    Basically sound advice. However as regards buying a new property this road for a new buyer is very treacherous. It is important to use a solicitor who has no connection whatsoever with the developer estate agent (if any) and financial adviser/mortgage broker. A solicitor who is skilled in new build properties is also useful. Developers have persuaded buyers to change their solicitor when I have been acting for them because I have uncovered a defect - commonly contaminated ground that has not been cleared on a new site, not to proceed, to one on their panel. I have found latterly many solicitors are naive where fundamental elements of the law are concerned. Today I consider because of the somewhat incestuous relationships that can exist between estate agents financial advisers and solicitors never before has the “buyer beware” been more significant.
