My wife was previous engaged to my brother. He filed i-129 for her. They had problems woth their relationship and when she went to the interview she purposely didnt answer any questions. Now she is married to me same-sex marriage for 7 years already. Uscis said is committed fraud in her previous i-129. Can she ever overcome 204(c)?

I dont know how naive are you. I know of 4 case that are of marriage fraud, irs fraud, naturalization fraud and other charges. The reason this happens is immigration officers err on the side of caution and lack of knowledge of individuals cultural background, and approve of I130 petitions.I am talking about asians specifically Nepalis, a lot of them are granted DV, TPS even though they are declared communists or criminals. I just notified USCIS tip line with specific details recently.
So they can get a waiver if they are the biological parent of a child born in the U.S. to a U.S citizen? I thought that was only applicable to women. Very interesting...
