    My name is Merlyn Nandiye. I won the DV Lottery 2021 and from Papua New Guinea 🇵🇬. My family and I are in the USA presently on F1 visa. Back in 2015 we entered the USA on a B1 visa and overstayed for 5 months. After our bar of 3 years of overstating, in 2019 they approved our F1 visa and we are in the usa school. All the adjustment of status process are done already including our interview. Yesterday we got letter that I overstayed and need to send in evidence/proof, and also the 601 form. Our visa number is going to expire this coming September 2021. We are concerned so please I need some advise from you. USCIS gave us only 30 days to do this....

    Can you provide me a bit of guidance please.
    My fiancé as a child, aunt tried to bring her to the US as her own kids, it failed! The aunt had completely change my fiancés name.
    After the aunt attempt was unsuccessful, my fiancé returned to her birth name that her parents originally gave her.
    In 2021, she went to the embassy for an interview after doing finger print. When she got to visa officer, he asked her about the previous name and she explained what had happened when was a minor.
    Yet her visa was denied on a 214b denial!
    Since the finger from what her aunt had attempted to do is in the USCIS system and now her original name as well.
    Will see need a waiver?
    Her previous denial did not say she needed a waiver but how do she prove that her name she currently carry is her real name but not what her aunt had changed when she was a minor?
    Please help!

    Can we file this kind of a waiver to expedite the interview process for initial entry for getting the Visa approved?
    I'm a dentist, and it would be absolutely impossible for me to find employment in Mexico. Obviously, having to leave my job would create severe economic hardship on the relationship.
    Additionally, there is extreme psychological hardship and strain on our marriage due to our ongoing separation.
    Please advise.

    So question if i601 wavier is approved for misrepresentation(inadmissibility) and got GC now when applying for citizenship would that be a problem ? Can they ask or investigate about it again or can be hurtful in anyways at the time of citizenship interview.

    I am just curious for level three psychological impact could I say something like depression and present my prior injection notices? And also for level one extreme medical conditions I found articles from the country stating that the medical care is terrible and I have diabetes, so could I say I wouldn’t be able to get my diabetes medication? Do you think that will suffice?

    Can you file waivers in the United States? Or do you have to leave to your home country? I have a 3 year bar due to illegal presence and a marijuana possession of 1 gram charge which I also need to waive. I just want to know whether I can file both waivers before leaving the us.

      you can file the 601A waiver while being in the US and of it gets approve you can move foward dont leave with out getting the waiver approve !

    Hi Jacob, seeking some urgent advice. Can form I-601 be used to get my mom into the USA for medical treatment? She was diagnosed with Lymphoma stage 3, and was on Chemo, but not able to get the immunotherapy. The immunotherapy is accessible here in the USA and without it she will not recover. Her condition has worsened due to not having this treatment, and not more lumps were found all over her body. Can this form be used for her or should I be using form I-131?

      I thought the 601 and 212 was to take away 10 or 5 years ban from the united states.
      i got deported in 2020 months before i was married. My interview is sept 6 and my lawyer told me that the officer will give me those waivers and told the process can take up to a year. I just hope I don't get denied

    Hi. Thank you for brief explanation. I am subject to 10 years bar. I left the US on January 2015, entered on 2005 on F1 students visa. Now, I live in Indonesia. my wife won DV Lottery 2022 and my wife as primary applicant. I am the derivative as well as my 6 years old daughter. Our interview's schedule probably june 2022. So the hardship is to my wife which is the upcoming US lawful permanent resident. My wife never travel abroad, know nothing about the US, no place to stay nor work. I have no criminal record, I am a restaurant server for whole 10 years, I paid my income tax, no drinking no drugs. Will my I 601 be approved? Thank you in advance

I Lived there for almost 30 years. I left the country back to Mexico 5 years ago As I was waiting for my Canadian passport. I have it now.. My question is what are the chances of me being denied entry to US or what’s the worst that could happen if they find out I used to live there?       I believe this will only affect you if you try to apply for a USA visa. My aunt is from canada. She has her Canadian citizenship and she’s able to travel to the USA with it. However, I believe you Can only stay 1 month in USA territory.

      We submitted the waiver and USCIS told us it was received April 4th 2022 that's all we know. I don't know if it's going to take the 11 or 12 months to get an answer or if that's how it is if we filed today compared to 4 months ago.

      We have not heard of any update. I check the website and processing times daily. All I can tell you is the processing time report says it decreased 3 months since I first posted here so we're at 13 months of waiting now, the processing time says 24.5 months as of today. A few months ago a different lawyer on RUclips said it would take 12 months so it seems we can get an answer any day or up to May 2024 I can't get an answer it's a frustrating waiting game.

    Very good video. My US B1B2 visa was denied 3 times from London Embassy on Pakistani Passport and 1 time from London Embassy on British Passport. Total 4 times denied. My sister lives in USA as US Citizen. I cannot travel on VWP as unauthorised. What options do I have. Can I apply waiver where I can travel on VWP British Passport. I had two arrests. One in 2005 simple caution. Second 2010 simple caution. No conviction at all and all clear on ACRO police certificate. Please advise. I am British Citizen since 2020.

    Excuse Me please, so if person come to United States, with the student visa legally (Russian)& stay because 911 happened. After student visa is expired and renew it to expensive. Person stay in USA illegally over 20 years. (Documentation only social security with no work permit and driver's license present) everything else,- lost or stolen. 🙏 any chances for the normal life??

      @@manuelibarra9076 of course. You get a receipt first, then a biometrics appointment, and then if they don’t require additional evidence, you get an approval notice. That approval notice is your guarantee that you won’t face any penalties when you return to the US. After is approved you go through consular process, and once your receive an interview date, you go back to your country for about 2-3 weeks and, if approved, you come back as a legal permanent resident.

      @@andrearazo828 No, because you need to submit the I-130 approval and pay the IV fees and submit proof they were paid with the I-601A application.

    What about if the waiver is due to your opposition of vaccines. I didn’t know I would have to mention how my spouse would suffer if I was denied.

    Hi iam agreen card holder and my daughter is us citizen she was born in usa my boyfriend he was in usa in 2018 in 2019 he travel to canada and start living there now he got acanadian citizen now he want to return back to usa but they banned him for 10 years because of ilegal crosing us canada border so ..... how he can ask awavier and ......what kind of waiver did he have to ask ?     Relocated From Administrative Appeals Office To
    USCIS Originating Office ?
    your Form 1601 Notice of Appeal or Motion, Receipt Number XXXYYYZZZZ, to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you."
    What does this mean? is it approved /denied/ USCIS will ask for additional evidence to approve ? Is there any time for USCIS to process this? Please help with your experience.

    Hello,
    Under what level would this be considered under?
    Us citizen daughter petitioning for mother. All of my mother’s 4 children are US citizens and reside in the US. Mother is alone in our home country.
    I’m unable to complete my degree due to not being able to work less hours in order for me to complete my program requirements( clinicals and unpaid internships). If my mom came here she would be able to assist me with that.
    Her sons are currently parents and they would really need help with child care.
    Where she is living is riddled with crime, she went to the stop and as soon as she walked out gunmen came in and killed everyone inside. Everyday is killing. My country is listed level 3 on the DO NOT travel advisory list. So she is scared and alone, she is getting older and has medical issues (thankfully not severe) but needs to be by her children.
    My older brother owns his own business so she will be taken care of financially. Once I’m finish with school she will be take. Care of .
    Do you think I can win my case with this reason

    Hi, I was deported back in 2004 for life (I think). I was a U.S. permanent resident and lived in the U.S. for nearly 30 years. I arrived in the U.S. with my parents in 1976. Currently I have been living in Mexico for the past 17 years. My whole family is in the U.S. My question is, what can I do to go back legally? I was convicted for an aggravated felony (not drugs nor sexual charges) and deported in 2004. What are the steps to start a process in getting back to the U.S. legally? Can I get a pardon? Or a permit to visit at least? I work as a Spanish/English Interpreter over the phone helping people all over the U.S.
    Please help. Thank you.

    You are wrong you can't adjust in the united States ONLY IF YOU ARE OUT OF STATUS WHEN MARRIEND TO A LEGAL PERMANENT RESIDENT only then you need a provisional waiver to go back to your country with to get interviewed for your greencard

      You are wrong. You can file i601 and adjust your status if you can prove extreme hardship. You don't have to leave. I601A is when you leave for your home country once it's approved.

    You can get married to a legal permanent resident and never have to go down to your country as long as its done after 90 days of entering the us and before the 6 month period is up that was given to use to visit so please stop misleading your clients or future clients
