Ive been homeless before when I was 17 years old. This happened when the adults I lived with who were drug addicts, didnt pay rent even though I contributed for eight months. They also stole my hidden money of $20 that I set aside for myself to get around on public transport to look for work. I left the home without money and a bag of clothes. I made it by going to services to support me until I got on my feet again. Be proactive, be honest and stop being a victim. Shit happens.

The server my first divorce attorney used sucked azz. My ex had a precise work and day off schedule that never changed in 16 yrs. Server charged for every attempt. I told the attorney I will serve him. No no don't do that. For other reasons I fired first attorney and hired a competent one who's server had 99% success rate. First attempt was successfull

Eviction case was frustrating. Didn't seem like the complainant was going after damages or unpaid rent, and STILL couldn't evict them! Also, it was telling, when he mentioned legal aid and hedged on moving out at the end of the month, they have no intention of leaving on their own, and are just stalling for time. And they are doing this while claiming to not pay rent because the place is in poor condition. Just another example of the courts letting freeloader tenants abuse landlords.
I love when attorneys and parties both say “I don’t mean to interrupt you judge” as they clearly interrupt the judge. Depending on the statement or the context, some judges may disregard chastising the person for their “outburst” but I always find that comical lol

I told her next time to just call me and I'll meet her in town rather than her having to drive most of the way across the county to get to my house.

I called him up and he said he got a subpoena to show up in Federal Court on a Civil matter. I asked him what the subpoena said and he read it to me. I replied "Yep, that is my subpoena you were served with." I drove by his office a couple of hours later and he was happy to give me the subpoena!
In landlord tenant proceedings the pleadings are jurisdictional. If you don’t follow the rules the court cannot evict someone. It’s a thing I exploited many times as a legal aide attorney.

Imagine it with another type of property. Like I loan you my spare car for a few months and when it's time to return it, I'm shit out of luck cause you just want to keep it and have no respect for the fact that I worked hard and earned it. That's when the law fails and people are forced to take other actions that may seem mean and illegal .. but sometimes the law forces your hand to do certain things. @@Truechyme but that’s not at all the same. primarily, the right to have shelter is a necessity, having a car is not (even if it’s extremely burdensome to get around without one). that’s why the law around tenant rights is the way it is, and has requirements beyond straight contract law. this is also something landlords *know* before they start lamdlording. regardless, your comparison is not an appropriate one. for one, there is typically no court process necessary to repo a car. by the terms of most financing contracts, you don’t have the sole property interest in the car. the finance company effectively owns it (i’m being overly simplistic, but that’s the crux of it) and automatically has a right to repo it if the car owner defaults. conversely, landlord/tenant law forbids a similar situation with eviction, and you can’t contract around it. you *have to* go through the courts to recoup rental property unless the tenant voluntarily agrees to leave. more importantly, I didn’t say the landlord has no recourse for nonpayment. they absolutely do. they just need to comply with the procedural requirements. there are distinctions between eviction proceedings for nonpayment of rent and eviction proceedings for other lease violations. this landlord did not even remotely come close to complying with those procedures. if they wanted to proceed on the nonpayment basis, which would have been an easier route, they could have included that in their filing. they could have amended this one or just re-filed. instead, they let this case set for 4-5 months without doing that. instead, they proceeded in other lease violations. they can’t just tack on the nonpayment issue when it’s time for the evidentiary hearing. they also need to plead their lease violation with particularity and come to court with sufficient proof of violation. they failed to do that as well. I don’t feel sorry for landlords. they are aware that they have certain duties as landlords that may feel lopsided compared to tenant obligations. i’m glad those obligations exist and are appropriately enforced.
Because they're not being evicted for not paying the rent, they're being evicted for breach of the tenancy agreement, which will include a term like "Do not cause a nuisance to other residents". The landlord will be able to bring a separate action to recover the unpaid rent and any damage to the trailer after they're evicted, but this action is just to get them out.
I think the judge was so nitpicky on the landlord’s pleadings because he wanted the tenant to have the time to move voluntarily and the landlord initially wouldn’t consent to give them time. He absolutely could have stuck to the statutory ten days, but that’s not the way Judge Middleton is.
