As a lawyer, I view it as impossible that a litigant will not see the documents which are the core of the case. That is nuts. Discovery is very broad and the ACC can delay, but ultimately will be required to supply all documents.
If there is any ultimate showing that ACC counsel misled the court, that could get very ugly for the ACC. Judges do not like that. Trying to deny what will ultimately have to happen is a bad place for a lawyer to lose credibility.
Clemson used what happened with FSU as a basis for their complaint and I wrote that FSU would use the Clemson filing. FSU did just that with the argument about the impact of no longer being a member of the ACC. If that argument is correct, then the entire case is only about the $120 million penalty to leave the ACC. Important argument.
Legal fees are very large, but a drop in a very large bucket involving tens of millions per year.
You are right. As was mentioned in the NC hearing, the issue is not disclosure to counsel. The issue is FSU’s counsel cannot consent to any protective order or partial disclosure because sunshine laws mandate full public disclosure.
Is this what the ACC is arguing? 1. FSU signed an agreement with ACC. We will show you that document. 2. ACC signed an agreement with ESPN. We do no have to show you that document.

The ACC is not being honest according to these two so to me that's a plus for FSU and Clemson. The ACC must feel that their case isn't "rock solid". Hope the ACC gets dragged around the courthouse. Bad Karma is catching up with the ACC. When FSU and Clemson and possibly UNC leave, it's the end of the ACC as a power conference which it isn't anyway but then it will be official. The ACC is so desperate that it had to add a B12 reject(SMU) and two leftovers from the Pac12 that no one else wanted. Hope Clemson and FSU join the SEC. SEC may not want a b10 foothold in the South.
I think FSU would want big because of the new deal and also research money.
I hope FSU goes to the SEC ,last time FSU let the administration make the choice to go to a conference based off academics we got stuck in the terrible ACC , let the sports department decide which conference we go to

Would you rather be South Carolina or Florida State? One has multiple championships and Heismans, the other has a jackass coach who wore a visor. FSU and Bobby Bowden made the right call in 1993
@@lifehoff No, FSU didn't "make the right call". If it had, then it wouldn't be publicly airing all this stuff to get out of that bad decision. A team that joins the ACC eventually regrets it as it leads to loss of athletic accomplishments. USC isn't involved in an expensive court battle in order to get out of "right call" and was passed over in the CFP exactly because of the decision to join the ACC rather than the SEC back in early 90s.

Yes, at the time of signing all parties involved had an understanding. Now, years have gone by, expectations have not been met, frustration has built, some parties have voiced concerns that have not and will not be addressed. In some cases deception has occurred, parties have not been totally forthcoming, other parties have been criticized, some feel unsupported. It takes a lot of frustration to choose legal action as the resolution and responding with inflexibility and incivility have ensued. I don’t see this as anything other than a bitter divorce where both parties try to seek an end and mitigate their liabilities.

Thanks for the note despite the rivalry! I'd enjoy the SEC too from a geographical standpoint. Also just feels more natural.

Can the judge at either court tell the ACC that not having a set exit fee for both exit and GOR is. It reasonable and threaten to void the GOR? They could use previous exit fees and current exit fees like SEC $30M exit fee with 24 months notice.
The judge cannot get involved in settlement talks
The acc constitution and bylaws only state an exit fee there is nothing about payment to buy out gor or that gor is any part of withdrawal fee.

I’m not sure I’ve seen this question posed, but can you answer this: what games do the ACC think they own? Is it FSU conference games against ACC opponents? Is it FSU conference games against any conference opponent? Because they don’t own the rights to our Florida game. They don’t own the rights to our south Alabama game!what rights do they think they own?
All ACC member’s home games. Even against non-conference opponents.
Only to home games broadcast by espn. If in big 10 by therory since big 10 is fox CBS no money would really go to acc

Honestly I don't blame the ACC for fighting tooth and nail to not let FSU go at least not easily because they are fighting for their life if they let us go then others will quickly follow and they will cease to exist
Rumor has it ESPN Won’t extend the contract in 2028 , so the ACC IS 💀 DEAD

almost every lawyer they bring on is an FSU fan or grad. Of course, they're going to argue anything that will look like FSU is in a favorable position.
