Here is the thing- apart from all the other aspects of the Post Office scandal the role of Lord Neuberger in the Recusal seems to have escaped attention.
I have therefore pasted the following ‘The role of Lord Neuberger in the recusal fiasco (Justice Fraser) should be investigated’ on as many RUclips articles as I could, about ten, but when I checked to see if there was any response I discovered they had all been taken down This Kafkaesque episode staggers one at every turn, even when Big brother has been outed he seems to be still working away!
I really want to know why Lord Neuberger interfered , if the recusal had succeeded the whole noble attempt at taking on the stinking system would have failed

If you refer a case to the European Union court, are you still the supreme court?

Yes. It's a matter of jurisdictions.

The UK has stated, post-Brexit, it will still adhere to the ECJ rulings and judgements.

I'm sorry if you missed the play on words. If you are "supreme", by definition, there is nothing higher than you are. So the UK "supreme" court is not, in fact, supreme. Prior to entering the EU, if was not an inferior court.

      girandole
      Ex Rothschild employee.
      Brother-in-law to Rabbi Neuberger.
Involved in the inquiry into 'widening access to the bar', meaning encouraging immigrant communities to access and practice as barristers and judges in the UK higher courts.
Do you think he's committed to the multicultural 'diversity' project?

Judges do not "lead the law". Judges are like referees. Referees do not make the rules. They merely enforce the rules as they exist. Imagine referees in any particular game deciding mid-game that the rules are not fair or do not yield the desired outcome. That biases the outcome and leads to chaos. The rules change independent of the referees. So it must be with judges. They must enforce the rules as they exist and the legislative branch of government makes changes to the laws.

This is simply not true in practice. There are plenty of cases involved judge-made law as their interpretation of the law can diverge substantially from what a literal interpretation of statute would be. Not to mention situations where entirely different directions are taken by judges and later enshrined in legislation.

UK judges aren't elected, they're appointed, and not by the general public. We don't play political football with our legal system like the US does.
