      I myself would prefer to at least comply for a breathalyzer, especially if I know I am not drunk / impaired. Perfect evidence to use in court if they still try to arrest me would be that breathalyzer being a 0, and if they keep pushing, I'll say no to a chemical test given the breathalyzer, but if I'm still being arrested for zero reason, under threat / durress I'll say yes to a chemical test.

      Not everyone can afford to fight in court to have their license un-revoked, which is immediate in implied consent states, like my own. (Alabama) Our crooked “justice” system depends on citizens, for whatever reason, not being able to fight back against their corrupt, greedy, often unconstitutional, actions.

      @@FlyingSquell The Field Sobriety tests are not required even in implied consent states. You may have to do the breath test due to implied consent but you don't need to do any field sobriety tests which all people should refuse.

      ​@@kgt7500 After being out through the ringer myself, I can say, in retrospect, that I would have declined everything and requested blood tests, both from them and private. I can say with 100% honesty, that I was not intoxicated in the least. I had two weak margaritas, 6hours before I was arrested (after wrecking my motorcycle), but I blew over the limit. I have absolutely no faith in breath tests

    Let me get this straight; the first thing he was looking for when he got on scene of an accident was alcohol? Not head injuries, not is there aid that needs to be rendered, but alcohol. I'm not a lawyer but I am a medic and the fact that he was too lazy to conduct testing and turn her over to an ambulance he took her to jail just pisses me off. There was never a moment he was concerned about her health or safety.

      Actually, a driver I suspected of DUI asked me after I explained the first field sobriety test if he was obligated to perform such tests; I said: "no", he said, I"d rather not then"; based upon any other observations made by me prior to that, he was placed into custody. Having driver's perform field sobriety tests are a form of collecting evidence and helping an officer make a better formed decision to make a DUI arrest. These tests may also give the driver the benefit of the doubt as well

    Nystagmus is exacerbated at night when you shine a bright light into one's eyes. That is a normal protective response by the eye to protect the retina.

    People sometimes forget that they are under no obligation to assist a cop in their investigation. I wonder how many people actually dont get arrested after a field sobriety test. I have a few cop friends that all say the FST is only a formality because their mind is made up before ever requesting suspects to take one.

    I was born with nystagmus... it's pretty feaky looking, not just for me but others.
    My eyes work separately. Since they work independently....
    It's a strange trip for all involved.

    I have nystagmus while sober. How can a police officer determine if someone’s pupil’s are the “correct” size? Officer says they try to rule out medical conditions. It the officer qualified to make a medical determination?

      If you claim medical issues they skip to the next test, if you can do no test you do breath, blood, or urine under implied consent. Do not do the clown road side test.

      They are supposed to ask the person if they have any eye problems. Or any other medical issues that would possibly impair the test.

    Nystagmus can be caused by so many things, I hate the way cops act like they know everything about. Vertigo, MS, head injury, anti seizure meds, b12 deficiency and even spinning in a chair can cause it. Grrrrr

      Larry has actually taken both courses(DUI and the advanced class about checking for drugs). He asks officers all the time about 'other reasons' for the HGN, so it makes me think they're taught at least some of those things, but choose not to factor them in 🧐

    Given that no one walks heel to toe one foot in front of the other and no one stands on one leg in their daily lives, who determined that a "sober" person would be able to do this? Olympic gymnasts sometimes fall off the balance beam because they can't walk this way, nor stand on one foot, especially when nervous.

    The cop didnt do a proper investigation. But just from this one video, i think she was guilty. But to give an 18 year old a dui charge for a victimless crime is BS. We see cops letting their fellow officers get away with a slap on the wrist for being caught extremely intoxicated while driving. But rules dont apply to the blue line gang and the rest of the government. I would like to know the verdict. But its still interesting and educational to watch you work. Thanks larry.

      Not really relevant what cops do for their buddies, they shouldn't get off for sure, but neither should she. Drinking and driving is negative no matter how you slice it. One wrong doesn't make the other less wrong.

    You can refuse everything.. rule of thumb if you think that you’re over the legal limit, then refuse people make the mistake of one.. drinking and driving. However, they also make the mistake of choosing the field sobriety test, and then refusing the breathalyzer. If you refuse one refuse both.

    If you're going to drink make sure before you leave your house that you have some extra clothes Cologne or perfume and some mouthwash. When you or before leave put on the clothes ,use the mouthwash and oh yea have some visine.

      She appears to be DUI however we obviously don't know that. The bigger point is that these videos should show and end result and rarely do. Obviously collecting too much money from listing it in the first place. No good reason for the video other than monetary gain. 😡

    3:38 Anytime someone says 'odour of alcoholic beverage', they are giving a stock response (so likely lying) so not to be taken seriously.

      It's not a "stock" answer, your body treats alcohol like a toxin, like through your gastrointestinal system or urine-most alcohol is metabolized and excreted through the pores or sweat glands; so what you smell is the odor of an alcoholic beverage being purged in the form of expelled gases on your breath, hence the term: "odor of an alcoholic beverage"

      ​@@turtlecadet9244 I guess you missed the last trial where none of the cops on scene smelled alcohol (at least 3 with one being a SGT), and when he got to the breathalyzer the 'attendant said he smelled strongly of alcohol. Wonder how that happened?

      @@16MedicRN I've made several arrests with not smelling alcohol at the scene, then when back at the police station in a confined area, the odor of alcohol becomes more prevalent (I can't attest to what you have referred to since I wasn't present in the first place)

      @@turtlecadet9244 that's interesting that you need such a confined space to have somebody 'reek' of alcohol. The breathalyzer lady also never wrote it in her report as I understood it. Isn't riding in the back of a patrol car a confined enough space? Curious. Plus, the man was in a wreck and all his bottom teeth broken with a split lip, hence 'slurred speech', no seat belt, and no medical was called until an intake officer made notice that he was 'in bad shape'. Additionally, defendant asked 10x (confirmed via video) for a blood test after being offered either blood or breath. He was denied that. The testifying deputy would embarrass you, I'd hope, that cops like this carry deadly weapons, and breathalyzer administrators would deny what was just read to them on the implied consent form. And, just for perspective, my ex was a K9 cop and would've never have behaved this way. My sister, a former deputy, wouldn't have given a shit. I treat 'smelled of alcohol' with a grain of salt, unfortunately. Thank you for giving your perspective 👍❤️ Assuming you're one of those who are honest, decent, and not a rights violator. I assume this because you're a TB follower 😊 I was happily encouraged recently with an encounter with a local deputy where I live. A mentally-ill woman was tresspassing on all properties on our little dead-end street. Taking people's mail, dancing around, very happy actually. Cops were called, she ran (scared out of her mind), but didn't get far. We did the trespass warning, and I asked him, you're not taking her to jail, right? His response, I'm not here to violate her Constitutional rights. We just want her safe'. Good answer 😉 Reality was, she got out of her sister's home down the road who was her caregiver.     To do the one and only test. With his patrol car flashing light. Wouldn’t be the best and correct way to carry out that single test. Not fair to anyone. To have flashing strobe lights. With his patrol cars flashing lights on, if I was in the jury. I wouldn’t find her guilty. As the only test was carried out under those conditions. Usually the officer would turn off the lights that faced the person that they were testing. Not a little unfair. That was a lot unfair. IMHO

    Breathalyzer evidence seems quite damning. Interested to see how you will show reasonable doubt against it. You did show an objection to its introduction, so am assuming you already had a plan in case the objection was overruled.
    When clients in similar situations have that evidence against them, how do you advise them about going to trial?

      That should be suppressed since there wasn't PC for an arrest. He did one test but couldn't explain her performance. The other FSTs weren't done, and neither was a PBT. The cop's justifications for the arrest were as follows. (1) An odor of alcohol was present. But that could have happened if she had spilled alcohol on herself. (2) Her eyes were bloodshot. But that's not caused exclusively by alcohol. (3) Her eyes were watery. But the video showed she was crying. (4) He knew that, since she was under 21, a lower BAC applied to her. But he failed to obtain her specific number at the scene. (5) She had admitted to having drunk alcohol. But she had said it was many hours earlier. Also, that statement should be suppressed, since she hadn't been Mirandized. So, as you can see, the arrest was arbitrary and should be tossed.

      He does it as a form of showing he's in charge of the cross examination. Often he stands between the witness and the prosecutor so that can't give signals.

      So many RUclipsrs do this. They think viewers watch every one of their videos in sequence, and that's just not the case. Most new viewers (the people that creators are trying to target) stumble randomly on videos. When there little/no context, they move on quickly and the video gets ranked down.

      You realize he's talking to opposing sides in both of those examples, right?
      He's getting it on record that the officer doesn't have the evidence that he tells people not to give the police. This is entirely consistent.

      When asking the cop, he's asking if the cop has any evidence. When talking to the citizen, he's telling the citizen not to commit the unforced error of volunteering evidence.

    Here’s a sad thing about the DUI thing they are they tell you will you take the test and then they tell you if you don’t your license will be suspended for up to one year well that’s true but it can. It can be suspended up to one year I don’t mean it’s gonna be it can be so that scares people into thinking well if I take the test and I pass then I’ll get I’ll get my keep my license and I won’t be suspended but you’re gonna be suspended no matter what but it doesn’t necessarily mean it’s gonna be a year so refuse the test, don’t give them no more evidence and what they have. It’s the cops word against yours, which is probably a stronger word because he’s a cop, but they have to prove that you were drunk.

      He likely has about a dozen videos per year from when he started litigating. I have not seen this one. But lawyers don't try that many cases every year most are plead out. So it's hard getting "new" material.
      Most people would rather take a plea than risk a jury and maximum sentencing.

    I love the cases where you defend innocent people, and I know your job is to defend your client regardless, but… I believe this young lady was drunk and could have killed someone. The justice system is broken, in many ways, and it ruins countless innocent lives, but…. so does driving drunk.

    I think Biden also leans in to check for scents. Boy, he and the officer are like twins! The only difference is that the cop leaned in to determine if odors such as alcohol or marijuana were present. You would need to ask the big guy what he was doing that for!
