She cannot file 485. She needs to file 601 Waiver and then leave the country for consular processing.
The easiest way for her would’ve been VAWA or Form I-360

Hello ma'am. I am a student of j1 SWT. In my DS2019 form, it says that the 2-year rule is not applied, but they wrote that the rule applies when printing a visa on the passport. Estao dizendo que demora 22.5 meses
Mas quando fui na minha intrevista I officers consular me fez 2 perguntas e refused my visa e me deu ums Carta dizendo que eu nao soube responder a pergunta agora minha familia nao tem que Comer estao passando dificudade

@@MarceloPires-kb8qp , pelo que estou entendendo, o advogado que está cuidando do seu caso não tem muito entendimento em casos que precisam de um perdão para legalizar. E provavelmente não te orientou adequadamente para sua entrevista no consulado. O pior de tudo são seus negócios , sua vida e sua família estarem prejudicadas por ainda não ter conseguido retornar. Talvez seria interessante consultar um outro advogado de imigração especializado em waiver para te ajudar.
É sempre bom ter outra opinião.
