  • The plaintiff purchased glasses from the defendant's shop, but she claims she couldn't see clearly out of them. The plaintiff says the defendant refused to repair them, so she is suing him for a refund. The defendant insists he did a perfect job with the glasses, and the plaintiff didn't complain until a year later when her eyesight had clearly changed.

      An eye exam has changed since Covid. The optician/optometrist has not returned to the office. Exams are remote and all you hear is his voice... which is blurry a or b, next.... he could be pool side in a speedo as far as I know.

    Her eyesight changed drastically in that short period of time. That happened to me during law school. I jumped 2 times in 1 year due to a lot of studying. Unfortunately, that was a cost I had to eat, not the eyeglass shop!

      Straining or overusing your eyes has no known connection to permanent change in eyesight. Your eyes might be tired and mildly blurry for a few hours, but you won’t need a new prescription because you study too much.

      yes agree, nearly overnight my eyesight changed from not needing glasses to read messages on my cellphone to needing glasses to read the messages,

      Me too, I never needed glasses until my 2nd semester of medical school. Carrying books around in high school and some in college was pain, but I would gladly carry them around again if it meant that I never had to look at a computer screen. Reading from a book is not nearly as bad for your eyes as reading from a computer. I had my glasses prescription changed twice in a year and a half. I had to pay for both pairs. Optometrists are funny that way. They don't like working for free, lol.

      but barring how good he is, it happened to me--from being able to read messages on my cellphone to nearly overnight needing glasses, now i cant read any messages on my cellphone if i dont have glasses on, it was not gradually ,it went fast for me, so shes just looking for afree ride

      As someone with thick glasses I don't have a problem with them. My only concern is if I'm playing sports, but thick or not I'd always be worried about them breaking during that.

      I’m severely nearsighted as well. I have to pay extra for thinner lenses. That’s also an option.

      I’m severely nearsighted and wear thick glasses. It’s common for people with severe near sightedness vision to change drastically. Also my frames constantly slide even after getting fitted because the lens are so thick. This isn’t on the optometrist in my opinion.

    Her new glasses that work perfectly are presumably the new prescription. Either her eyes have changed significantly in the year (very possible) or the first optometrist screwed up her exam and the glasses made according to that 1st prescription never seemed right because because the prescription was off.

      Sometimes things we do with and without our glasses can also affect our eyes as well. My eye doctor felt bad, he forgot to tell me the previous year not to read with my glasses on. My eye sight has improved, still need glasses as I’m very near sighted but now I can make out someone one 4 feet in front of me if I happened to have them off.

    I have horrible eyesight and myopic degeneration. I used to have Coke bottle bottom lenses. If you PAY for thinner, plastic lighter lenses they will feel better but they are EXPENSIVE. She didn't want to pay for them.

      You’re talking about high index lenses. She has an extreme prescription of -16. The lenses she has are definitely high index or they’d be wayyyyyy thicker. She probably paid over $1,000 for those glasses.

    She has two different frames. The glasses she's complaining about is smaller with a thinner rim, so the thick glass will of course protrude more beyond the rim. The lady's crazy. The defendant should've countersued for lost wage to appear in court.

      That and her New glasses are a round frame. The ones he made are an Oval frame. It's only natural you will look out of oval frame differently than a round shape; she just wasn't used to it and didn't want to figure it out but wanted the "cute style" of an oval-style frame. I know, right now, I can see the top of my glasses oval-styled glasses...I can also see the "side" of my lenses as they are thick.. You learn to ignore it after a while (seeing the edge and frame).

      A lot of defendants two to sue for time off work to attend court, and the judge's response is always the same - it's not something you can be awarded for because people needing to attend court is just part of the legal system. It may be possible in a case where a lawsuit is completely frivolous (as in, the person is literally only suing to be a nuisance to the other person, knowing they have no case), but that's rare. In the vast majority of cases, the person filing the lawsuit thinks they have a genuine claim, no matter how obvious it may seem to the rest of us that it's going to fail.

    This is why it’s recommended that you get your eyes checked every year, because our eyesight worsens a little more every year. It can be a slight change or a major change. The woman tried to get free new glasses with a new prescription. That is why she lost.

    The eye doctor was saying that the lenses needed to be thinned by the nasal passages. Not the nose pads.
    Also, you don’t have to change frames to change lenses. He should know that’s what the doctor meant. She was happy for a short time bc the lenses were not cut right or properly. I used to make glasses. The optometrist should guided her to a better frame.

    Wire frames hold lenses differently than plastic frames. She just needs to get laser surgery. My eyes were so bad and thick with my nearsightedness. Got laser surgery and I’m now20/20.

      How long have you had lasik ? I got mine over a decade ago. It was great for a while but I'm now nearsighted again. Your eyes change shape as you get older, so lasik won't be permanent.

    what the plaintiff doesn't understand is how big lenses in small frames is not a combination that goes well together. i had glasses for 30 years before getting LASIK, and I had a bad prescription as well with thick lenses, but not as bad as hers, but how does she not understand that her prescription changed??

    I got new glasses and they changed the prescriptions. I couldn't see as good, but the optometrist said it will take 2 weeks to get used to them. I ended up just putting back on my old ones and have been wearing them for 1.5 years now and they are fine. I'll got to a new optometrist next time. She wasn't bad just didn't get it right.

    This woman in this court case is a liar and is trying to get new lenses for FREE. Your eyes can and DO change, even in only a year. I have extreme near sightedness and would have pop bottle lenses if I didn't spend a shit ton of money on very expensive lenses so they would be much thinner. This woman could have done the same thing I did but didn't want to spend the money apparently.
    She also said she can wear contacts because they are ON her eye. No, it's because they are paper thin and are completely different from a plastic lens. I'm not even sure if her lenses are even plastic, they could have been glass. Some people still prefer glass because they are much cheaper and don't scratch as easily but are MUCH heavier.

    I have the same problem as her. Horrible vision. Contact lenses work bc they sit right on my eye but glasses just don't do the trick.
    I've tried stronger prescription and different shaped lenses but I can't use them for daily wear. Only around the house.

    I wear glasses. I have had lots of damage done to my eyes due to an aggressive brain cancer. Having multiple surgeries on my eyes almost every year and a half.. I'm constantly changing my prescription. With that said, glasses loosing up, nose pads needs changing etc. I don't think anyone has explained this to her

    When people have very strong prescriptions they advise you not to choose the thinnest frames because the lenses are going to be thick and stick out.

    So many Optometrists over correct or the patient has a hard time with the proper prescription. If the glasses are made correctly, it's not the person who made the glasses fault. Her eyes either changed or with her severe eye issues, she just couldn't tolerate the glasses(even though they were made correctly). He did the work, how does she deserve a refund?

    I have to get my eyes checked because I started a job less than a year ago and now I’m using multiple monitors. I know my sight has changed because I can feel the strain. Waiting that long to pick up the glasses was not a good idea.

    She doesn’t realize that the frame and style she picked out also has a big impact on her vision. I can’t wear the metal framed glasses with the oval lenses. I just can’t see clearly. I switched to a plastic square pair with a built in nose piece and it’s fantastic. Sounds like that’s her problem too. I can’t wear contacts.

    I feel for the plantiff... I remember one day I had my glasses on and walked outside. My neighbor waved hi to me. I couldn't see him, so i took my glasses off. When i took my glasses off, i slipped and fell down 2 steps, landed on my lawn, and was fatally stabbed in the leg by a blade of grass. I sued my optometrist because i did not see it coming!!!

    she's blind. when allowing your eyes to adjust is what changes your prescription

    I have similar eyesight issues. There is definitely an adjustment period each time one goes from contact use to glasses. Her eyes are reacting normally to progressive frames.

    I understand what she is saying , I had one optometrist that did my perscription perfectly. But everytime I go where my insurance pays they can never get the perscription right. Especially if you have several things going on. But in her case I think she chose wrong frames for her face.

    I can understand what the plaintiff was trying to say because I had a similar experience. I had 4 pairs made couldn't see out of them. They did the exam again a month later prescription changed I couldn't see they changed them again. Then kept sending me new glasses and dragged it in for over a year. I contacted the head office they dragged it on for almost another year. I now have 7 pairs of glasses that are worthless and still no solution 🤷‍♀️

    I usually see the optometrist to get my prescription and then take it and order my glasses online. You will usually find much better prices online since some of these companies can sell wholesale since they have a large quantity and likely will have a much bigger selection to choose from. And then you can always take the finish the glasses back in from minor adjustments to your local optometrist. I've done this with two Cazal frames and a Tom Ford frame.

    Her old frames look a lot more difficult to make thick lens for since they are a lot smaller than the new frames which is probably the cause for needing multiple adjustments. My verdict if for the defendant. 🤣

    LOL of course the lenses stick out so much more for that pair! They're the thinnest frames you could find xD The sheer weight of the lenses was probably what was deforming them to begin with! I have terrible eyesight and even with the more expensive lightweight lens material, it's still going to sit heavy in the frames.

    My eyes have been changing almost every year. So, I think either the first doctor misdiagnosed her or her vision simply changed.

    I know that sometimes depending on your prescription and lens thickness you have to choose a sturdier frame to support the lenses better.

    I am on her side. Same thing happened to me at Costco. They encourage you to walk out the store with them. Once you do, they are your glasses. It's like the minute you drive off the new car lot- it's your car. You have to be strong and insist they make it right. Do not take the product out the store- do not cash the check, etc. That is the best way you can win. She told him from the start they did not work. He played games and tried to get her to use them. As time goes by, he gains an advantage.

    If she can get by with contacts, what would even possess her to want to wear 2# of difficult to adjust framed Mr. Magoo glasses?
    Does she just do it for the attention & sympathy from anyone having to see her struggle with those things on?

    An eye glass prescription is only good for 1 year just for the reason that the RX can change. A year and a half later is not his fault! Stupid woman to sue.
