      Right. And how come they keep saying the phone was off? No one said it was off it wasn’t transmitting. It could have lost signal or went on airplane mode. Both would prove the prosecution got it wrong. Plus the only DNA is touch. That’s not enough in most states to prosecute any more because of false convictions. This case is wild

Hopefully they got the right guy. But there should be evidence that he is guilty. And these people sound like absolute clowns the wild theories they push.

      lol right. They are talking like it isn’t just touch dna and cell towers pings that make them think he is guilty. They were looking for a different year car before Bryan’s arrest, the only dna is touch, no victim blood in his car, and no stalking even though they pushed that for years. These people are a joke now.

    The PCA does not state that the phone was turned off. But it does lead a person who doesn’t pay attention to believe that, thats what it said.

      @@suzannek3493 - There is much being made of Anne Taylor’s expert witness, Sy Ray, criticising his use of cell site data to geographically pinpoint an accused in criminal cases. Yet that is exactly what the PCA does, even using cell site data to draw on a map the route Kohberger is accused of taking.
      Following this is a lengthy paragraph about a search warrant for historical phone data to determine if Kohberger stalked any of the victims, conducted surveillance on the King Road residence, or was in contact with any of the victims’ associates. The following paragraph states that according to CAST, Kohberger’s phone utilized cellular resources in the 1122 King Road area on at least 12 occasions prior to 13 Nov, and that on nearly every occasion, it took place in the late evening or early morning.
      This led the media all too easily to make the connections themselves, while the gag order prevented its correction.
      The evidence to answer your question is, according to Anne Taylor, being withheld or has not been preserved by the prosecution.

      If you search the park he went to and you read all the reviews you can see all people stating there is no phone/wifiservice at particular parts. If you invest a bit of time in Annes explanation you will actually find it very plausible. ​@@suzannek3493

      Indeed! LE ought to be focused at this point on testing the other 3 male DNA samples found at the scene, interviewing the frat boys and other college students, and doing their best to find other potential suspects because BCK is going to prove beyond a reasonable doubt at this point that it wasn't him. Then, he's going to sue their assets for false imprisonment. LOL

      Dec 13 MPD states they saw rhe video but dont.kmow who owns the car and can't see inside.
      I don't thing the state knows what they are doing.

    The defendant doesn’t have to prove anything. The prosecution is making an allegation they have to prove. This why I don’t like the media manipulation. They are having a conversation as if he needs to be able to prove he wasn’t at the scene. That’s not how it works. The prosecution has to prove beyond a reasonable doubt he was there. Most people will be fooled by them poking holes in his alibi. Actually, he doesn’t even need an alibi. The prosecution has to make its case. It has not so far in my opinion..

      @@bambooprincess3495 no he doesn’t. The burden is on the prosecution. I don’t have to keep a verifiable record of how I spend my time. Not doing so doesn’t implicate me in anything. If a prosecutor is making an allegation, they have to prove I did anything. I can’t disprove a negative. I don’t have to prove I didn’t do it, they have to prove I did. Your understanding is why juries are so scary…

There is a reason he is here, multiple in fact, that which include his car, his proximity, his dna, and even more. What a ridiculous statement.

      @@miki49 my statement is FAR from ridiculous. He’s there because local PD felt pressured to make an arrest, not because there’s any actual evidence against him. 1. There’s no murder weapon. So the DNA on the knife sheath is irrelevant unless the knife it belongs to is identified as the murder weapon which it has not as of yet. 2. The “cell phone pings” only mean he was in a 30 mile radius of the tower he pinged off of, it doesn’t put him at the scene as the media is trying to allude to. So what evidence do they really have? Their whole case rests on DNA found on a knife sheath snap, and a cell phone ping that puts him within 30 miles of the crime scene. What evidence? It’s circumstantial at best. It’s a far cry from beyond a reasonable doubt unless you’re an idiot that watches the news and don’t do your own research.

      @@miki49 you see it that way because you don’t understand the legal term “burden of proof”. If you did, you would understand that’s the reason most defendants don’t testify in their own defense. If the defense attorney doesn’t believe the prosecution made its case based on evidence alone, they will decline to put their client on the stand. What’s insane is how you are shifting the burden of proof to the defendant instinctively. Never mind the prosecution hasn’t presented any evidence to his guilt. This is why being a lawyer is so hard. Jurors are idiots

    He wouldn't take his phone at all. He wouldn't just turn it off at the exact time he was committing a crime. He would leave it at home. How do they know it was actually off and just not in an area with no signal? This is not beyond reasonable doubt.

    This case is a classic small town cover up. They needed someone to pin down for this murder so they found someone who lived nearby who drove a vehicle matching the description of the one seen in the area. They planted the DNA and built a case. The possibility of BK successfully murdering these 4 victims in a brutal stabbing in less than 11 minutes and somehow managing to NOT leave or track DNA evidence ALL throughout that house or his car is near impossible.

    Where do you people get your education from??Have you all been living under rock?? Clearly have not did your research on the expert before coming out to spew technological facts!! This expert is highly trained in that field.. nowhere does it say BK phone was turned off! Simple tower search of Moscow Idaho area will tell you service is non existent..o and btw this guy doesn’t normally testify for defense! May god bless america we are gonna need it!

From huge military, he's testified in huge cases, usually for Prosecution - but he agrees with the alibi of BK, the defendant. This Expert totally understands the geofencing tech, he knows ahelluva lot more than these ppl!!!! Lol!

Furthermore you would find that this Expert has his own podcast & YT channel that you ,if taking time out to watch as most fact checkers do,highlighting these cases & the techniques that were used. He has never testified for a defense witness ! He has always worked on prosecution side! That should pretty much dumb down to the average human ,what he has already found prior to AT releasing this alibi!

      No it’s not. What says that’s “his” knife sheath? Nothing.
      What says that’s his DNA?
      Nothing.
      The DNA found on the knife sheath wasn’t enough to identify as anyone’s. So, they sort of “fill in” the gaps with a statistical analysis to get a “statistical match.” Then you examine the math. It’s not enough of a match to identify him with any reasonable certainty. It could be his DNA but it also could be someone else’s.

      But with all the time he supposedly spent in that house and all they can find is touch DNA on a snap button on a knife sheath? None of the victims DNA was found in his car, house, or anywhere else for that matter. Possible, yes. Probable in light of no other DNA found anywhere else, not likely.

    The pca says it was not transmitting. They said it was off or on air plane mode. If it was air plane mode there would be evidence on his phone that he wasn’t there. And I think they want the cast report so they can prove the evidence against him is faulty. I really don’t like the only evidence being touch dna. They changed the year of the car after Bryan was arrested. And they say there was no stalking. Idk maybe I misunderstood.

    He's not an idiot, just because his cell phone was somewhere doesn't mean he was. Calling that an alibi is ridiculous. I'd bet the farm he planned every detail of this crime for a very longtime.

    This is what is going to get him convicted. Unfortunately this guy was not as smart as he thinks he is. If he was actually a genius like he thinks , he would have leaft his phone on at home and took a bike or some other vehicle to the scene that night. What got this guy caught was traffic cams and doorbell cams without a doubt, and they picked up his car on tape Then the cellphone hung him. Thats and that

      Unless they are able to provide a license plate that verifies the car in the videos is BK’s then all we have is someone who drives a car matching the car in the video. That is not enough evidence to convict. The DNA evidence is weak, the phone data will be proven to be weak. They needed to pin this murder on someone and they found BK who drove a car matching the one in the video, they then planted the DNA on the knife sheath and built their case. This is a classic small town cover up.

      There was a horrible hit and run accident right in front of his building that night, there was police absolutely everywhere and it was very loud, many left their apartments to go sleep somewhere else or went for a walk. Bryan being an insomniac must have been awake for sure and he went for a ride because being home was not an option. Also why would he choose that night to kill? There was police all around. You mean to tell me he chose that night to commit a crime?

    To me, the tiny contact DNA evidence isn't a big deal. It's all these little things that will add up.
    I am not a big fan of circumstantial evidence, though. That's the gateway to making it easy to frame someone for a crime.
    Though if BK was being framed, I am sure he would have a good idea of who it was.

    I have a tendency to believe the guy is smarter than taking his phone with him. I'm suspicious about the knife sheath since it's so convenient for the prosecution. We'll see what happens. Regardless, four people were killed.

    Even that question is disingenuous. You have no idea what the defense expert will present regarding refuting the claim that he was in the area of the murders, so how can anyone at this stage make that determination? Better questions would be is why the judge at this late stage requested more detail of BK's alibi which involves him driving around, did the request come from the prosecution, is that unusual, does it reflect uncertainty about the prosecution evidence that he was in the area at the time of the murders, how do you think the expert will challenge the prosecution assertion he was in the area based on an analysis of phone pings and cell towers.

    What is so wrong with stargazing? This was not the first time he did, he was an insomniac and it was a habit of his to go look for places where he could go for a run, he even had a jogging buddy.
    And about the DNA, it's unreliable touch dna. That's it.
    Regarding his phone, it's all very easy to dismiss. He didn't get any calls that went to voicemail in that timeframe therefore you can't prove that he had actually turned off his phone.

    The sheath just flew a few miles over and landed in the house. After knowing what the prosecution has, a year later an alibi is given? If there was an alibi why wasn't it given in the beginning? He never said not guilty. God saw what happened.

    “All the evidence together” he says, like the totality of dna, phone, car & they “saw him the next am getting out of the same car” same car as what? You mean BK happened to drive a white car & that a gas station manager took a still shot of a white car with no personal identifiers ie: license plate or photo of driver behind wheel?     How did the killer know that Maddie's bf wasn't there, Kaylee's bf wasn't there, Dylans bf wasn't there, Bethany's bf wasn't there?
    Im not bying anything of what Bethany and Dylan are selling. There are a reason why the killer/s left them alive...
    Like the killer/s, that just killed 4 people, would leave the house leaving a witness alive, whom the killer/s came face to face with.
    Dylan is now fighting for not to be cross examinated WHY???? Because she cant remember all the lies she told and the defense will eat her up raw.
    What are the odds that exactly that day the murders occured, out of 5 girls, only one had their bf over that weekend? Kind of strange that none of the others were, or that none of the girls were staying with them.
    Wasn't it Family Weekend?
    How did the killer know that family wasn't staying over?
    How did the killer know if their targeted victim was even there?
    How did the killer know that someone else may have been crashing in their targets bed?
    Even if the killer saw movement, wouldn't have known for sure who all was in there, or who was gone.
    There were plenty of vehicles in the parking lot, and parked all around.
    Of course there were someone on lookout, ready to warn the killer/s if someone was to approach the house.
    What would the killer/s have done otherwise, if someone suddently was to enter the house? That's way to risky.
    Even a half way intelligent person, should have felt that was potentially a suicide mission otherwise.
    Bryan could have passed by for 365 days in a row, and would still not know when the time was right to enter the house and stab these poor students.
    There were absolutly no routines in that house, people came in and out non stop.
    Someone close to the victims, had the "inside information" of exactly who was in that house and in which rooms they were in.
    Snaps and text were flying in and out of the house fir hours, BEFORE the even called 911 hours later, why wouldn't they have done everything to get medical care for the 4 students? Im gonna tell you why, because they already knew there were dead, and did nothing.

    There was only tiny speck (19
    picograms, look it up) of TRANSFER DNA!
    The killers are still out there, laughing.
    We all want justice for the poor students people don't even do their own research about the case, they just jump on the guilty train, and I find it disgusting.
    Innocent until proven guilty.
    This isn't adding up at all.
    He is innocent!
    When he will be exonerated, I hope he will sue the whole gd country

    But his phone pinged again at 9am near the house. He went back! And oh, so he was driving out at night, pinging towers near the victims' house, stopped pinging anywhere at the time murders occurred, then his dna found on knife sheath left in the crime scene, and by the way a knife was used by the killer to MURDER the victims. 😂 It's really not him. 😂 And oh this is so far how much we know, there could be a lot more evidence.
    And oh Bryan has been holding on to "his alibi" and decided to divulge it after one and a half years. 😂

    I thought all along , that the route he drove home in the middle of the night was something like a 40 minute drive , yet he lived only 8 miles away . He went the long way home .............. I think it was that route because he could easily pull over anywhere , hike up a hillside , or hike down to the river - why , easy ............ to hide the knife . Just my opinion

      There is traffic light cameras between Pullman and Moscow Idaho! They would have picked his car up going that way if this was true! so the 2 yr rookie (officer Payne) for Moscow Pd with no previous training is the one who typed the PCA tailoring the states narrative that he dodged those cameras by driving outside of said cameras ,irony of all of this,a simple map search of traffic cams in that area has one camera near the smoke shop,which is being reported in this defense sworn filing, that this was not BKs Elantra! Pretty sure tinted vs non tented ,sunroof vs no sunroof will prove this! This highly decorated expert has put this man in another state at the time of the murders! He would not have came onto a case that would sink his career had he not did all his digital research first! “Socialite true crime podcast”is the experts show case of work! People quit being lazy & read ,Stop listening to main stream mind fuching you& do your fact checking! This is scary times in policing!

    FYI: He does not have to prove or provide anything UNLESS HE GOES WITH AN ALIBI DEFENSE. Then by the state of IDAHO he must present this alibi and there are deadlines. If he chose not to put on a defense and rely solely on the state proving their case he could of done that. IT WAS HIS CHOICE to go with a DEFENSE ALIBI therefore he must play by IDAHO rules.
    Also the PC never said it was off, it wasn’t connecting to any towers, (could be off, airplane mode, remote area). Remember the phone could always be somewhere else than on him. I don’t see how saying the prosecutors pings are wrong but the defense experts are right. From what I understand it is VERY SUBJECTIVE just like the UNSPENT BULLET in DELPHI, and why Lie detector test are inadmissible in court. It all comes down to who is reading it and interpreting it.
    Another point, About the expert SY RAY - look up: Colorado judge finds "sea of unreliability" in company's cellphone mapping data. Also the judge found Sy Ray was not a credible witness."He inflated his credentials, inaccurately claiming to be an engineer”. As noted, his sole academic degree is an associates, and there's no evidence that it's related to engineering. Nor is there evidence that Ray's taken any engineering classes.
    If you dig hard enough you can always find problems on whatever side you agree with…

How can anyone make a hard decision on a death penalty case without knowing the facts or the evidence? We know very little of either yet people are anxious to say one way or the other. It was a horrible crime and I hope whoever did it is prosecuted and convicted. The prosecution must prove guilt beyond a reasonable doubt, we shall see if they can do that. So many people are convinced of his guilt and I like pointing out what they seem willfully blind to see. Including Grey Hues. What he considers facts and scientific is laughable.

      @@jordansharpe2886 I also payed a lot of attention to the Kyle Rittenhouse trial. The prosecutor, police, crime lab and witnesses were more helpful to Rittenhouse than proving a crime. The media and social media were against Rittenhouse and I see similarities in this case. Clearly all they care about is making money with no regard for the truth or justice. There is a conflict between his right to a fair trial and everyone's right to free speech. It's unfortunate people can't stick with the facts and be honest but that's the world we live in.

    Could BK have had 2 phones?? If the defence can produce a photo of BK in his car in the morning, he was out looking at the pretty stars, then that could strengthen the alibi. I do find it strange that the defence has waited this long to come up with the alibi. How their witness can prove where BK was on the morning the crime took place will be interesting to see?? I did not think that cell data was really strong 🤔🤔 Looking forward to hearing how the prosecution responds to this 😁😁
