We submitted the waiver and USCIS told us it was received April 4th 2022 that's all we know. I don't know if it's going to take the 11 or 12 months to get an answer or if that's how it is if we filed today compared to 4 months ago.
We have not heard of any update. I check the website and processing times daily. All I can tell you is the processing time report says it decreased 3 months since I first posted here so we're at 13 months of waiting now, the processing time says 24.5 months as of today. A few months ago a different lawyer on RUclips said it would take 12 months so it seems we can get an answer any day or up to May 2024 I can't get an answer it's a frustrating waiting game.

@@manuelibarra9076 of course. You get a receipt first, then a biometrics appointment, and then if they don’t require additional evidence, you get an approval notice. That approval notice is your guarantee that you won’t face any penalties when you return to the US. After is approved you go through consular process, and once your receive an interview date, you go back to your country for about 2-3 weeks and, if approved, you come back as a legal permanent resident.

You are wrong you can't adjust in the united States ONLY IF YOU ARE OUT OF STATUS WHEN MARRIEND TO A LEGAL PERMANENT RESIDENT only then you need a provisional waiver to go back to your country with to get interviewed for your greencard
You are wrong. You can file i601 and adjust your status if you can prove extreme hardship. You don't have to leave. I601A is when you leave for your home country once it's approved.

you can file the 601A waiver while being in the US and of it gets approve you can move foward dont leave with out getting the waiver approve !

Us citizen daughter petitioning for mother. All of my mother’s 4 children are US citizens and reside in the US. Mother is alone in our home country.
I’m unable to complete my degree due to not being able to work less hours in order for me to complete my program requirements( clinicals and unpaid internships). If my mom came here she would be able to assist me with that.
Her sons are currently parents and they would really need help with child care.
Where she is living is riddled with crime, she went to the stop and as soon as she walked out gunmen came in and killed everyone inside. Everyday is killing. My country is listed level 3 on the DO NOT travel advisory list. So she is scared and alone, she is getting older and has medical issues (thankfully not severe) but needs to be by her children.
My older brother owns his own business so she will be taken care of financially. Once I’m finish with school she will be take. Care of .

Now, I live in Indonesia. my wife won DV Lottery 2022 and my wife as primary applicant. I am the derivative as well as my 6 years old daughter. Our interview's schedule probably june 2022. Is the backlog with 601a going to decrease under Biden Administration or will it stay like this? It changed from 13 to 31 months since I filed. Is it better/faster to go back home and file 601 instead?

We submitted the waiver and USCIS told us it was received April 4th 2022 that's all we know. I don't know if it's going to take the 11 or 12 months to get an answer or if that's how it is if we filed today compared to 4 months ago.

We have not heard of any update. I check the website and processing times daily. All I can tell you is the processing time report says it decreased 3 months since I first posted here so we're at 13 months of waiting now, the processing time says 24.5 months as of today. A few months ago a different lawyer on RUclips said it would take 12 months so it seems we can get an answer any day or up to May 2024 I can't get an answer it's a frustrating waiting game.

@@manuelibarra9076 of course. You get a receipt first, then a biometrics appointment, and then if they don’t require additional evidence, you get an approval notice. That approval notice is your guarantee that you won’t face any penalties when you return to the US. After is approved you go through consular process, and once your receive an interview date, you go back to your country for about 2-3 weeks and, if approved, you come back as a legal permanent resident.

@@andrearazo828 No, because you need to submit the I-130 approval and pay the IV fees and submit proof they were paid with the I-601A application.

Hi, I was deported back in 2004 for life (I think). I was a U.S. permanent resident and lived in the U.S. for nearly 30 years. I arrived in the U.S. with my parents in 1976. Currently I have been living in Mexico for the past 17 years. My whole family is in the U.S. My question is, what can I do to go back legally? You are wrong you can't adjust in the united States ONLY IF YOU ARE OUT OF STATUS WHEN MARRIEND TO A LEGAL PERMANENT RESIDENT only then you need a provisional waiver to go back to your country with to get interviewed for your greencard
You are wrong. You can file i601 and adjust your status if you can prove extreme hardship. You don't have to leave. I601A is when you leave for your home country once it's approved.
