      Is not just Newsom is the entire corrupt California congress and Senate, they keep on coming up with incredible stupid laws that give the government more control and tax us more while giving benefits and money to illegals. I don't understand Californian voters, I know many of us are disenfranchised and no matter how we vote the left passes every resolution into law but how do we fix a system that seems to be rigged against us and keep the stupidest lawmakers in government? From Climate Change which has quadrupled our energy bills including gasoline, natural gas, electricity to water skyrocketing water cost, who is that benefiting? The $20 an hour minimum wage increase was another assnine decision, many fast food restaurants will go out of business or will lay off workers. Instead of creating new jobs that can pay well all solutions result in increased cost or higher taxation.

    What sucks ballz also is the fact that both cops and retired cops are EXEMPTED from having to pay this 11% tax. Even though I’m a retired cop myself and am exempt, I still regularly donate money to CRPA and FPC to help defeat this bullsiht law. It’s completely unfair and not right to any and all law abiding citizens.

    get gun and ammo manufacturers to stop selling guns and ammo to the government agencies in California. That would put pressure on the State cut out these nonsense laws. manufacturers need to stop selling products products to the State of California and city agencies... boycott California period..

      Oh the public voting for this wouldn't be any different. Look how Measure 114 in Oregon got passed. It was by voters. Mostly because the legislation misled the public on what it would do. Also, what you are suggesting is how a "Democracy" works. We are a "Republic". Voting a law in by majority vote of the public is not what we want.

    In Vandermyde v Cook County the court struck down a similar tax. The court said, "Although defendants rely upon Samuel Johnson’s dictionary and claim that “infringe” means to violate or destroy, they left out that Johnson’s definition was: “1. To violate; to break laws or contract. 2. to destroy; to hinder.”

    It should be DOA at the circuit court level. SCOTUS in Minneapolis Star v. Minnesota Commissioner of Revenue (1983), held: a targeted tax on paper and ink products violated the freedom of the press / First Amendment.

    As much as I appreciate groups such as CRPA and what they do, let’s be honest. Regardless of what lower level ( state or federal) courts/judges decide, the Federal 9th circuit will and has ceremoniously sided with the State in 98.9% of the firearm regulation lawsuits. This means, like the Miller, Duncan, Weiss, and many many more, these cases will be tied up in the court system for years and years. Duncan is a prime example!!!

    I bought a firearm from Bass Pro shop in June..... I picked up my firearm after my dumb 10 day background check cleared on July 4th. I still had to pay the 11% or $70 to pick up my firearm. What a JOKE!!!!!!!!! Even though I bought the firearm before the July 1 deadline...

    The Supreme Court already settled this type of taxation scheme in Murdock v Pennsylvania 1943 and in Minneapolis Star v Minnesota Commissioner 1983.

    The tax on firearms and ammunition is a Federal Tax on the Manufacturer.
    The Pittman-Robertson Wildlife Restoration Act (Pittman- Robertson; 16 U.S.C. §§669 et seq.), initially enacted in 1937 as the Federal Aid in Wildlife Restoration Act (50 Stat. 917), provides funding for states and territories to support wildlife restoration, conservation, and hunter education and safety programs.
    AFAIK, States cannot impose an additional Tax except for Sales Tax.

    In 1819, in the case of McCulloch v. State of Maryland et al., 4 Wheat. (17 U.S.) 316, 431, Chief Justice Marshall uttered the famous dictum, "the power to tax involves the power to destroy.” That has been repeated by the courts many times since then. To tax the purchase of firearms and ammunition, over and above the general sales tax on other merchandise will have the effect intended or not, to make it harder for individuals to exercise their rights under the Second Amendment. No one would think that an additional tax on speeches, peaceful assembly, or the exercise of a religion is valid as it would run afoul of the First Amendment, so why would the new tax be valid?

      Unfortunately, the answer is no. As a consumer you are not paying the tax directly. The firearms manufacturers will be paying the tax and they can write it off on their taxes. The FFL is the ones being screwed.

    The challenge in beating this law is that it is a tax on FFL selling the guns and ammo, not on the consumer. Only FFLs who do more than $5,000 in sales quarterly pay it, on their gross receipts for guns and ammo. This is a tax on the dealer, not the buyer.
    Similar tax laws, like the one in Illinois, were defeated because they were a tax on the “right” of the consumer. Selling guns/ammo is not a “right.”

      But the consumer is paying 11% extra. It may be a tax on the retailer but the retailer certainly isn't losing 11%. And a low-volume dealer can automatically beat the store price by that amount. The whole thing is asking for trouble. Oh, and some people are exempt. Imagine retired truck drivers not having to pay the tax on diesel fuel.

    What bothers me is not that the nuisance (and SO many others) don't have any idea what the 2nd Amendment is for; but that he sits behind multiple layers of armed security and works to render his "constituents" defenseless, in a state that is decriminalizing all kinds of violent, assaultive behavior. What's worse is that Ca will absolutely re-elect him.

    California has a lottery, nobody knows where the money is going, it sure as hell ain’t going to education like it was supposed to!!! California has the highest taxes on fuel, nobody seems to know where all this tax money is going??? It sure as hell ain’t going for road repairs!!! California legalized marijuana and other cannabis products !!! This should be another state revenue stream, but nobody seems to know where the taxes and money generated is going!!! Funny how you can only spend cash in these so called dispensary!!! I wonder why??? Here we go, another democrat tax that was passed and nobody will know where the money is going!!! An additional tax on guns and ammo sure won’t stop any crimes!!! Crooks don’t buy guns or ammo in stores!!! Y’all seeing a pattern here??? Keep voting Democrat; our corrupt or incompetent politicians are depending upon you!!! 🫤

    Any tax against a right is wrong we should not have any taxes on weapons or anything that is needed to make weapons .so more Americans can exercise their rights.

    God for CRPA…
    I read somewhere suits on this could not be made until October, because that was when dealers would do their first quarterly submission and nobody would be “damaged” and have standing to sue until then. But while the seller may remit in October, buyers are paying today, and are being forced to pay an extra tax to exercise a constitutional right. What’s next? Poll taxes on non-democrats?
