Hey. Based on a recent update from the US department of state, the 2 year home residency requirement has been waived off for current J1 residents. So you can apply for H1B from J1 without a waiver. But since your J1 has already expired the 212(e) might still be applicable to you. You can follow the steps we have described in the video to get your waiver. From what I know, you can even continue the waiver process after you return to India too.
@@Walkwithsony you can complete the 1st and 2nd stages. I would recommend to wait before starting The third stage. It’s better to do it after you get extension or when you are ready to switch to h1b.

My J1 visa is only for one year can i apply for a waiver and one month already finished.
