    Hello, my husband came to the USA with a tourist visa in the year 2015. He would travel back and forth to the US until we got married on January 2016. We applied for an I-130 in May 2016 and received a receipt in August 2016 and his I-94 expired in September 2016 given from the port of entry by land. At the time, I was only a Permanent Resident but became a US Citizen recently on December 2017. After I got my Certificate of Naturalization, we applied for an I-485 Adjustment of Status and sent all documents requested to NBC and got a receipt in mail last week from USCIS. My husband has a medical exam with an approved doctor tomorrow so we can send that to NBC as well. We are a legit marriage, but I am worried that since he overstayed since September 2016 it would cause problems. Since I recently became a citizen, would that automatically be an advantage? Also, from now, January 23, 2018, how long do you think he would get a fingerprint appointment?
    Thank you for your help

    Hi ! My husband and I have been married for 1 year now living in Germany. We are planning to move there and start the process through adjustment of status. Do I as a German enter with my normal passport as a tourist? I don’t need a visa as a German. I just need to fill out ESTA and can stay 3 months.

    I'm on F1 visa and I have my SSN working on campus and OPT. My OPT expired already and went back to school to maintain my status. The thing is I used my SSN for work when I shouldn't have. Now I'm getting married, will this be a problem for getting the green card? I saw on the form I485 that they ask if we ever worked illegally!

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад +1

      You can definitely marry your boyfriend, but he won't be able to join you for approximately 2 years (that's the time from filing until the interview at his country's Embassy). After his interview, he will enter US with immigrant visa and immediately receive Green Card that allows him to work legally without any other document. Call us at 718-769-6352 and I will email you the list of documents you need to get started filing for him.

    Asking for a relative if he came here to America at a young age and is now planning on getting his green card. The lawyer is saying that he has to go to Mexico, does he really have too, and are there any risks in that because he is currently in America without proper documentation. Hi, I had my interview yesterday and I think that was good.......we had separated interview and I think they didnt like fact That I came to US as tourist and I got a marriage but I didnt applied for GC because I wanted visit my son in my country....and when I came back to US after 1 month I didnt reported my marriage to the border officer......I told to the immigration officer in interview that I didnt ask about nothing when I returned.....so......she told that they gonna do a background check and give a response in 60 days if yes or no for my green card.......I'm worry because my marriage is real, we applied for green card 6 months later after marriage........please, could you tell me What do you think about this?

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад

      It may not be anything, or they may issue some sort of Request for Evidence for you (about their suspecting that you had fraudulent intent when returning with a tourist visa while intending to stay in US permanently to apply for green card), in which case you may need an I601 Waiver. I would recommend to just wait for now and if you have a troubling letter from them - give us a call at 718-769-6352.

    So if u applied for k1 visa and upon arrival to the us. You get married within 90 days. Do you have a time period where you have to apply for i-485? Like within 6 months or a year? Or no time frame since they came in on a k 1 visa. Or immediately after you get married? And prior to obtaining I-485 can you legally work?

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад

      gilbert512 As soon as you get married, your wife can apply and receive a Social Security number and work. You have to file the I-485 within 6 months of the K1 visa issuance, although I had clients that applied a bit later and still received the Green Card. Don’t wait a year, that’s just ridiculous

    Please could you confirm if I have to send all copy of documents to prove my marriage before the interview to green card.

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад

      When you apply for Adjustment of Status, I-485, you do not have to submit all your "bona fide" joint supporting documents. Instead, you must bring those (and one set of copies for everything) to your adjustment of status/green card interview. But you have to collect them while you await the interview, i.e., collect joint tax returns showing you filing as married filing jointly, joint utility and other joint bills, joint insurance policies, joint bank account statements, joint credit card statements, joint leases or any joint contracts, etc.

    i m on F1 Visa and doing work in initial Opt which is going to expire in june-2018 but my project is until end of december-2018 so i was thinking to apply green card through marriage based(i m already married in octocber-2017) in January-2018 , so my question to you is does my OPT EAD card will revoked once i applied for green card application so it means i can't work with my project until i get GC-EAD. give me the best answer, thanks

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад

      It will not be revoked, but once you file for Adjustment of Status, you will file for a NEW EAD and will be able to receive that, which will extend you for another year of legal work. Please contact us for your adjustment of status preparation and we will be happy to help you. It has become very very complex in the recent months, with new very detailed legal forms and the Trump administration breathing down everyone's necks. Our telephone number: 718-769-6352.

    I want to marry the love of my life but she lives in the UK. I want to bring her here and get her permanent residence but I don't know the steps. Can she just come without a visa and get married to me then we apply for a greencard? Or would we need to apply for a certain visa first?

    • @MarinaShepelsky
      @MarinaShepelsky  6 лет назад

      If you are a tri-state resident, please call my office and set up a free consultation, where we can review your options. There IS an option for getting her a green card after she enters with a visa waiver permit (that most UK citizens have). Our telephone number is: 718-769-6352.
