  • What happens if USCIS accuses me of fraud? A client came in to see us this morning because USCIS accused his marriage-based case of fraud. There are a lot of potential consequences with a fraud finding or even a fraud allegation. Immigration fraud is considered a federal crime.
    That being said, you need to take it very seriously. Even if you're giving up on the case, you're going to want to hire an attorney to appeal the finding in the case you ever want to try again down the line.     Immigration fraud is not a word any immigrant in this country wants to hear and once that word is thrown out, in my opinion the "Do It Yourself" ship has sailed and it is time to call in the heavy artillery of a competent immigration attorney.

    Would if you're accused of fraud when there is more than likely enough evidence to prove a bonafide marriage? Tha'ts the horribble situation that I'm in. I pray to God the embassy approves. I've been to Lagos six times to see my amazing husband, step kids, other family members. I love being with them. It's so hard to be apart like this. I even got affidivats of four witnesses. Pictures, communicaion, etc. My husband and I even traveled to Abuja together by plane. In AP for almost 60 days. Just had a stokes interview last week. Like why? Ive never in my life been in trouble with the law. Like I even worked for the Dept of Defense and had a low security clearance. Now, work for the sherriffs office. My husband police record came back clean. Like I have no idea why this is going on. CEAC date has been changed three times but still says refused. All of our documents are legal, true and authenthic. Just don't understand. I feel picked on. They can't say fraud when a divorce decree is real, online and done at the court. Just so upset.

    What if my husband’s ex wife lied and told USCIS that he married her for immigration benefits, even though he never was able to apply for immigration benefits while they were together? Now we received a NOID based on their previous marriage and asked to prove that THAT marriage was bonaFide??? What can we do?

    Hello,I has a fraud case with uscis and i need your help. I entered USA with DV .Before entering i went for interview which I denied my son. When i became citizen ,i filed for my son and the uscis wrote me a letter that I committed a fraud.

    Hello
    My father USA citizen and he applied for me as unmarried son and I got my green card as unmarried
    When I applied for my N 400 i mention
    That I was married before I got my green card so after long processed
    They denied my N400 because of that
    My question is there any risk my
    Green card
    And is there any way to apply again
    For naturalization citizenship.

    Can one get a green card after having a lawyer like you fight for them, let’s say they went before the immigration judge, can he grant them a green card after a lawyer proves otherwise?

    What happens If petitioner is the one who accuses you of marriage fraud because you cheated on them? (Relationship was broken and we both had other partners) If they are accusing fraud to be vengeful because they want to ruin the chances to ever get a green card. What can be done ?

    So does USCIS provide what evidence they have towards the application which is fraud?? In your years of working, how serious have those cases been with fraud?

      I've been trying to get my wife to the US for since Obama was president! I'm a US citizen and this is a broken and a system that criminalizes people of color just like some other law enforcement agencies! Canada treats and citizens way better than the US,...If I move to Canada will I need to start all over? If I get Canadian residency can I move my family there???

      They're not specific! After a denial for a fiance visa we got married and that two was denied at the embassy, they then rescheduled us for another interview in May of last year then the pandemic! Our immigration journey started in 2016 and now we have a daughter, I've lost my eyesight of 90% and I'm disabled and have to fly back and forth to Ethiopia and stagger around because of the poor infrastructure. It's humiliating and disrespectful to accuse me a model citizen of fraud rather the fraud is on their behalf!

      @@truthtruth9745 A denial can be either due to fraudulent marriage or not enough evidence to support a marriage. Sometimes a persons background check is not clean. However you would be given a reason for denial. You have a right to appeal their decision also. I have a friend who has been trying go get her Husband here from Nigeria and he has been denies visas too. So clearly they discriminate against certain countries. However you do have the right to ask for the reason for the denial. USCIS is taking so long to go through applications. It took them 2 years to send me a green card and when it arrived, they had the wrong name on the card. I sent it back the same day for them to change the name. They sent me a new card exactly after 1 year. Thats when I knew this is going to be a slow long process. It is very expensive to keep filing these forms and to go back and forth to their office for fingerprints.

    Just an observation. I am not an attorney; I'm just an observer. However, it appears that the main concern of those accused of marriage fraud isn't the health and welfare of their spouse, or mate. It appears that their overall concern is whether, or not, they can stay in our country. This makes one wonder what their motive for coming here is.

    What if my ex-husband and I divorced 6 months ago? He got his greencard and frauded me. He got called in for interviews. Now he's trying to get married. They are investigating them now. What is USCIS going to decide?

    I want to thank you for all your help. you have so much knowledge.
    I hope you can help me I have a question, I went for my citizenship interview and they gave me a paper saying that my application has been recommended for approval but it also says that IF final approval.... does that means they will review my paper work and my interview and make a decision?
    I am very nervous not knowing if they will request for more paper work and that’s why they didn’t say that it was a the final approval ☹️😩

    My wife was previous engaged to my brother. He filed i-129 for her. They had problems woth their relationship and when she went to the interview she purposely didnt answer any questions. Now she is married to me same-sex marriage for 7 years already. Uscis said is committed fraud in her previous i-129. Can she ever overcome 204(c)?

      @@kamelody7285 most immigration lawyers are thieves. They want to take every penny from these foreigners cause of lock of knowledge of the law. It's hard to find a lawyer that would take the case of someone who been used by a foreigner for green card cause it takes too long and too complicated. In addition to that that's not what they stand for. Immigration lawyers prey on the immigrants to make millones.

      Attorneys can DO that. They find the case to be a 'lost cause' and there's NO way around it. They know they're going to lose but went with the proceedings anyway. They get PAID whether the case wins or lose.
