The employer should have never let her work without getting her documents in the first place.
Absolutely that employer also is at fault… hopefully her boss noticed, this all could have been avoided
That's it!!! But look what happened - she worked, didn't get paid...and the employer just happened to trespass her straight to rough cops. She should have gotten her pay & been let go. But no, employer used her for free labor, and cops roughed her up & put to jail.

The employer made the mistake of giving her the benefit of doubt, when she said she would bring in her ID and supporting documents. But I do agree that letting her go 3 weeks without those documents is a little long. In the old days with this problem they would have paid her cash as an independent contractor and then terminated her. It’s impossible to cut her a check thru payroll without a social, because Uncle Sam wants his cut, and Uncle Sam can get really nasty if he doesn’t get his cut.
Exactly. The fact that they did so makes it obvious that their intention is to use people who cannot legally work as free labor that has no legal recourse, and this cop just randomly turned a humble trespassing call into a violent encounter, so inexplicably they I can only conclude that he’s on the take for these human traffickers.

I work in HR and we would never let anyone even start one day without having their paperwork filled out. This is nuts and should’ve never of happened. unless they’re hiring people who are not legally allowed to work in America.

Of course the manager would tell the officers that she needs to fill out the form but it just feels as though they had an agreement to be paid under the table and the other people working there get paid under the table too.

I knew a lady who lost her SSI because she started working. She asked me to get a title loan on my car to help pay her bills. Absolutely not…. might as well just ask me for the money, which she was probably not going to pay back. Plus, I was dating her son who treated me like shit. No, not worth it

I worked in HR and I was a recruiter for a very long time. Technically you’re not supposed to let anybody work without the paperwork being signed for this reason and probably a lot more other reasons like injury.

Fyi, that's not a legal hire. The company is in big trouble, legally speaking. I know lawyers that would line up for that easy case. The woman is dumb for agreeing to work, but overall, she is the victim here, and the cop did nothing but escalate the situation.

thats routine, they expect the documentation to be done by the time payday rolls around. Otherwise if it did take 2-3 weeks, they have to send you home

More than likely this is a case of the employer trying to pay people under the table, avoiding legal paperwork to evade taxes and other fees. They lied to the police saying that she never filled out paperwork to try and cover for the the initial cover up. But they will get fleeced in court. More so now that the cop escalated the situation and attempted a completely unnecessary arrest.
If they company urgently need staff, then they might let you start working immediately. It's risky for both parties, but definitely can happen.

I worked lining up interviews, and hiring employees for a major grocery chain in NA, and there is no way she was ever going to be paid without the proper paperwork.
I think, (As she referred to more than once) she was used to getting paid under the table, so she just didn't think she needed to fill in the documents.
If she was being asked for the documentation for three weeks, she should have known that wasn't about to happen!

I work for a health insurance company and I see that attitude every day. I've seen people call multiple times in one day, trying to get the answer they want just because they don't want to accept the situation that they have. Or even ask me for a supervisor thinking they will get a different answer. That usually doesn't work out for them. Supervisor gonna tell them the same thing.

This gal is a complete nutcase and typical "victim", but I certainly hope that the employer also learns from this. Do not allow a person to start working unless all of the documents are completed and verified. In my career I have been on both sides of HR and never was I allowed to start work or did I allow a new employee to start work without all of the documents properly filled out. You are just asking for trouble by not doing so. Unless of course, you indeed are paying them under the table. Obviously, this was not the case in this instance.
The employer is actually incorrect. She shouldnt have been allowed to start. It was illegal for them to start her without the documents. They also have to pay here irregardless as well.

I was thinking the same thing. If she didn’t fill out her tax forms on day one I would not let her work until she did so. The I9 has a grace period of needing to be filled out three days after hire. They should have just let her go after 3 days if she was unwilling to do the paperwork.
@@mmcla5 as person who used to do schedules & put people in the system but the payroll company makes the checks there have been times people didn't get paid for three weeks because they get paid every other week & depending when u start ur paycheck reflects the two weeks prior . & if there is any hiccup let's say they missed a paper work or payroll didn't receive the mailed copy before a Tues they aren't put in the system & people had to wait. There's always hiccups when it comes to working at a new job but I've never seen a person act the way she did demanding cash on the spot or else. She's entitled for her money just not when she demands it. & the hiccup was obvious . Alot of times things like that slips through managements fingers cuz the next process is for her to turn in the paperwork & usually when hired they give u the packet to fill & put u in training & on the schedule a lot of times new employees forget to turn it in or just need one more document so management can't send it in . But she acted like this was an under table job & it wasn't . That's the real conflict I see here. Lastly we did give some cash if people were on back pay because of a hiccup being so long & made them sign a paper & we would hold their check & take it out it. But we cashed employees checks for them so that's why we were able to do stuff like that.

All of this is on their shady company. They're obviously paying some of their employees under the table and she wanted the same. As soon as I heard the W-2, I knew what the issue was - she either cannot work legally, or had some big debt she was trying to avoid paying. She thought that because she wasn't asked to fill out the paperwork on day 1, that meant she didn't need to. She blew off the employer until she learned it was required for pay, and then freaked out.

The reason why she’s upset is because the hotel hires illegal immigrants who are getting paid cash i.e. they do not pay taxes. She is an American citizen so they are forcing her to be on the payroll to offset the illegal activity. this happened to me. as a housekeeper in a nursing home. i didn't freak out like her, i was 17 and it was my 2nd job. they didn't pay me for 5 weeks. i filled out the payroll paperwork during hire but the site supervisor never turned it into the company or whoever. they tried to pay me with a cashiers check too 😬. only had to threaten to call the police & gave them 48 hours, got sorted lol

It wasn't her fault. It was that fat ass lazy manager's fault. It's FEDERAL LAW that an employee has three days to produce documentation. At that point if she does not, she is no longer employed and must be paid for the time worked within 72 hours
I'm in the UK and we have some very robust employment laws, so I'm shocked someone can work without submitting paperwork.
What would this company do if it was a company that dealt with say heavy construction or transport and their employees said I'll bring in my licences to operate construction machinery or huge trucks when I'm good and ready.
There's no way an employee would even get on-site or in the cab of a large vehicle without their paperwork.
Something is up with this company or employment laws in America aren't up to scratch.

The employer shouldn’t have allowed the employee to work for more than 2 days without having the I-9 filled out. W-4 would be needed before they process payroll. She shouldn’t have been allowed to start working on day 3 without completing the I-9.

Yeah, that's odd to me as well. An I-9 has to be completed within 3 days of starting a job and it's the employer's obligation to ensure it's completed. Most employers ask for it to be completed before the first day to avoid this issue. It's on the employer that they kept scheduling her hours without ensuring she could legally work.

Every place I've ever worked, the first thing you do is fill out some forms with basic info, social number, basic emergency contacts etc. Then you initial a paragraph that says you will submit banking info within 1-2 weeks, and failing to do so will impact pay

The job you have now probably has a turnover rate of less than 50%, some places (looking at you Amazon) have a turnover rate a year of above 100%.
Plus finance sometimes knows.... let's be generous and say they don't know much. I've had two cases where dumb finance types required me to specifically get a bank debit card (kinda expensive and unneeded in the 1990's) while their aim was to verify I own my bank account (something which is legally my problem, not theirs) and had an employer who demanded to know the country of birth of my parents, while ethnic tracking is completely and utterly illegal. So even as someone who can prove his ancesty as white native back to the year 1404, I refused.
In both cases dumb finances types refused to pay.
In both cases the ex-employer ended up paying my full wages with the 50% extra stipulated by law for late payment of employees. Turns out nobody gives a hoot what dumb finance types think their internal bureaucracy requires. If it can't answer "Is it legal?" and "Is it strictly necessary?" both with a yes, you get paid without doing whatever 'it' is.
Some people know every trick in the book. Most likely collecting social services and making extra on the sly. Probably did this same thing at other jobs and was given the pay off the books to get it over with. Didn't work out this time.

I know with every job I've had, I had to complete the paperwork first before being hired. Something is very sneaky with that hotel and the staff. If I was her, I would ask for a thorough investigation with that particular hotel.
