Her first point makes no sense. How are the family's feelings relevant to this at all? If she's innocent she needs to be released and compensated immediately. The families being upset that they got the wrong person is a separate matter entirely.

I personally think that Letby is guilty, but if there is cause for probable doubt then it should certainly be investigated. The feelings of the victims' families are beside the point. Letby too has a family after all.

I think most of her accusers genuinely believe what they say. The problem is that more and more problems are emerging re the way the prosecution assembled its evidence. Regarding the table they actually created the evidence. Lucy Letby didn't or couldn't afford to hire statisticians to create her own table but every statistician I've seen says the prosecution table is fatally flawed. Has a single statistician come forward so far to say the stats are impeccable and this is a fuss over nothing? I haven't seen one, they've all said the exact opposite so far.
As with Bristol some years ago, the condition of the little children was such that the statistical analysis was close to meaningless. There are circumstances where whatever one does tragedy and sadness occurs. Life is like that at the margins.

I work in the NHS and regularly see incidents brushed under the rug. Many patients don't even know when they've had something bad and avoidable happen to them. The culture of cover up must change. Letby was used as a scapegoat.
The NHS is a chronically corrupt monolith with no accountability It is not fit for purpose and cannot change. The rot is too deep to reform. It needs replaced with a system of social insurance, like the successful model in France. The only party willing to tackle this is Reform.

In the Netherlands we had a famous case of a nurse being convicted for the same thing. She spent a long time in prison. She was innocent. The state secretary of justice has apologised to her.
@@allanwilson664 No two cases are the same. Many cases are similar. This one certainly was, including ‘evidence’ from her diary where she wrote something like “I’ve done it again, I shouldn’t have” and of course the police took that to mean she was writing about killing babies. She wasn’t.

There are lots of genuine concerns about this case - 1. Cherry picking of statistics which did not include deaths when Lucy was not present - the jury were duped into believing that Lucy was present at all the baby deaths which is far from true. Statisticians are united in challenging the data the Prosecution presented to the court. 2. Medical experts have spoken up and explained there is no evidence that the babies died from an air embolism. Professor Michael Hall and other neonatal medical experts have seriously questioned this as the cause of death. Yet air embolism was presented as a real cause of death during the trial - again misleading the jury. 3. Reports have come to light showing an outbreak of bacterial infection during the spike of deaths (2015-16). Premature babies, many with open lines would be highly vulnerable to such an infection. 4. Dr Jayaram's evidence has been shown to be incorrect. He testified that he 'virtually caught Lucy Letby red handed' standing over a baby with a dislodged tube. However, door swipe scans now show that at the time Dr J accused Letby of this there was another nurse also in the room. Dr J testified that Letby was alone, but clear evidence shows that she was not. 5. In Lucy's own journal she said 'Why me, I haven't done anything', but this and other innocent sounding comments were ignored by the media. 6. Strangely, no medical experts were called to testify for the defence. So the prosecution went unchallenged on the questionable medical facts they presented to the court.
Regardless of whether Letby is innocent or not, there are SEVERE flaws in the criminal justice procedure. It's been obvious for decades and nothing has been done to fix it. The Judges are not impartial as they should be and equal representation is not given.
Mr Davis is one of the architects of brexit. He was useless, I wouldn't pay too much attention to his opinion on this. He is no expert on medical matters.

Yes and the statistical evidence was possibly misrepresented by the prosecution. Her barrister seemingly didn't try very hard to defend her in court. She may be guilty, but it's clearly not 'beyond all reasonable doubt'.

Wow, you're only realizing we don't live in a free or fair society now? Men have been getting wrongly convicted and thrown under the bus by a corrupt legal system and society for centuries but there's only a public outcry whenever there's a suggestion some woman may perhaps have been "wrongly convicted".
In the Netherlands there was a similar case with Lucia de B. , a nurse who was present at work when 7 unexplainable deaths occurred. She was sentenced to life in prison and tbs (mental teatment to avoid a release). She was convicted on statistics among other things. It was one of the big miscarriages of justice in the Netherlands and she was released and rehabilitated.
As soon as this case came up - there were interviews from around the world highlighting where historically the nurse had been wrongly convicted.. Well done Sir David for raising these questions

I am quite suspicious of the doctor who run the ward. I work in NHS and senior nurses and doctors always blame lower rank professionals. Doctors and Senior Nurses never ever take any responsibility of wrong doing. I saw this behaviour many times.
I am a nurse and take it from me, doctors always make mistakes and us nurses take the flack! also bullying is on every ward. If your face don't fit or you're quiet then you will be bullied. I agree with this one. I worked on a ward where I saw 2 qualified nurses forge a blood pressure reading. They made it up because they were pushed for time. I wouldn't have been believed I I told someone, because the ward sister didn't like me and I was indirectly bullied because I was quiet.

Several did die while she was not on duty. It seems that this was not communicated to the jury at the original trial. One problem with the conviction. Guardia article last month details many doctors who have now come forward to directly state their concerns. That said, I'm not yet ready to believe she is innocent, as her writings and behaviour in the trial were very odd.

If they want to discuss something as serious as potentially the most serious miscarriage of justice ever they (meaning she) should stop interrupting Mr Davis. Infuriating to watch. Everyone has an opinion on this, but anyone who comments should really look into the case so they have a more informed view. I dont believe she is guilty beyond ALL reasonable doubt.

Writing notes saying 'I killed them' after loads of babies die whenever you're on shift has a stronger effect though... If people can't see Letby's guilt, they simply haven't looked into the case. She kept mementos from every baby she killed in a shoebox in her bedroom!
I am not too knowledgeable about this Letby case.... is the evidence clear that someone has tampered with medical equipment and killed many babies, or could it be that the medical equipment was faulty and the unit was understaffed? as I say, I have not been following the case.
As a nurse in the NHS I doubt she could afford a robust defence out of her own pocket. Probably the court appointed lawyers who had.what appeared to be a multiple child murderer on their hands. If they themselves didn't believe she was innocent, or even just that they couldn't win, they may not have been playing their A game...
The deaths were accounted for. Atopsies said natural causes but then the police, who exist to uncover and solve crimes ,became involved along with a discredited "expert".Why did this happen ? Examine some of the recent articles on the subject

Nah, I don't buy it. I saw the interview with the doctor that raised the red flag. It seems like there were genuine concerns about her. Definitely NOT bullying.
I sat on juries for over 2 weeks some years back and it's very strange what is submitted as evidence and what isnt. For instance a case of a girl charged with being involved in the robbery of a taxi driver. She had got the taxi to stop outside some flats to pick something up. She got back in the car and this guy turned up and robbed the taxi driver (he was never identified). Prosecution claimed when the driver tried to drive off she stabbed him in his key hand to stop him. We the jury asked the court a simple question. Did the taxi driver have injuries to his hand. Response was that has not been entered as evidence so we can't tell you. Therefore we had no option than to find her not guilty. The injury to his hand would have convinced us guilty but not submitted as evidence by either side. That alone was sufficient doubt. So a jury trial is not necessarily about who is telling the truth and more about who are the better of worse lawyers .
As retired Registered Nurse (male btw) I can truly imagine the poor girl being stitched up. I left the NHS back in the late 80s and never looked back. I was bullied, harrassed and at one point tried to be stitched up for an appalling incident that happened when I was actually on my days off. It still haunts me and went a long way to destroy my faith in the 'caring' professions. Unfortunately I fell victim to the homosexual, catholic and nepotic cliques that permeated the then NHS. I doubt much has changed.

She's guilty. Go and read the case against her - it's compelling. This is one of those times where small gaps or inconsistancies are being misinterpreted. The number of deaths were several times the normal - and after she left the frequency of deaths returned to normal - and this was BEFORE she was arrested. Combine all the evidence and to me, it's undeniable, don't let doubt creep in - she did it.

No-one can know if she is guilty - but that there is a 'reasonable doubt' about her guilt, as David Davis attests, should have been evident to anyone who followed the original trial with a sceptical mind. I said it to friends at the time, if I was on the jury I could not have found her guilty on the basis of the evidence presented. She was convicted entirely on the basis of inference and speculative theories, which is simply staggering. We have had sufficient miscarriages of justice in England to know juries [and expert witnesses] get it wrong - especially when our febrile tabloid press are bent on creating a sensational narrative.
People have no idea how corrupt the legal system is. I commented early on that the evidence in the case was wholly inadequate, circumstantial. This is a very serious case and they still refused an appeal. Now consider the thousands of smaller cases, the violent, perjuring police, the number of cases arising out police interactions. The system, the legislation, funding, the disproportionate impact on people's lives, the concept of 'making an example', 'justice needing to be seen', the vindictiveness particularly against those who stand up for themselves, both during and after cases. People have no idea how biased the system is. The media are completely supportive of the legal system and generate revenue from reporting on cases. Huge credit to David Davis for pursuing this. Letby should be released from prison immediately, whilst all the very well paid hospital managers should be arrested and held on remand instead. Only then, when they are fighting for their freedom, will more facts emerge.
Eeerrr... Circumstantial evidence doesn't mean inadequate evidence. It could be as strong as direct evidence. Infact many criminal convicted around the world coming from circumstantial evidence.

Yes, it's a weird take. I guess it's a closure thing. Easier to blame someone. My mum died and I know the hospital let her down. It's a hollow hole but chasing the nurse who was bad seems unlikely to help. Also she was African, so it would be painted as racism of course.

For example you said the nurse probably shares some of the blame, but then is it the hospital being run badly that has put her in that position? Maybe her superior had a part to play, or their superior? Then is it the governments fault for putting the hospital and therefore the staff in a bad position. The minister of health? The leader of the NHS? I think its human nature to blame but like you said it could be very complicated and mentally draining thinking that way. If you're medical, you realise how strong it is. The insulin came from outside the hospital, yes outside. Meaning she brought a lethal drug into work, with the intention of using it on non diabetic infants. That's before you even get into the evidence of the embolisms, and the fact the deaths stopped, and then started again on her shift whilst she was attending to patients. Then disappeared entirely after she was removed.

Why would she write a “confession” in her diary, but then deny everything during interrogation, and then appeal to the court? Moreover, there is no evidence that the babies died at her hands.

Seriously? I mean obviously you have every right NOT to allow someone to babysit your own kids if you're suspicious for any reason. However, that is nothing like putting someone in prison because you're suspicious of them. I'm not saying she's innocent necessarily but if there's any reason to believe she could be then that should be looked into.
That depends on how conclusively the convictions were overturned, and whether the actual cause of the deaths becomes known. If they were to be overturned purely on the grounds of strength of evidence, ie it's decided there's enough doubt to question the safety of the convictions but no other causal factor is found, then yes she would still be in for a very rough time if released.

The level of ambiguity will be the determining factor because uncertainty creates a vacuum that becomes flooded by idle speculation and unfounded theories. What I mean by that is, the most favourable outcome for Letby would be if she was exonerated because the actual cause of the deaths was found to be natural, or caused by another person or factor. That is very unlikely to happen though - much more likely is that a degree of doubt is cast such that the convictions are considered unsafe and quashed. In the latter case, media speculation will be rife and many will still believe she is guilty, because there is no other viable scapegoat.

Yes but rarely evidence informs police police decide if they have a case CPS review and make a decision Judge will decide if case can proceed to a verdict and can make a terminatory ruling before trial. But agreed a jury an make a wrong decision based on personal feeling.

In a situation such as this sometimes , very rare occasions I stress an accused can have it put in their head that they are guilty and such is the the ordeal that they’re experiencing they end up actually believing that they’re guilty . Her "confession" post it notes have been well analysed and make much more sense as an outpouring of anguish and despair and not a confession. To ignore difficult questions about statistics, doctor training, cleanliness at the ward, complex causes of death, and instead to leap on a nurse's scrawled journaling is not surprising given the circumstances. But from what I read she was a dedicated nurse who volunteered for extra shifts and that explains her presence there. None of her colleagues think she did it and for days and days on trial she gave hours of testimony answering openly every question put to her.
Shezwas also advised by her mental health counsellor to write down the random thoughts she was having as a form of therapy. At the time when she knew people were blaming her.

Since the case of a young mum, Sally Clarke, loosing 2 baby boys to Sudden Infant Death Syndrome, going to prison, because a so-called expert used statistics, wrongly, to say that the case of an affluent family's chances of having 2 cot deaths, was 1 chance in 78million, I cannot back this conviction. The young mum i spoke of had her convictions quashed, but heartbreakingly went on to commit suicide when she was finally cleared of all suspicion is such a sad story. @@LegallyBlondeCritic No it doesn't. Each case is heard on it's own merits. We had miscarriages of justice in the old days of no forensic evidence and before the CPS was set up but our criminal courts only improved and developed with time. It didn't set any precedents.
Beyond reasonable doubt usually consists of steadfast forensic evidence like finding the suspect's DNA or fingerprints at the scene of a crime or CCTV footage which clearly shows their face while they are committing the crime, all the evidence here was circumstantial. It's pretty rare to get a conviction of this magnitude on circumstantial evidence alone. This smacks of people in high up places (NHS bosses) pulling strings, trying to pass the book for their failings, and the government's failings.

A few years ago I saw a government figure on how many people are suffering from a miscarriage of justice in the British legal system that are innocent. 17.5%. You cannot have anyone convicted of a crime if they are innocent. So its not that they haven't studied and looked into this before. This is so disturbing for the families involved in this case. Awful. RIP those little infants.
More people seem to be doubting the verdict. There's also very similar cases which turned out to be miscarriages of justice, such as Lucia de Berk. Either way, I hope the truth is discovered and there is justice either way.

I’ll just point out a few things, she was the only one on shift when all baby’s who died or nearly died. She had notes around her house claiming she was evil and she did this e.g And she didn’t looked shocked when she was arrested? I would be gobsmacked if she was innocent. She was also found to have been searching the parents of dead baby’s up on social media.

Yes it's so annoying that people think that feelings and sentiments matter more than truth and facts. I personally think that Letby is guilty, but if there is cause for probable doubt then it should certainly be investigated. The feelings of the victims' families are beside the point. Letby too has a family after all.

I think most of her accusers genuinely believe what they say. The problem is that more and more problems are emerging re the way the prosecution assembled its evidence. Regarding the table they actually created the evidence. Lucy Letby didn't or couldn't afford to hire statisticians to create her own table but every statistician I've seen says the prosecution table is fatally flawed. Has a single statistician come forward so far to say the stats are impeccable and this is a fuss over nothing? I haven't seen one, they've all said the exact opposite so far.

I work in the NHS and regularly see incidents brushed under the rug. Many patients don't even know when they've had something bad and avoidable happen to them. The culture of cover up must change. Letby was used as a scapegoat.

In the Netherlands we had a famous case of a nurse being convicted for the same thing. She spent a long time in prison. She was innocent. The state secretary of justice has apologised to her.

There are lots of genuine concerns about this case -
1. Cherry picking of statistics which did not include deaths when Lucy was not present - the jury were duped into believing that Lucy was present at all the baby deaths which is far from true. Statisticians are united in challenging the data the Prosecution presented to the court.
2. Medical experts have spoken up and explained there is no evidence that the babies died from an air embolism. Professor Michael Hall and other neonatal medical experts have seriously questioned this as the cause of death. Yet air embolism was presented as a real cause of death during the trial - again misleading the jury.
3. Reports have come to light showing an outbreak of bacterial infection during the spike of deaths (2015-16). Premature babies, many with open lines would be highly vulnerable to such an infection.
4. Dr Jayaram's evidence has been shown to be incorrect. He testified that he 'virtually caught Lucy Letby red handed' standing over a baby with a dislodged tube. However, door swipe scans now show that at the time Dr J accused Letby of this there was another nurse also in the room. Dr J testified that Letby was alone, but clear evidence shows that she was not.
5. In Lucy's own journal she said 'Why me, I haven't done anything', but this and other innocent sounding comments were ignored by the media.
6. Strangely, no medical experts were called to testify for the defence. So the prosecution went unchallenged on the questionable medical facts they presented to the court.
Regardless of whether Letby is innocent or not, there are SEVERE flaws in the criminal justice procedure. It's been obvious for decades and nothing has been done to fix it. The Judges are not impartial as they should be and equal representation is not given.
And there are hidden extremist working in the nhs that are intent on killing patients for their religion

In the Netherlands there was a similar case with Lucia de B. , a nurse who was present at work when 7 unexplainable deaths occurred. She was sentenced to life in prison and tbs (mental teatment to avoid a release). She was convicted on statistics among other things. It was one of the big miscarriages of justice in the Netherlands and she was released and rehabilitated.
As soon as this case came up - there were interviews from around the world highlighting where historically the nurse had been wrongly convicted..

I am quite suspicious of the doctor who run the ward. I work in NHS and senior nurses and doctors always blame lower rank professionals. Doctors and Senior Nurses never ever take any responsibility of wrong doing. I saw this behaviour many times.
If there is any possibility she is innocent, then it needs looking into urgently.

I agree with this one. I worked on a ward where I saw 2 qualified nurses forge a blood pressure reading. They made it up because they were pushed for time. I wouldn't have been believed I I told someone, because the ward sister didn't like me and I was indirectly bullied because I was quiet.

Several did die while she was not on duty. It seems that this was not communicated to the jury at the original trial. One problem with the conviction. Guardia article last month details many doctors who have now come forward to directly state their concerns. That said, I'm not yet ready to believe she is innocent, as her writings and behaviour in the trial were very odd.

I am not too knowledgeable about this Letby case.... is the evidence clear that someone has tampered with medical equipment and killed many babies, or could it be that the medical equipment was faulty and the unit was understaffed? as I say, I have not been following the case.
As a nurse in the NHS I doubt she could afford a robust defence out of her own pocket. Probably the court appointed lawyers who had.what appeared to be a multiple child murderer on their hands. If they themselves didn't believe she was innocent, or even just that they couldn't win, they may not have been playing their A game...

I sat on juries for over 2 weeks some years back and it's very strange what is submitted as evidence and what isnt.
For instance a case of a girl charged with being involved in the robbery of a taxi driver. She had got the taxi to stop outside some flats to pick something up. She got back in the car and this guy turned up and robbed the taxi driver (he was never identified).
Prosecution claimed when the driver tried to drive off she stabbed him in his key hand to stop him.
We the jury asked the court a simple question. Did the taxi driver have injuries to his hand. Response was that has not been entered as evidence so we can't tell you.
Therefore we had no option than to find her not guilty. The injury to his hand would have convinced us guilty but not submitted as evidence by either side. That alone was sufficient doubt. So a jury trial is not necessarily about who is telling the truth and more about who are the better of worse lawyers .

As retired Registered Nurse (male btw) I can truly imagine the poor girl being stitched up. I left the NHS back in the late 80s and never looked back.
I was bullied, harrassed and at one point tried to be stitched up for an appalling incident that happened when I was actually on my days off.
It still haunts me and went a long way to destroy my faith in the 'caring' professions.
Unfortunately I fell victim to the homosexual, catholic and nepotic cliques that permeated the then NHS. I doubt much has changed.

She's guilty. Go and read the case against her - it's compelling. This is one of those times where small gaps or inconsistancies are being misinterpreted. The number of deaths were several times the normal - and after she left the frequency of deaths returned to normal - and this was BEFORE she was arrested. Combine all the evidence and to me, it's undeniable, don't let doubt creep in - she did it.

On the other hand, justice can not equate to anyone being found guilty. If there is any miniscule chance of the guilty verdict being erroneous, then it should be explored, and I salute Sir David Davis for being curious about this.

No-one can know if she is guilty - but that there is a 'reasonable doubt' about her guilt, as David Davis attests, should have been evident to anyone who followed the original trial with a sceptical mind. I said it to friends at the time, if I was on the jury I could not have found her guilty on the basis of the evidence presented. She was convicted entirely on the basis of inference and speculative theories, which is simply staggering. We have had sufficient miscarriages of justice in England to know juries [and expert witnesses] get it wrong - especially when our febrile tabloid press are bent on creating a sensational narrative.
People have no idea how corrupt the legal system is. I commented early on that the evidence in the case was wholly inadequate, circumstantial. This is a very serious case and they still refused an appeal. Now consider the thousands of smaller cases, the violent, perjuring police, the number of cases arising out police interactions. The system, the legislation, funding, the disproportionate impact on people's lives, the concept of 'making an example', 'justice needing to be seen', the vindictiveness particularly against those who stand up for themselves, both during and after cases. People have no idea how biased the system is. The media are completely supportive of the legal system and generate revenue from reporting on cases.
Huge credit to David Davis for pursuing this. Letby should be released from prison immediately, whilst all the very well paid hospital managers should be arrested and held on remand instead. Only then, when they are fighting for their freedom, will more facts emerge.

It could be as strong as direct evidence. Infact many criminal convicted around the world coming from circumstantial evidence.

Yes, it's a weird take. I guess it's a closure thing. Easier to blame someone. My mum died and I know the hospital let her down. It's a hollow hole but chasing the nurse who was bad seems unlikely to help. Also she was African, so it would be painted as racism of course.

For example you said the nurse probably shares some of the blame, but then is it the hospital being run badly that has put her in that position? Maybe her superior had a part to play, or their superior? Then is it the governments fault for putting the hospital and therefore the staff in a bad position. The minister of health? The leader of the NHS? I think its human nature to blame but like you said it could be very complicated and mentally draining thinking that way. I’m so glad David Davis is pursuing this. I always thought the evidence against her seemed flaky and reading the New Yorker article convinced me she definitely deserved a retrial. British justice is totally flawed to deny her one.
If you're medical, you realise how strong it is. The insulin came from outside the hospital, yes outside. Meaning she brought a lethal drug into work, with the intention of using it on non diabetic infants. That's before you even get into the evidence of the embolisms, and the fact the deaths stopped, and then started again on her shift whilst she was attending to patients. Then disappeared entirely after she was removed.

If she is innocent and released her life is ruined, she would have lost everything while in jail and some folk will still think she's guilty.
That depends on how conclusively the convictions were overturned, and whether the actual cause of the deaths becomes known. If they were to be overturned purely on the grounds of strength of evidence, ie it's decided there's enough doubt to question the safety of the convictions but no other causal factor is found, then yes she would still be in for a very rough time if released.

The level of ambiguity will be the determining factor because uncertainty creates a vacuum that becomes flooded by idle speculation and unfounded theories. What I mean by that is, the most favourable outcome for Letby would be if she was exonerated because the actual cause of the deaths was found to be natural, or caused by another person or factor. That is very unlikely to happen though - much more likely is that a degree of doubt is cast such that the convictions are considered unsafe and quashed. In the latter case, media speculation will be rife and many will still believe she is guilty, because there is no other viable scapegoat.

Her "confession" post it notes have been well analysed and make much more sense as an outpouring of anguish and despair and not a confession. To ignore difficult questions about statistics, doctor training, cleanliness at the ward, complex causes of death, and instead to leap on a nurse's scrawled journaling is not surprising given the circumstances. But from what I read she was a dedicated nurse who volunteered for extra shifts and that explains her presence there. None of her colleagues think she did it and for days and days on trial she gave hours of testimony answering openly every question put to her.

Since the case of a young mum, Sally Clarke, loosing 2 baby boys to Sudden Infant Death Syndrome, going to prison, because a so-called expert used statistics, wrongly, to say that the case of an affluent family's chances of having 2 cot deaths, was 1 chance in 78million, I cannot back this conviction. The young mum i spoke of had her convictions quashed, but heartbreakingly went on to commit suicide when she was finally cleared of all suspicion is such a sad story. Here is hoping that true justice will be done

@@LegallyBlondeCritic No it doesn't. Each case is heard on it's own merits. We had miscarriages of justice in the old days of no forensic evidence and before the CPS was set up but our criminal courts only improved and developed with time. It didn't set any precedents.
Beyond reasonable doubt usually consists of steadfast forensic evidence like finding the suspect's DNA or fingerprints at the scene of a crime or CCTV footage which clearly shows their face while they are committing the crime, all the evidence here was circumstantial. It's pretty rare to get a conviction of this magnitude on circumstantial evidence alone. This smacks of people in high up places (NHS bosses) pulling strings, trying to pass the book for their failings, and the government's failings.

A few years ago I saw a government figure on how many people are suffering from a miscarriage of justice in the British legal system that are innocent. 17.5%. You cannot have anyone convicted of a crime if they are innocent. So its not that they haven't studied and looked into this before. This is so disturbing for the families involved in this case. Awful. RIP those little infants.
More people seem to be doubting the verdict. There's also very similar cases which turned out to be miscarriages of justice, such as Lucia de Berk.
