- In Calgary, domestic assault charges are handled by specialized prosecutors who only deal with domestic violence matters. Complainants recanting or indicating an unwillingness to proceed is a very common occurrence and the Crown view such occurrences with a critical eye.
In some cases, it is questionable whether or not the complainant truly wants to recant. The accused, family and/or friends may have utilized control tactics or threats to insist on the request. These are tactics that the Crown Prosecutor’s office is well aware of and as a result, rarely withdraw charges in such a situation.

I called the ambulance for my partner who has epilepsy and hit her head while fitting. Arrested few days later no contact order and phone seized. She never once accused me but apparently the hospital contacted the police just ‘to be safe’
My wife filed for an order of protection against me because I blocked her mother's phone number from calling my home phone. She called every day at random times for 22 years.
I received an order of protection and was removed from my home for 1 year.
The year is almost up.
What are the chances the judge/court will grant my wife's request to continue having me removed?
How come it seems to easy to get domestic assault charges dropped, but if I breached the curtilage when she was granted exclusive possession of the home, I am going to jail?

In California you can be charged with domestic violence using "disturbing the peace" even if there is no contact at all and even if there is no longer a relationship. If you at one time had a relationship, but no more, and you do anything at all that she finds to be upsetting then you can be charged with domestic violence. This is a violation of the 14th amendment and the void for vagueness doctrine and it is being challenged in the courts but for now it is still the law. If you do something that is not against the law for anyone else, but because of a past relationship, you can be charged, while nobody else could, just because she finds it upsetting to her. That is not equal protection under the law. Domestic violence now becomes whatever the judge thinks it is, which violates the void for vagueness doctrine.

I live in Wisconsin and I was charged with disorderly conduct with domestic assessments back in 2008 I was 23 yes old and now it’s been 13/14 yrs ago and I need serious help to get them back. My 2A rights are very important to me and so is not breaking the law. How would I ever be able to protect my family of someone with a gun broke into my home. It was my first offence to push my wife since were arguing back and forth but she claimed the way i pushed her got her scared thinking ill beat her and she called police and got charged with two criminal assaults for pushing her and causing stress ..but we are now in good ways again we have been married for 16yrs and we have 3 kids and j have appealed my case i dont know what steps to take but we have started some marriage counselling sessions with a professional and our Pastor on the other end and since this happened after we all had alcohol as the defendant i decided to get into one or two classes now ...so i need your help this was my first time in court i panicked

@@tequilaflores2570 hi man i appealed to the district at the district Court but currently im a suffering from PTSD having episodes of what really happened and yeah the magistrate was very harsh on me without hearing me out but i hope ill come out of it soon ( suicidal thoughts have crossed my mind a lot of times ) i feel sad all the time and knowing i was not a threat to my wife of 16 years it still breaks my heart and lack of sleep is a big factor now

@@tequilaflores2570 if you dont have a lawyer on your court date seek adjournment buy time to get a lawyer (this was my mistake i didnt do it because i thought it was a small matter and me and my wife wanted to move on with life so i pleaded guilty hoping the magistrate would be fair but 🤯 very harsh on me )
@Tequila Flores i have great news man my criminal charges were dropped 🙏🙏🙏😳 it was a nightmare for me but i got a good Lawyer who made good submissions on my behalf and the Judge was Linate on me and he asked me to have a 9months good behaviour thats it

@Allicat4 hey i believe if the witness is not willing to co-operate there is nothing the courts can do about it than to throw to case away especially if the Police dont have enough evidence

@@alyxms5826 my ex wanted to drop the charges. So the whole thing didn't have a strong case. All we did was argue anyways no abuse. But the government wanted something out of this. So the charges went from DV to disturbing the peace. And they couldn't charge me with $2000 price which came with the DV because my ex refused to help the prosecutor. My public defender said this whole thing is a joke. They still wanted to leech something off me so they put me in a 2 week anger management class and pay 1 year probation- no jail time. I still broke up with my ex even after she intended to get back with me. The whole police thing was unnecessary and a waste. I'm not even violent. But my ex at the time put us on the phone with her mom. Her mom heard us arguing and called the cops. I told the cops what happened and they determined I was the aggressor that's why I have this dumb disturbing the peace record. Better than DV but anything that shows up in your record looks bad. Especially when they don't know the real story.
Getting counseling says you did it , if you don't hit people why get counsel
Not really man … sometimes you wont know if you are mentally causing pain to someone until someone opens up you might not know# respect is when you take time to listen to someone else speak# and when the person is your partner its wise for both of you to seek counselling
A lot of people are falsely accused, you will need counseling if that’s the case as well.
