Hi McBean Immigration! My spouse was detained while crossing the border on 12/24/14 and was given a positive credible fear determination by an asylum officer and has been in removal proceedings ever since. He submitted an asylum application and the i797c shows a receipt date of 12/28/15. I’m a US Citizen and filed an i130 which was approved in 2017. He is requesting voluntary departure from IJ so that he can travel abroad to Honduras in September to attend his IR1 visa interview. Based on this info… does he need the I601/I601A waiver? I spent a year in the US helping my uncle's business, setting up his IT infrastructure, and doing the payroll for his employee's and what not. I got paid a reasonable amount, paid taxes, and didn't complain because what amazed me was the fact that I was NEVER without money. Back home, it's a constant struggle to make ends meets, and you're always juggling what will be paid, and what you have to do without. In the US, for that one year, I never had that problem and at first, I was like, ok what's going on here? I'm paying more taxes in the US out of my salary, and I have more money in my pocket?? Whaaat?? Nahh... Somebody pinch me. Yea, that pinch came really fast and it was time to go back home. My sister is an American citizen, and to apply for me will take so long. Unjustly long. Incredibly long. Too long. I hope that changes cause the struggle is real.
