i was trespassed from a roadside rest stop in I-65 south of Montgomery
I saw a lighted sign on the side of the freeway last night that read:
"If you feel drowsy pull over and rest"
It failed to mention that the police will run your tags and issue a citation for sleeping in your vehicle. Stay safe my friends.
That was the first thing that came to mind for me. Just saw a sign yesterday day that said this…
Yup just took my road test to get my license back today and that was one of the questions and the correct answer was to pull off to the side of the road to rest. In my mind I was like yeah right so the cops can roll up run ur plate and tags and sit and screw with u for an hour about it

If you would listen, you would know that they got a call on her. So probably they have to follow some rules and not ignore any call. They can not choose which calls they will admit and which calls they will ignore.
When you have your kids, you decide which calls you will ignore and which ones you admit?.. There is no logic in your thinking process.
It's interesting that you only judge the cops in these cases....but you never judge also the people who called the cops on her... It's really a double standard.
On Judge Judy was such an episode where the witnesses broke the window of the car because sleeping in the car is dangerous, then they sued each other for the broken window.
@@alaalfa8839 So, the police need to respond to every call even when a law is not being broken such as the case above? A welfare stop in this case is just used as an opportunity to intimidate someone and make up some laws to justify it.
True story: Dutch cops once inspected a guy sleeping in his car at the side of a road. He was drunk and sleeping of his intoxication. Dutch police drove him home in their car, one of the cops drove the drunk man's car home. That's what I call serving the people.

Another true story. When i was younger i got a couple times pulled over by Dutch cops for smoking weed and not one cop feared for his life and started putting bullets in me within seconds of arriving..

I remember hearing stories of relatives, friends of relatives, my friend's relatives, telling stories of being too drunk to drive and the cops would come and rather than allowing that person to get behind the wheel of a car and possibly hurt themselves or others, gave them a ride home. This was back in the 60s, 70s, and early 80s though.
I think when DUIs became the big "moneymaker" for many of the municipalities that they are, that all stopped and they would rather stop someone and tag them for DUI. There are even "awards" given to officers that write so many DUIs and Speeding Tickets within a month and or year.
@@thomasjoseph5876 Back in the 70's living in Phoenix I used to drive a VW bus, at that time most (not all) cops were looking for any excuse to pull over a "hippie van" and find something wrong.
@@goldfieldgary Not surprisingly, "hippie vans" were notorious for people who owned them being marijuana users, and back then, it was a big deal if you got caught with anything. We are talking DUIs here, not drug users. You have to remember how society saw alcohol vs drug use back then.
The charges were dropped and she received a settlement and apology from the officers due to legal council from her father. Any other citizen would have had to pay for an attorney, bail, fines, tow, and storage fees her car. Could have been two or three thousand dollars plus a criminal record for sleeping in her car.🤔

It was really devious behavior when the officer threatens her with up to 90 days in jail if she doesn't hand over her ID.
“We responded to a call”. Somehow police think that an anonymous call gives them the authority to violate your rights. “A call” authorizes them to search your home without a warrant and identify you without a crime. This has to change.

Former police officer and sheriff's deputy Abiyah Israel described his experience in police academy and he said the academy did not teach them the law, did not teach them the Constitution, did not teach them skills for dealing with people or de-escalating situations... but they sure learned how to shoot guns, how to fight in hand to hand combat, and how to write citations and arrest people.

@decur8 In the military, this is known as ‘ready, fire, aim’. The field officer in charge is the responsible trainer. In this case I’d demote the LT and/or make him sign a 90 day letter of improvement (detailing training plans with weekly updates or face termination).
She literally got arrested for requesting the officer's name, these guys are what gives all cops a bad rep.
There doesn't seem to be any shortage of bad cops. THAT'S what gives them a bad name.

She was absolutely correct to write down the officers names, which the officers are required to provide her.
It is amazing how often body cam video that proves a suspects hadn't done anything wrong goes missing or was "accidentally" deleted, yet, amazingly, any footage that helps the officers case is ALWAYS preserved. I've been involved in multiple cases where this has happened.
Medically speaking, this is a serious case of ACAB.
Unfortunately for the damned and stupid police officers, the girl's father is a very powerful citizen.
Perhaps because of this, or by some divine miracle, the images recorded by body cameras have not disappeared.
Officers are NOT required by law to identify themselves.

A friend of mine got a ticket there for not parking dead center in a parking spot. He was held up for about an hour, and his pickup was searched. He took it to court and had his ticket thrown out.
They aren't public servants in that town. They are revenue generation officers. Worst town in Alabama.

My mom has narcolepsy. She often has to pull over and take a 20 minute naps. Other motorists have called police just to make sure she is ok. They come, knock on her window, ask if she’s ok and then they are on their way again. Simple. She’s annoyed but also greatful concerned citizens are looking out for people. But then again a situation she has been in has also never escalated like this
But why do people call the cops for that? If they are concerned, which itself can be understandable, then why don't they just knock on the windows and ask if she's ok?
So if they id her, they will know exactly how long she was sleeping. Makes complete sense.
That's what I never understand in these videos. Their reason stated for NEEDING to ID the person rarely has anything to do with the issue at hand. In reality they want two things: 1. Any reason at all to check someone for warrants. 2: For their authority to never be questioned ever.

The only thing I would say to her is that once the police tell you that you're under arrest and/or if they give you a reason to ID, it doesn't matter if they're right or wrong, you should provide ID at that time and make clear that you're doing so under duress due to threat of arrest. Then get an attorney and file charges against the officer and department. You should never get into a physical struggle with police, once they initiate force comply with them and deal with it in court after the fact.

She tried earlier in the encounter but the police officers didn't let her speak. But she, in all fairness, did only try once. She really looked like she just wanted to sleep some more. Poor girl, those 4 hours were probably the only sleep she has gotten in quite a bit of time. Like a nurse coming off a 36 hr shift or something.

Her father, James “Buddy” Caldwell the former Attorney General of Louisiana, represented her. It appeared for a short time that the City Attorney of Guntersville Dan Warnes wanted to pursue the case, however, not long after the first court date was postponed the city began talking settlement.
Finally, last summer, the case was settled, and all charges were dropped. Mrs. Landry received an undisclosed cash settlement and two of the three officers on the scene apologized. (One officer was not with the department at this time.) Her record was expunged as well. Mrs. Landry no longer lives in Alabama

I was a cop in France for a few years. I've found this interaction absolutely incredible ... Why on earth would you harass someone who is peacefully sleeping in its car, legally parked, in a public parking spot ?

Because in America, if you're in public, you have to be busy spending money. You can't be sitting idle not spending money. This country is run by the criminally insane.
Right if you're taking a nap and are legally parked you won't get on trouble in any Western European country afaik. Now sleeping a whole night in a car is different. It is illegal in Portugal, Danemark or the Netherlands while legal in Sweden, Norway or Germany. In France, Italy and Switzerland you need a permit to spend a night in a car/camper although cops do usually not bother people, esp. if it's just for one night. I was once awoken when I was sleeping in the back seat of my car on a motorway service area. I had to show drivers licence&insurance and was told I could not take a nap there and after some back and forth left. But they would never arrest you just for that!
This interaction means you can call in and say "i saw a person with a gun threatening people" and they'll absolutely destroy an innocent person because of a phone call.

As a 34 yr law enforcement veteran and former training officer, I am ashamed at the behavior exhibited by these officers - particularly this Lieutenant. This is an example of a city getting what they paid for - crap salaries call for crap employees.

The one time I was approached by LE, that’s EXACTLY how it went down. I wasn’t asleep and it wasn’t a park, but very close to the same circumstances as this. He asked if I was ok, saw that I had the remains of lunch beside me and was reading a magazine, and bid me a nice day. Idk why Warrior GP wants to criminalize innocent activity.

I was driving from the South of England to Central Scotland (about 400 miles or so) one Friday evening after a busy week at work. At one point I began to feel very sleepy, so I pulled off the road into a layby and snoozed for a while. I was woken up by a rapping on the window. I wind the window down to see a Traffic Officer resplendent in his high-vis raincoat.
"Are you OK Miss?"
"Aye, I came over all tired, and rather than risk crashing my car I pulled off for 40 winks before I continue my journey."
"Oh, that was a good idea. I saw your car and the windows were all misted up, I'm sure you understand the concern. There's a coffee stop a mile or so up ahead, if that would help."
"Thanks Officer, I'll get myself a rocket boost of caffeinated heaven and that should help."
"No problem, take care and drive safe."

I drove once from Maine to Texas. Somewhere along the way, don’t remember where, I had to pull over to sleep because I was just exhausted. I pulled off the highway because I just couldn’t keep my eyes open anymore. A couple of hours, a highway patrol officer banged on my window to wake me up. Never asked for my ID, nor even my name. Just politely said that I couldn’t sleep on the side of the highway and promptly directed me to the next rest area about 10 miles down the road. Things have changed a lot since then.

It's outrageous that any random person can call the cops and make allegations about a person being "suspicious" and the cops then have the "right" to harass the person.
THIS is the root of the majority of these obscene cases of overreach. They have paperwork to fill out and they will get reprimanded if they don't have the name of the target of the investigation. That is why they will basically break the law in order to get the person's ID info, including arresting the victim for "obstruction of an investigation" that they legally don't have a right to pursue.

To be fair, she was called for being suspicious. The officer affirmed several times that this was supposed to be a welfare check. The caller was, presumably, concerned for her wellbeing. Though, personally, I would have checked on her myself if I was so concerned and called for EMS if I thought there was a issue.
