  • The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

    my story is nearly exactly like maya’s. i have crps, went to the same exact hospital just a year or 2 later than her, and still had to fight really hard to get them to prescribe me ketamine to get me out of my quadriplegic state. thank god they didn’t seperate me from my family (likely bc they were already battling maya’s family) but i heard them talk negatively about me and my family. they also told me it was all in my head, and told me to get up and walk while i was paralyzed in a wheelchair, bc they didn’t believe me. i had to fight to get my meds. i then saw dr. hanna like maya and he saved my life. maya’s situation saved my families lives, but i wish none of her family had to go thru that. i thank maya so much for raising awareness about crps and for fighting so so bravely for the justice they deserve.

Seems to make these doctors feel good. Mind your own health. Seriously. Yes, I am sure you know more than a person who actually has the illness... 🙄

    The importance of this case is the public notice of how social workers and first responders DO NOT always or often have the best interest of the children. This is happening across the nation!

      My Daughter was in traction for 3 months for severe scoliosis from marfan syndrome. I slept beside her every night and called the hospital home for the entire time. The thought of being separated from her during this time like 'Maya' was makes me feel physically sick!

      It’s very sad but Mayas mother was misled by a quack. Who would allow their child to be put in a drug induced coma and kept on potentially deadly doses of ketamine and other dangerous drugs. Since the mother tragically ended her life and the Ketamine stopped Maya began to walk and has continue to improve ever since. Look at her. She’s a beautiful girl who appears healthy. Her mother didn’t want her better. She wanted her tranquilized. The mother was clearly mentally ill and behaving irrationally.

      @mandystrong8196 That is hard to argue that he was a quack, he has over 40years experience and is an MD, and anesthesiologist. His area of specialty was pain, he dedicated 20yrs to south Florida University understanding pain, If you have children, have they ever been under anesthesia, have you been put under anesthesia? Did you trust those Drs? Beata did with her daughter, he was a pain specialist plus an anesthesiologist. As a mother myself I cannot judge what I would do and not do for my daughter in debilitating pain. She would scream all night and day in agonizing pain.
      His treatment of Ketamine is no different than a hospital giving it to a patient. I do not think she was a bad mom by any means. Just a desperate mom to find answers that nobody could give her at the time.
      The family has already won one lawsuit proving that she wanted her daughter better and the Drs were wrong in their judgment.

    My mom was diagnosed with CRPS. It took roughly 5 years to even get the diagnosis and she’s been on ketamine treatments for 14 years as of Sept 24th. It may seem like a simple arm hold doesnt hurt, however for someone who has CRPS, its excruciating. This documentary is so important and I hope Maya and her family win and are taking care of themselves.

      @@ambermcvay6844 100% I have thoracic outlet syndrome. Something as simple as holding hands sets my symptoms off. You learn to function at a higher level of pain and THROUGH pain after being forced to because people who think they can’t see it means it doesn’t hurt.
      Just because you look okay does not mean the pain is not there.

      Sounds reasonable to me given the fact that for some reason the mother felt that her daughter should be taking an incredible amount of ketamine in spite being told that these treatments had a 50 percent chance of death.

      ​@@PEBBLEZ21 But that's the same as calling a cancer patient "Chemo girl" because she keeps getting cancer and requiring chemo and then acting like it some derogatory slight. It's absolutely rude to call her that. If they wouldn't call a young female chronic cancer patient "Chemo girl" it makes no sense they would refer to Maya in such a derogatory fashion simply because her case is more severe than others (especially when they forced her to suffer for so long because they didn't believe her or her previous healthcare team. Again, imagine denying a young girl chemotherapy because you think she is faking cancer and then refusing to talk to the oncologist who diagnosed that girl with cancer and then mocking her behind her back at how bad she fakes cancer).

      Dr Sally Smith and Cathy Bedy were both under Suncoast. Settlement was $2.5M from reports I’ve seen/read.

    I can’t wait to hear all the evidence in this case! I work in healthcare and everyone who does takes an oath to do no harm. I started researching this case when I first heard about it, and I was actually surprised that this isn’t the first or last case of the hospital treating families this way. The lawyers for J. H. is going to have to work a miracle because the emails and messages between the hospital staff is very damaging, IMO!
    I hope the attorneys for the plaintiffs will have credible witnesses to explain the treatment for CRPS that their client was going through. Because those not in the medical field could have a harder time understanding that all kinds of medications are used for various off label treatment. And there are many treatments for different illnesses that are successful being used in other countries that aren’t available in the United States. Just because they aren’t used in the United States doesn’t mean the treatments don’t work.

      I just retired from my hospital last year, after 45 yrs of nursing. I also, by the way, have RSD, now called CRPS, & have for 40+ yrs. This whole story makes me sick, and has for a long time. I was following it before I heard of the Netflix doc. Those emails, there is no way to defend their way out if that!

      I agree! The text messages were awful. One Dr. Said "Ketamine mom died." then said something like her assumption was right. The dr. that responded to her said it was sad and felt bad.

      That is why so many people have decided the trial is only necessary to get the money....minds are made up that the hospital should have just written a cheque...swayed by a TV show. It has taken years to get this trial to court, and the hospital is fighting this, for a very good reason, they do not accept the accusation that they caused the mother's death, by misdiagnosing Maya or reporting their concerns to the Child Protection Service. Many miss the point that the mother killed herself in her home so her husband & son would find her. Hung herself...could not be more dramatic or cruel. Their lawyer said in his opening statement that an expert with show the Mother was not mentally ill. Her actions belie that statement.

      @@GRMLS5Agree. My father hung himself. The problems came from inside himself and the hanging was cruel to those left behind. I don't think Maya's mother was a hero in her fight to get her daughter life threatening drugs or in her death by her own hand.

    My heart absolutely breaks for Maya and her family. This Netflix documentary was incredible and could open up a lot of people’s eyes to disabilities and medical conditions that you can’t always see. As a nurse, I applaud Beata for all that she did to advocate for Maya and only giving up when she couldn’t take the insane allegations anymore. I pray for the Kowalski’s throughout this trial and I hope they are able to find some peace and comfort at the end of all of this.

    It’s astonishing that this hospital doubled down on their actions and let this go to trial. This happens far more than many are aware of. The fact that they billed over 500k for the diagnosis they took Maya away for is disturbing and infuriating.
    The despair Beata felt is unimaginable. Justice for Beata and family.

Yes the drugs were extreme and maybe there could have been a better way to treat her…but how is it the parents fault for doing what the doctor prescribed.       This is exactly what I was thinking. This needed to be much more clear and structured. Too much meandering. Hopefully the witnesses will be very strong. I watched the NF documentary and it did a far better job of outlining all of the facts.

    My heart goes out to Maya and her family.
    I suffer from this condition. Complex Pain Syndrome. It took 4 long years for a proper diagnosis that all of my doctors missed. Finally, a UCI neurologist ran a series of tests and found severe nerve damage in my left leg.
    In 1995 I had an accident that forever changed my life. 😢

Anyone who knows me, knows that by the time I ask for help, I have done everything under the sun to help myself from yoga, pilates, self hypnosis, otc, topicals, heat, ice, tens, etc

      It's heartbreaking to watch.
      I was told l had Parkinson's and treated for a year. Then sent to a hospital in London for a week l didn't have Parkinson's l had FND a software problem to the brain.
      It's a difficult condition to treat.
      You are just written off and made to feel you are a fake.
      The medical professionals think they are God's and know it all and are not compassionate.
      I hope this family gets the answers they are seeking. ❤

    It's sad that it took the netflix doco to blow up for this family to finally be granted a fair trial. But I'm glad that this beautiful family finally get a trial and a chance. The whole case is so heartbreaking and shows how much both her parents loved their children. Maya's mother stood up for her daughter and just wanted the best treatment for her, as a loving and caring mother would. It's so sad that it came to this tragedy for the doctors and social workers to believe her parents and Maya. Rip Beata

    This had been happening for years. It's so sad and noone should ever have this happen to them. How incredibly isolating for the mother. The medical staff and even law enforcement had zero problem pinning this all on her and even pin her own family against her, that's horrific. May God have mercy on their soul

      Beats was so beaten down and depressed she felt eliminating herself was the only answer for getting Maya out of the hospital. Even her own husband thought she was being too pushy in her fight for her child's best interests!

      Any good mother will do absolutely anything for their child, go to the ends of the earth, including Mexico, and fight like a Grizzly to protect her child! Beata was a nurse, so with that knowledge, and everything she’d already gone through trying to find some relief for her daughter, combined with months of listening to her baby girl screaming in pain day and night, absolutely made Beata come off as aggressive towards her daughters care, because she’d seen it work so well before! Regardless, if the Ketamine treatment is safe, or not, she believed what she was told by a very reputable Physician, and had seen it completely change her daughters life for the better, so I’m not debating that. I’m just saying that there’s no love as strong as a mother’s love! And there’s a big difference between a mother’s love and a mother being crazy! I’ve seen people in the comments call Beata mentally ill and etc! Those are just the types of people that put her in her grave!

    I did medical malpractice work my entire career. Maya and her family have a strong case. Her attorney is giving a weak opening statement. I hope he is stronger over time. I have not yet heard the defense attorney give his opening statement.

      She already testified she was under instruction from risk assessment who were directed by DCF.. Maya was removed from her parents custody so they did not need consultation nor was their permission required for the pics. DCF usually take photos when a child is being moved to another location to ensure evidence of their physical condition is recorded. That day they were unable to send someone to take them so asked that the hospital have it done.

      yeah i was surprised because the trial kept getting pushed back so you would think he would have had EXTRA time to prepare his speech… saying “i think” multiple times after presenting points in the case is not good… you shouldn’t have to “think” you should just “know” the details of the case by now..
      also, constantly mixing up Beata and Maya’s names… good lord…

    I'm so sorry for you and your family's loss. I was diagnosed with crps in 2019 after a work injury in 2018. I have had my own battles with my previous place of work and workers comp . I'm so sorry for what you have all been through, and I hope you get the justice you all deserve. My heart goes out to you and your family .     As a master social worker working at a children’s hospital, I find the way CPS handled this patient and her family incredulous! From the CPS type cop I find she and her power grabbing ego made this hospitalisation (s) into something totally unnecessary and the continued piling on was aided by this social worker taking a stand and making sure the nurses on Maya floor were complicit in not presenting this to hospital administrator and/or attorney.
    I also have CRPS (RSD REFLEX SYMPATHETIC DYSTROPHY…older term that IMHO should never have been changed as RSD is clear by name of health issues explains well what the person is dealing with.
    My heart is out to this family. The person in charge that ruined this family should at least never practice with children for rest of life.
    The fact that the diagnosing doctor who caught this first should have been taken as a qualified provider who actually works with those who have RSD/CRPS.
    what they did to this family is unrecoverable!
    Is there reason this head offender isn’t named as a solo defendant?!

      Thank you!! I thought I may be the only one who feels the family’s lawyer is terrible! Did they have any fundraisers for legal expenses? This lawyer is monotone and as he talks he comes across as disinterested! He shuffles papers and reads off them with no emotion at all. A lot of cases come down to the lawyers personality. So I pray the family has great witnesses and clear evidence because this lawyer is putting everybody to sleep!

    Imo this young lady & her family will win. Especially if anyone on that jury panel has ever been in the hospital alone. Never at no time are there 3 nurses smiling taking photos in a patients room just for f sakes. Like Maya said she had to use the bathroom on herself at times cuz they didn’t want to help her. All those nurses who helped carry out this wickedness should be individually sued as well. Like not one of them just maybe considered Maya being in pain? Sad to know that this is a epidemic in the USA. All doctors believe they know your body better than you. Tell you what hurts & how much it hurts. It’s insane that it goes on more than ppl know. Especially if you have nobody. You get treated badly. Ive been treated by by er nurses at different hospitals in my city. I find that a lot of nurses just become nurses for employment. Not cuz they actually care. Seems like these indifferent people are in high positions. That John hop psycho lady she needs her badge snatched off dined & thrown in jail.

      And she has improved and functioned much better since the hospital intervention and not on ketamine. The ketamine was not working. If it was controlling her pain it was destroying her other functional abilities. She was wheel chair bound, atrophied, malnourished, not able to perform ADLs, wearing briefs, she presented to ED in severe pain, and so on..

      Continue watching because from Maya’s own testimony, she worked her hardest to get stronger and better. She blames herself for her mom’s death. She was trying everything to never go back to the hospital because of fear. The ketamine helped her!

    I was diagnosed with stage, four RSD 24 years ago and the pain is so excruciating that there are times when I wish I was dead. It took 16 doctors to diagnose what I had and not one. American doctor knew what it was but doctors that went to medical school, and their countries knew what it was. Nothing helps. no matter what they do or give me nothing helps. Ketamine did not help. Now they’re going to have to put another door so calm stimulator to see if that works. The pain is over 85% of my body and I don’t even feel like a living person. Mine began as a victim of a crime.. Doctors used to tell me it was all men mental, doctors tell me that it doesn’t spread, and that I was lying about it, etc. I felt like I was the only person at this level until Maya, the documentary came out on Netflix, and for the first time I felt there was somebody else out there that understood what I have. I am now 64 years old, a man that is now being treated like a little child, because I cannot do anything for myself hardly.

Too many, unnecessary, trauma filled events from people of authority and everyday people that are nosey, on a power trip, mean, and just want to control people.     I saw the Netflix documentary and it made me sick. So many people should be held accountable not just the Hospital. It's hard to believe this happened in the USA. I pray for the Kowalski family and hope they get the justice they deserve. Unfortunately that won't bring Beata back. It really seems criminal charges should be brought against some of the people that allowed this to take place.

    After the many reports of horrible behavior by doctors and emergency medical personnel during the recent international widespread illness (cannot be named on this platform), reported by nurses who witnessed these things, many people have become very distrustful of the medical community. I know I go to the doctor far, far less. And I don't automatically take the doctor's prescription or diagnosis as fact. My friend underwent heart valve surgery without anesthesia because some medical person took her drugs for their habit, and she felt very step of the operation. When she tried to talk to her doctor about it, he gave her vague answers to protect himself and the hospital. I know there are trustworthy doctors, but how do you find them? Maya's (Beata's) story just reinforces how I feel.

      @@SlothLoveChunk14 She had a valve repair. And yes, she felt everything. They didn't open up her chest. It was less invasive, but during the surgery, she kept complaining and the doctor was yelling, "Where is the anesthesiologist? My patient is feeling pain."

      I have it & I don't call it either. 😂 I've had well past 40 yrs, & back then, it was only called RSD, Reflex Sympathetic Dystrophy. I was in the clinical trials of doing Radical Sympathetomies for treatment of RSD (CRPS). For all of us that have it, or for me at least, the goal is to just be able to manage a life, and not do anything that might exacerbate things and go into a full blown RSD cycle.

      The terminology for the disorder has changed over time. As more people have been diagnosed and treated neurologists have refined and updated treatment approaches. The name for the disorder has also changed. At one time fibromyalgia was not recognized as a "real" disorder, among others.

    Sounds like this mom knew what her daughter needed and she was a health professional too. Some doctors/nurses get offended when you try to ask for what you know you need. Like they’re god and don’t tell them what to do.

    I don't know much about the case for now, but I think the lawyer for the hospital did quite a good job in the opening. May not be a very popular opinion.

    Nothing in this entire world will ever be able to erase the pain those two baby’s feel knowing their mommy killed herself because of this hospital, there is a chance they will never be able to find peace. Dr sally smith & cathi are the most despicable woman & all the staff working at that hospital.
    There is absolutely nothing that will reverse this trauma & ache that keeps this family up at night. The only thing keeping them going is the divine presence of the mom. This is sick & I’ve never seen a case touch my heart in such a way.

    My son was accused by a neighbor he had a minor conflict with, you would not believe what he and his wife went through. My daughter-in-law was so distraught she almost fled, it was insane

    It’s sad that’s malpractice is hard to win with so much proof drs nurses and hospitals need to be held responsible for any unprofessionalism or harm in any way!! Drs need to stop and start believing in their patients !!!

    It’s interesting that ketamine is/was such a controversial treatment. I’ve read that’s it effective at treating resistant depression prior to even hearing about this case, so for why is it so outrageous for severe pain. It’s also a schedule III non-narcotic, but has been referenced as a narcotic.

      yes a lot of people are using Ketamine treatment for bipolar disorder, anxiety etc. obviously it’s monitored etc . i watch the doc last night and let me tell you it really opened my eyes to how common medical kidnapping is etc. the fact her mother felt she had to take her own life for her baby to be safe is outrageous and than the hospital bills for the condition they said didn’t exist. this family deserves every cent they are suing for unfortunately it will not bring her mother back but it will help them get back in their feet

      The problem is that it was a novel treatment for this disorder at the time and the dosage for treatment is very high. The jh doctors made assumptions based on the dosage, it seems.

    Just want to add how inhumane and dysfunctional our justice system is. We should have the best in the world and instead we end up harming and damaging victims even more. Congrats America for not even attempting to overhaul this congested mess.

Their medical doctor was fully involved and it was their choice to choose the route they did. Their daughter's condition had improved. It's not your call how they chose to treat their daughter. She was loved and cared for. The system killed that mother and emotionally, financially ruined hundreds of others. Grow a heart ffs.

    Wishing Maya and her family total justice.. I hope they receive every bit of compensation..nothing will bring her mum back or restore the injustice that the ‘Goliath’ mentality of social worker and hospital did .. but dad and brother and Maya deserve every bit of it… I hope they bring them to their knees .. full blown apology and admitting the wrong doing they bestowed on this family .. what a hero Maya and her family are 🫶❤️🫶

    I have been watching this trial off and on for a few weeks. Just watched the Netflix video. Now have so many questions. Have to go back to day one and watch the WHOLE trial. So sad if all is right in the documentary.

      Once you watch the documentary, you'll understand that it is a huge uphill battle for the defense.

    Ketamine is not fda approved for the treatment of crps yet. Which is why most people with it cant get the treatment because its so expensive! Without it being recognized as a treatment for crps, insurance will not pay for it. Sorry for all of the comments but i have CRPS so this really hits home for me. 😢

      @@PEBBLEZ21 there are dangers to every pharmaceutical. Ketamine has given many their quality of life back that suffer from crps. When you have CRPS you're willing to try anything to not be in pain. It does work for many.
