’ve noticed, that’s not a common trait of a lawyer. Lol And it’s so respectful! I’m glad I found his channel.
      I think simply being able to practice law is a hell of an achievement! But being Humble is a hell of an achievement!

      She had just 2 attorneys that handled violent felonies. In St. Louis. Two. They were hundreds behind. It was honestly a mess.

    I'm in St Louis and let me tell you...she is a politician at heart and has a serious disdain for her office. She has blacklisted certain police officers from bringing cases to her office and the police are suing her. The attorney general of Missouri is suing to have her removed from office for dereliction of duty.

      They are very sharp to act in her interest to all show up and defend Gardner on the other hand didn't show up in defence of the victims in question.     I saw this video days ago and thought 😱 without context. I’m so glad you covered it bc now I’m even more outraged by the behavior of these attorneys. I can’t even imagine how the victim felt. The judge’s comments at the end have made headlines, and rightly so.
    What happens from here? Can they be disbarred, removed from their positions, fined, etc? I have questions.

    More than 65 prosecutors have quit, been fired or " ghost quit" since Gardener took office, two are saying they were fired because they prosecuted cases involving Gardeners "bad cop" list when told to stop.
    Now they are down to just THREE prosecutors that are qualified to prosecute a felony case.

I live in St. Louis and the DA's office is so corrupt it's insane, and the community has suffered so much and lives have been lost because of it.     Prosecution is a political act in every instance. And this particular party has a nationwide trend of being permissive of crime especially crime committed against low income minority communities. She is only one of many Soros backed prosecutors who would have been a darling of the dnc just a few short years ago.
    This is what democrat voters welcomed. Promising to prosecute political enemies was and is more important than anything else.

      Too many cases, not enough attorneys, and an unwillingness to prioritize (and a shocking matter of what choices they make when they DO prioritize). They could have dropped some of the charges, offered softball plea deals to lesser charges and nonviolent offenders... but no, they're trying to cover it all, because despite being in the position of being the chief prosecutor, she doesn't have the management skills of that position, and *just doesn't care...*
      Look at her Wiki page - this isn't her first "stumble" (not even *close* ) but it may well be her last.
      What we saw showed how overloaded the caseload was. The offending prosecutor - the one who was assigned to the burglary/shooting trial that never showed up - is assigned to over 100 cases currently. If that's for the current month, that's more than 3 cases per day - when you know that some of them are going to take multiple days for trial. It doesn't add up.

    I was sued over child custody and twice during our case I appeared before the court on time, anxiety and all, and my daughters moms lawyer didnt show up. In total the matter hung over my head for over a year. I can only imagine being the victim of a crime and the people who are supposed to represent me are this irresponsible

    They office assigned a murder case to an attorney that was out on maternity leave. And it was dismissed for prosecution's failure to appear. How crazy is that.

    Love seeing you fired up and rightly so!! Thank you for sharing this. Glad the judge held them to the same consequences anyone else would have if we disrespected the judge or court. This Childs family deserves justice, them not showing up on trial day is more than embarrassing on the prosecutors office. What other corrupt crap are they doing??? The whole office and all convictions need to be investigated

      How's this. In the McCloskey case. that was the one where the homeowners went out in front of their house with guns when a protest group broke into their gated community. She charged then with brandishing a weapon, but during the investigation they found out that the gun Patricia was holding was broken and couldn't be fired. Since it was inoperable, they couldn't charge her with brandishing a weapon. Gardner's office told the techs to fix the gun so that if could be fired and then filed a report that the gun was operable at the time of incident.

    I’m so glad the judge just didn’t sweep their negligence under the rug. I’ve actually had this happen in court in Will County, for a child support order. And thankfully Judge Defenbaugh saw threw the crap my ex was trying to pull. I NEVER got served with paperwork but happened to be doing research and saw my name on the docket for 2 days in the same week. Neither lawyer my ex hired showed up for the first date, I did show and got the order thrown out. The second day I showed and so did both of his lawyers, they tried to bring up the case earlier in the week and she said NO, she already ruled and you wasted the courts time and the defendants time. They couldn’t understand how I knew of the dates because apparently the orders were still not mailed. Yah 1 lawyer happened to mention it. They were held in contempt. I did get the orders Friday of the next week. Both cases were thrown out. My ex couldn’t afford to pay his child support but he paid for many lawyers.

    The judge questioning that one prosecutor sounds like a dad trying to get the truth out of his kid. He already knows the answer, but he has to walk him down the path to the truth.

    Wow. For an attorney to not show and then think it was okay to show up late to the rescheduled date is just WRONG on all levels, and it does appear the office is absolutely in chaos.

    This situation is DESPICABLE! Despicable that it happened and despicable how it's being handled by the prosecutors office/Kim Gardener. Makes me sick and so very angry 😠 I'm thankful for this judge.

    I did some checking and, not only has Gardner not resigned, she's defiantly said she's not going anywhere, is intending to run for a third term, AND she wants a new judge. Really?!!
    A lawsuit has also been filed by Missouri Attorney General Bailey to remove her from office for exactly the reasons this show cause hearing was held.

    I like the occasional angry LTWM. It's cathartic to hear an attorney verify what we were all thinking. Clarification like that helps voters see through her excuses when she goes up for reelection (likely playing the victim). I think this is exactly why Manning is so supportive of law tubers. The public would never have this insight.

      Mike can correct me if I'm wrong, or I should say any legal minded person probably, but i am pretty sure they would get qualified immunity even if they don't deserve it or actually qualify for it on the facts.

      @@rs180216I think qualified immunity involved is protection from liability for making a mistake while doing your job in good faith. Like not being sued for arresting the wrong red headed man with freckles, or misunderstanding the difference between 3rd and 4th degree littering.

    This judge is awesome. Cap shield and a Beat NAVY sign. Dude shoots straight but has some character. The "I had a boo boo" defense is EPICLY BAD. These two idiot prosecutors allowed a violent criminal walk, they have ONE FREAKING JOB! I think Mike did a great job of expressing all of our ANGER at these two. Sad I missed this stream, chat looked FUN!
