- The plaintiff is in a rock band. While playing at the defendant’s bar, the plaintiff says a drunk patron destroyed his guitar, so the plaintiff is suing for repairs. The defendant believes he is not responsible for the patron’s actions.

Probably could have, but the laws in most places put responsibility on business to protect their patrons and their property. So you go after the one with deeper pockets if not both parties
Both parties are liable in this case, he can choose which one he wants to sue, but he can't sue both. Since the drunk guy who caused the damage is implied to be broke, it would be difficult to collect payment from a judgement, so by suing the business instead he is more likely to actually receive payment.
@@James-134 If he couldn't sue both, why do all these lawsuits say with a faulty airbag always seem to sue Takata, the car company, the car company's parent, the federal Department of Transportation, the state DOT, the other driver, etc.?

@MrMatteNWk he probably could've sued both. But the cost of filing multiple suits in small claims means its easier to go after the bigger pocket instead of both. With your car example, there's usually hold harmless agreements shifting the liability onto specific parties for certain things. But if not, and there was a car airbag issue, you could sue all parties involved. Typically the main party liable to the customer will have their insurance pay the loss and then go after the other at fault parties. This is a very basic breakdown, but you would sue Toyota and their insurance pays your loss. Toyota then goes and sues the airbag company (or files a claim on their insurance). If the fault was from a part that they bought to make the airbag, then the airbag company goes after the company that sold/manufactured that part. However, Big industries like car manufacturering very well may have protections in place preventing lawsuits like this to make it less complicated on large scale claims.
Businesses who send someone with zero firsthand knowledge of the incidents are just asking for a judgment against them. How is the person supposed to refute the allegations?
Exactly. And they always lose. They might as well decide to pay before coming to court.
If more people understood the court system, they wouldn't do that.
They think the boss or manager is more important, even though they know nothing about the case or think hearsay will work on the judge.

it's difficult to tell the price of an old guitar unless you go to actually sell it.
Brazilian rosewood is impossible to get these days and is widely considered the best rosewood for guitars.
$3k to $5k is a pretty good estimate.

Right. Most don't want to waste time with petty bs. But I think it's more of, if it was so important for the police wouldn't you make sure you had a statement taken and everything documented. Especially when you just stated "they took a statement and everything" which wasn't true. Unrelated if on scene they refused, you can go to the department and even file reports online.

Kirk is such a jerk. I hate how he cuts people off at the end of their statement. And then in the case of this gentleman, he was trying to play his guitar for us (the audience) and he cut him off too.

Smart people who play in bands and have what they consider to be "priceless" equipment have insurance on it. It's no different than having insurance on anything else you own or use for the purposes of earning a living. If you value something that much, then put your own insurance on it, which I'm sure he probably had but didn't want to use. If the defendant had had any witnesses to testify on his behalf, I don't think he would have lost.

Either the owners of the bar hate spending money or their bar is doing really badly. A sensible owner would either pay or offer to help out with the payment just to keep their good reputation in check.
The question that should be asked is why did not the band have insurance? Then the other why did the guy LEAVE the instrument period.
The plaintiff did have insurance. He still had to pay. And why can't he leave his instrument? Should he take the guitar to the bathroom with him?
I have to argue. It was on a stand in the band area. It should have some kind of protection. He was playing it that evening.

The entire case I was just wondering why they didn't sue the dude who did the damage. He's an adult and even if he was over-served he should be held accountable. If he drove home and hit anything they would go after him and not the bar.
That is a Taylor Grand Audit6orium 2500 new. Used max 1675. 65% . To buy another neck maybe 200. To glue it on I would say 350 max for repair. 1100 is over priced.

I would’ve never paid the full amount. I would’ve paid for the original price of the guitar, minus the shipping and insurance. There’s no reason for the defendant to pay that. I would definitely fight that.😊
A PA shouldn't just fall over either, so even if the bar wasn't reponsible for the drunk, they are still on the hook for a hazardous working environment.
Personally I think the drunken patron should be responsible not the bar, and if the bar is going to be responsible then they should only be about 50-50 because it was the patron who actually damaged the item

I got sued in small claims by a local business. Some of the claim wasn't true. She brought no paperwork, and she didn't sell me anything. I pulled out a credit card receipt and the judge accepted it as payment. Since she brought no paperwork, the court has to go by what I said.

To me, it's not the bar owners fault.
The laws in most places put responsibility on the business to protect their patrons and their property. If a customer put a bag down at their table and I trip on it when walking by and hurt myself, most Liabilty insurance policies will cover that type of thing. They may be able to then go after the person responsible but often the laws states that the business has the duty to protect their patrons, even from other patrons.

It was not on the police report the drunk man was driven home by the officer just people saying so !!!!!! So the judge was right hear say ( not on the report ) !!🤔🤔👏👏🤥

The only evidence by the plaintiff was that a witness affiliated with the plaintiff testified that the guy was holding a cup in his hand when the incident happened and so the judge, therefore, finds that proves the plaintiff's case???? Even if that biased witness statement is true, it doesn't indicate that the patron was overserved by the business since there's no evidence that he was, in fact, drunk. He would have had to have been overserved for the business, apparently, to be liable. This judge is like judge Judy: if she likes you, she'll be more likely to find in your favor. In this case, the plaintiff didn’t even come close to having the burden of proof. The judge just gave him money for his "priceless " guitar, which was an admitted lie. After saying it's priceless, he immediately assigned a relatively low price for it. Ha. And the judge asked for no estimate or appraisal of its value. She's a hack.

The drunk aspect is actually irrelevant. The guy could've been sober and if he fell and broke the guitar then the bar could still be held liable. The business has a duty to protect their patrons and their property, even from other patrons. That's what Liabilty insurance is for.
This human nonsense is unable to sue who's responsible and so he wanna pin it on the bar.

The report did not say he drove the guy home it just said he lived at an address and was broke.
I feel like they shouldn't have been responsible because who's to say he was drunk when he got the drink. Witness said I saw him with a drink in his hand. Not that he was at the bar and got a drink while being drunk. Plus who says he went to the bar to get the drink. Could've been a sober friend.
