  • There are a number of cases before the Supreme Court that will “reorder law and American society,” according to Richard Hasen. He is a professor of law and political science at the University of California Irvine and an expert in election law. He is also the author of "Cheap Speech." Hasen speaks with Hari Sreenivasan about how to stop the spread of disinformation that is poisoning politics.

    I didn't sign up to live in Talibangelical America. This fall's election is critical, but I am not hopeful with all of the election rigging going on in too many states. It's time to create an escape plan, because living in Gilead isn't my idea of a good time.

      It's going to be really difficult to put my tri-racial body back into the bottle. Well over half a century later, I am never going to be White. Millions of inter-racial exist. On the one hand, they want women to have babies who are not wanted. On the other hand they don't want inter-racial babies. It's a bit late for that.

      America has been a facist state since its inception as also has a decades long history of destroying democracy and installing authoritarian regimes across the globe.       How very true but America has always boasted of many things that were never really true. All countries do this to some degree. It has never been a fair society although segments of the country have been working towards changing that for decades....and nearly succeeded. Greed, unbridled capitalism and religious insanity, will be the country's demise...and in the case of the only party who can stop it, the democrats, they are proving themselves too weak to deal with this clear and present danger. It breaks my heart to see what is becoming of the country I once called home.

      In Australia we have a federal system, but national elections aren't run by the States. They're run by an electoral commission independently of whichever government is in power. The US electoral college system seems nuts, as the college can overthrow the will of the people.

    I am not pro-murdering babies.
    I am Pro-Becky who found out at her 20 week anatomy scan that the infant she was so excited to bring into this world had developed without life sustaining organs.

    I am Pro-Emily who went through IVF ending up with SIX viable implanted eggs requiring selective reduction in order to ensure the safety of her and a SAFE amount of fetuses.
    I am Pro-Christina who doesn't want to be a mother, but birth control methods sometimes fail.
    I am Pro-Jessica who is FINALLY getting the strength to get away from her physically abusive spouce only to find out that she is carrying the monster's child.
    I am Pro-Vanessa who went into her confirmation appointment after YEARS of trying to conceive only to hear silence where there should be a heartbeat.
    I am Pro-Lindsay who lost her virginity in her sophomore year with a broken condom and now has to choose whether to be a teenage mom or just a teenager.
    I am Pro-Courtney who just found out she's already 13 weeks along, but the egg never made it out of the fallopian tube so either she terminates the pregnancy or risks dying from internal bleeding.
    You can argue and say that I'm pro-choice all you want, but the truth is I'm pro-life.
    Their lives.
    Women's lives.
    You don't get to pick and choose which scenarios should be accepted. Women's rights are meant to protect ALL women, regardless of their situation!

      @Just Be it would be such a relief to be able to trust the people making laws governing the use and disposition of our bodies and our health to have common sense, and hopefully good will as well.
      There seems to be little indication that any thought, study, or Sense went into the extreme strictures of the laws being pushed upon 51% of our population.
      The legislators are not not usually licensed to practice medicine and their choice to impose their judgement on women whom they have no license to examine or diagnose should be recognized as criminal.
      The fact that they are taking it upon
      their ignorant selves should turn off anyone who has any regard for the safety and well-being of the women and children who fall prey to them
      That they are imposing conditions upon the potential mothers of our future generations is beyond alarming.
      Women's status is being made roughly the equivalent of some poor unneutered bitch stolen by the operator of a puppy mill to be bred as often as possible for profit.
      But we pass laws to prevent dogs and cats from being so callously exploited.

If the SC tries to undo the progress of the last 50 years it’s going to be utter chaos.       The US Supreme Court is doing its job as part of the checks and balances of the federal government. Roe vs Wade was bad law. Justice RGB said so.

      I'm sure Clarence thinks he'll be given special consideration for all the hard work both he and his best friend have done. Of course, if tramp tells Ginny to dump Clarence, she probably would in a heartbeat.
      My bigger worry is the criminalization of crossing state lines or attempting an illegal abortion, and for you men, don't forget anyone aiding and abetting that pregnant wife or girlfriend will undoubtedly be criminal also. Then you can give birth in jail and they can take your child on the grounds you're obviously unfit and sell it onto all the women who want to adopt Alito seems so worried about. Don't forget they can put you to for peanuts in all those privatized prisons the US built. I'm glad I turned18 in 1974, but I'm sad and scared for how successful republicans have been in undermining democracy. It's been heartbreaking to watch this 40+ year plot being carried out.

      I love in a liberal bastion which I really like cuz everybody seems sane here. But sometimes it sucks because I feel like I can’t affect much positive change because many people are like minded. Although there are many public disagreements it’s not on the level of national disagreements. Sometimes I wish I lived in a conservative area just to make a difference. But other than that man... you’re right. People are crazy these days. The US is trending towards theocracy, tribal partisanship, anti liberalism, anti ini democratic, anti intellectualism, nonsense. And the GOP, which used to be the party of small government is increasingly becoming heavy handed, draconian, and authoritarian. Especially with figures like in Florida it is big government, draconian rule in the interest of imposing cultural dogmas. Doesn’t seem like the land of the free from a few decades ago.

      @@willcerf757 You realize of course that conservatives see themselves as curators of true liberalism, and so called liberals as believing in a current form of Marxism - Leninism, which has always failed in nation after nation.
      Conservatives believe in the historical truth that Christian moral values were and are an essential basis for a the founding of the USA as a happy and productive society, while recognizing the human mistakes which have and can be corrected over time.
      The tribal partisanship that you mentioned is seen as intentionally generated by the Democratic Party in the form of "wedge issues" to divide and conquer the nation. Those wedge issues are hammered home 24/7 by a large propaganda network of networks, publishers, and social media that operate in lockstep.
      The heavy handedness that you perceive in the GOP is, IMO, a direct response to generations of unacceptable authoritarian, draconian, corrupt, dogmatic rule by the Democratic Party, that has destroyed or weakened many aspects of our society. That destruction being accelerated by Biden - Harris is no longer tolerable. It has taken the nation to the brink of destruction.

      Not reset to the 50s because the wealthy paid a lot of taxes then. Nixon created OSHA and EPA at the end of the 60s to early 70s. Since then, it's been all about deregulation and privatization. Throw in some Reaganomics and reduce those taxes. The Federalist Society and some others have been busy rewriting laws and taking over courts. You have to remember the huge part Newt Gingrich played in breaking the political system and aligning with white Christians to create single-issue voters who could be manipulated as a large voting block. It wasn't easy, millions maybe billions have been spent and a lot of local politics manipulated to accomplish this huge division of American society necessary for the wealthy to achieve their goals.

      Yes and no. If the electorate in many states was not so dominated by ill-informed, bigoted and reactionary citizens currently fueled by obsessive grievance, we might see the voters kick out virtually all Rs from the process until such time as that anti-democracy cult apologized for its endless falsehoods and corruption. I blame the voters who keep supporting such flagrantly warped, cynical and dishonest political opportunists. We also need major structural reform of the Senate and the Supreme Court along with elimination of the Electoral College in favor of a more fully democratic process of selecting a president. Our fragile democracy is on the edge of a cliff. I'm not convinced we will prevent it going over.

    This professor is spot on with everything he said. Everyone in this country needs to listen carefully to what has been done, is still being done by the politicians who are in the minority and have been for decades now. I, for one, am well past being sick of minority rule. We need to do away with the antiquated electoral college. We need to put pressure on the voting rights act to be passed.       Both parties have been equally complicit in messing up this country for decades until a few years back, but now it's not even close. The GOP's only platform is supporting Trump and banning abortion, it's especially appalling coming from the party that is supposed to be about limiting government intrusion into our lives. I pretty much always vote libertarian/third party but tolerate others well, but at this point going forward I am disgusted by anyone who votes for the GOP to retake the House. A divided govnt has always been my preference to avoid either party pushing their agenda too far, but right now I can only root for the Democrats.
      That being said, my official prediction right now is Trump loses but less than he did last time, and the house does actually overthrow the results and installs him as president. The Democratic Party should force Biden to resign, several other candidates could beat Trump and be less susceptible to that coup, but the DNC has years more experience than the GOP in forcing party insiders into the nomination, so they'll likely shoot themselves in the foot just like they did the last few elections. Anyone but Hillary would have beaten Trump, and several other Democrats would likely have beaten Trump by several million more votes. Democrat voters need to get rid of their superdelegate system, the DNC is FAR more corrupt than the GOP when it comes to nominating a candidate. I'd vote Tulsi with no regrets

      Do some research to find out which countries have the best benefits and how they suit your lifestyle. If things like universal healthcare, family leave, subsidized or free childcare are important, check out Scandinavia.
      Canada has a universal healthcare system but you'll have to wait until you have permanent residency or citizenship to access it. College is cheaper there but housing costs there are sky-high like everywhere else.
      Most people I know who emigrated to other countries go to where family and friends are already settled and can help newcomers get started. Otherwise, I'd suggest finding a sponsor or make contacts in the country with reputable organizations, and get some job prospects.
      Most online "immigration attorneys" you find on Google just want to take your money. Call or visit your nearest consulate or embassy once you make your choice where you want to move.

Liberal leaders need to have strong candidates ready to go to take over those seats and get the votes to get strong laws of protection on the books. Also, it seems very clear that SCOTUS needs to be expanded, and term limits for all branches of government.

    Two years ago I applied to Irvine Law School ,where this guy is from, and Harvard Law School. They both now accept the GRE for admission. When I told them that I had bought a book on Amazon titled '30 REAL GRE ESSAYS', published in 2014, BUT THE QUESTIONS DON'T CHANGE FROM YEAR TO YEAR, I received a one word reply from both 'REJECTED'.     Sad to think that voting rights and ensuring a system of fair representation has now largely become a "partisan" issue. We are at a point now where we can no longer state with full faith and confidence that an elected political candidate will indeed be the representative that takes office, or that election officials, those in office to referee elections, will not make decisions based on their allegiance to party but rather their allegiance to the greater public.

    The U.S. is in for decades of governing by the minority opinion due to flaws in our 'Democracy' (if you can even call it that). The president elected by the minority due to the 'electoral college' and 50% of the population represented by only 18 senators, but 52 senators from the 26 smallest states representing only 18% of the U.S. population, we are fundamentally an undemocratic 'Democracy'. The thing is this will continue to get worse in the future as demographic distribution shifts and we can't vote our way out of minority opinion governing. I'm old and almost glad I won't live to see the final downfall of our country.

      the main issue is term for life rather than set term as anyone in an office too long, on any political leaning, becomes more fixed and over- confident in their thinking.       They’re not interpreting laws here. They are literally removing a precedent which will have a negative impact on several other laws. Moreover, their rationale for this is NOT logical. Alitos arguments for overturning roe vs wade is false and is not based on rationale thought but on moral belief. This is a terrible way of thinking and reasoning since this country has all types of people with various views, and in order to preside over a system that governs those people, the Supreme Court must separate their own personal moral and religious views from legal arguments. But these judges are not. Having people like that in our courts for such a long time can only hurt us in the long run.

      There is no law permitting nationwide abortion. There is nothing in the Constitution about it. So by definition a decision on the subject involves interpretation. Roe was an interpretation. The Court has plenty of times when it rejected prior rulings. Brown, miscegenation .... all that involved interpretation and overruling prior decisions.

Never has the Supreme Court made a decision like this using rationales that are based in religion, are illogical, and would subsequently have a negative impact on other rights once implemented. Their reasoning is not based in fact, nor science but in religious views not shared by all Americans, which is unconstitutional. FYI there’s nothing in the constitution either about not permitting abortions nationwide. But the court has no problem making stuff up to justify their draconian thinking.
