The whole thing is sketchy. If she owns everything after 60 days, she has no incentive to sell anything for the first two months. She can just put everything away and then sell it on the 61st day and keep all the proceeds.

The seller is incentivized to sell in the 60 days because they risk getting zero for their efforts, if you come pick up your stuff that they didn't sell. I managed a consignment shop for several years and you would not believe the amount of people who do NOT read the contract or have an understanding of the time/terms. As most people casually ask while shopping because they want to bring in things of their own, we verbally explain the process and it was simple. We have it posted throughout the store. We then explain it again to them while they sign a contract and bring in their items and show them the terms written that we just explained. Just as this lady did, there is an itemized statement listing each item sold with the check that was cut on the 1st of each month. People would not call or come by to pick up checks, phone numbers get disconnected and I'd have some checks for almost 1 year. At the end of the year, we void the checks (they were 90 days only anyway although we'd issue another one upon request) and in some cases you never hear from the person until over a year later and they want to pick up their item. We say we sold it and they get mad. Then they want the check, we voided it as it was over a year old. In most cases we'd cut a check but in a few where there were issues, the owner went by the contract so I was not able to cut a check. During my last year, we revised the contract to include "storage fees" after a certain date that had to be paid in order to pick up the item or it was ours. The large bookcases, antique dressers and other large dining pieces people would leave there for storage while they went out and put ads on craigslist and facebook marketplace and if it sold they'd come pick it up and pay us nothing.
People attach sentimental value to items vs being subjective about what they’re actually worth. And want to yell you down when it’s not worth what they think it is.

If they don't tell you until you get the cheque 90 days after that something has sold, how do you pick up the unsold items after 60 days??
The whole thing is sketchy. If she owns everything after 60 days, she has no incentive to sell anything for the first two months. She can just put everything away and then sell it on the 61st day and keep all the proceeds.
After 60 days of the contract ending maybe???
@@michelepaccione8806 You're supposed to pick up your unsold items before the end of the 60 days, if you still want it. The seller is incentivized to sell in the 60 days because they risk getting zero for their efforts, if you come pick up your stuff that they didn't sell. The wrap-up at the end said the defendant had proof (an email) that she told the plaintiff to come pick up her stuff before the 60 days.
Easy, on the 60 day mark you show up at the store and take what's yours, that hasn't sold.
The plaintiff has a disgusting attitude, I hope the defendant finds the email.

Honestly the defendant should’ve used her company name. Because I thought she was a horrible person who takes advantage of the elderly in the beginning and she proved that no, they’re great very flexible and understanding company and it’s a great ad for the company.

I watched this twice because it was so juicy. The plaintiff not reading the contract and then not understanding it caused this whole thing. And I still can't believe the judge read from the contract word for word and plaintiff said, "that's not how it works." TWICE!! Cmon man.
Your items are only worth what someone else will pay for it.
Edit: It's so flustering to provide paperwork in the moment with a client that clearly has made contact a frafillion times. Glad she was given more time to actually go through everything.

I managed a consignment shop for several years and you would not believe the amount of people who do NOT read the contract or have an understanding of the time/terms. As most people casually ask while shopping because they want to bring in things of their own, we verbally explain the process and it was simple. We have it posted throughout the store. We then explain it again to them while they sign a contract and bring in their items and show them the terms written that we just explained. Just as this lady did, there is an itemized statement listing each item sold with the check that was cut on the 1st of each month. People would not call or come by to pick up checks, phone numbers get disconnected and I'd have some checks for almost 1 year. At the end of the year, we void the checks (they were 90 days only anyway although we'd issue another one upon request) and in some cases you never hear from the person until over a year later and they want to pick up their item. We say we sold it and they get mad. Then they want the check, we voided it as it was over a year old. In most cases we'd cut a check but in a few where there were issues, the owner went by the contract so I was not able to cut a check. During my last year, we revised the contract to include "storage fees" after a certain date that had to be paid in order to pick up the item or it was ours. The large bookcases, antique dressers and other large dining pieces people would leave there for storage while they went out and put ads on craigslist and facebook marketplace and if it sold they'd come pick it up and pay us nothing.
disappointed in the Judge, she never use to scream and be so damn rude to these people.
People attach sentimental value to items vs being subjective about what they’re actually worth. And want to yell you down when it’s not worth what they think it is.
