The allegation is he broke Federal law, State election law and tax laws. That is why it is a felony charge and not a misdemeanor. In New York, the clock can stop on the statute of limitations when a potential defendant is continuously outside the state.
A state DA cannot bring Federal charges. He can recommend the crime/charges to the DOJ, FBI, etc at the Federal level, but he cannot prosecute on behalf of the FedGov. He has no authority to "convert" a crime from an expired misdemeanor to a Federal felony charge. He is not a Federal agent, and in doing so he is illegally impersonating a Fed. That is a felony.
