That is the question the justices of the U.S. Supreme Court will consider addressing in Serrano v. Customs and Border Patrol, a lawsuit appealed by the Institute for Justice (IJ) on behalf of its client, Gerardo Serrano, who had his new truck taken from him at the Mexican border in 2015.

    Don't limit this to just vehicles. Pursue the general tenant of this unconstitutional confiscation of private property. Our tyrannical, bureaucratic government is out of control.

      I'm guessing that either that's tied in,or if they win this one they plan to use it as a springboard for further action on civil forfeiture abuse. Although personal I would like to see civil forfeiture almost gone completely.However any step in the right direction should be helpful in a few different ways. Hopefully helpful in getting the next step.

      I understand Both sides as to why this happened. Even though I totally do not agree that US Customs should have the right to seize his truck for 5 bullets without a gun being there, the agents also are on Alert when anyone takes pictures of them. See the Cartels Threaten every Agent and getting pictures taken of them is a huge no-no! Those pictures usually end up in the Cartels hands and they then threaten those Agents families in the US. So I do not agree for his truck to be taken, but there should have been an investigation into him and possible Cartel ties.

Not saying US citizens can’t be working for the cartel, but that’s a very far-fetched justification for violating someone’s civil liberties. Not only was it an unlawful search and seizure (taking pictures is not illegal), his right to a timely hearing was also violated. By your logic, anyone with an Italian last name can be in the mob and I can arrest them and use civil asset forfeiture because they *might* be sending those photos to hit men.

      When you enter a country you deal with the agents of the government on whose soil you will walk. Taking any ammunition or guns into Mexico is a very serious offense. It appears the US side had screening to see drug money was not being carried in. This fellow was lucky he just lost his truck. Mexican prisons are no fun at all. Two years is pretty quick to get out after being found with loose bullets; he would have no use for his truck in prison.
      A remarkably bad effort for the Institute of Justice. Usually their videos are very good; this one was not.

      @@jstenberg3192 Qualified immunity for police officers has been getting a lot of attention lately but equally or perhaps more disgusting is how much spiteful and illegal conduct occurs inside the District Attorneys office by prosecutors also protected by qualified immunity. The Border Patrol seized the vehicle but the lawyers are the ones who use every available tactic to make the process to reclaim property onerous and expensive, intentionally, with the direct purpose to deprive citizens of their valuables.

    I have been stopped by CBP while driving a Govt. vehicle and in full military uniform (U.S. Army) and was detained while they searched the car. This was in SoCal picking soldiers up from the airport in Las Vegas. They didn't like when I told them to get real police and refused to answer any of their questions.

      Mexican agents enforcing Mexican law on Mexican soil. The video failed to mention that; when you enter a country you deal with their border agents, not the one you are leaving. The man was very lucky he was not imprisoned for years in Mexico; others in the same situation have been.

      @@flagmichael in Jamaica a spent cartridge will get you in prison. In Kenya you can't have a knife (I and my partner carried machetie), firearms possession in Thailand is the death penalty. Bribes seem to work. Side note: dealing Mexican customs, I heard impeccable English. With American and Canadian, some could barely annunciate clear American English. I greatly impressed German Federal police when they strip searched me and noted my language was so good they knew I German but my passport was American. Now, years later, I hardly know the language. Right now I can't say you won't find ammunition in my truck. It gets stuck and lost everywhere.

    I have known Gerardo for many years. Not mentioned: His truck baked in the sun on the Mexican border. The paint was deteriorated, the battery was dead, and the tires were flat.
    It was a pickup truck from Kentucky. Of course there were loose rounds of ammunition rattling around in the cab. Given the current cost of ammo, I should see how much loose ammo is under my truck seats.

      Yes you should. I bought a house in wisconsin 2 years ago and in the attic space someone had forgotten tons of ammo. I couldn't use alot of it, so my family got a good large box and a half. Also there was a box with a kit the make your own shot gun shells I really want to learn how to do. My grandfather use to make his own, wish he was still alive so I could bug him. I don't know why I'm telling this story but it was neat to find a treasure and it was ammo.

      @@williamhouseholder1558 - I reload my own ammo. I even have a RUclips video demonstrating a Lee 12 gauge shotshell reloader.
      I first encountered Gerardo when he called on his way to a TV studio with his county sheriff who was doing a CNN interview after taking a spontaneous pro-gun stance against federal anti-gun tyranny. A mutual friend told Gerardo that I was the "gun guy" in our local liberty group. 😃
      Gerardo is a good guy, and I'm glad he and IJ are fighting this pernicious asset forfeiture.

    I live a few miles from this gentleman, I had a LEO try to run me over because he wanted my farm and was trying to scare me off.

      Get a couple dozen people together and demand that the chief of that law enforcement agency address this horrific act of aggression.
      No one, ever, in the U.S.A. should ever have to encounter this kind of behavior by a LEO.

      I had two police officers work together in attempt to run me off the road as well in an act of intimidation. Their motive was unclear I suspect they wanted simply to get me to wreck so they could arrest me for some reckless driving or some such. I If I did not have two witnesses no one would have ever believed me. I have had multiple encounters of harassing behavior since and I have cameras installed in my vehicle. Not a fan of Blue Mafia behavior.

      @@wish1012 not in Polk County, FL here of late. The sheriff held a press conference on the 3 deputies arrested for theft of $723. Then the detention gaurd arrested a few counties away for DUI. She is suppended now, but termination will likely be the outcome. We need more higher officials willing to do the RIGHT THING.

No one ever talks about conditions to the other rights. Even on Abortion, that isn't even a right they protect that like crazy.

    It’s long overdue that these forfeiture laws get to the Supreme Court! They should certify this as a class action, declare the laws unconstitutional, and somehow force these tyrants and their agencies to pay restitution!

      Agree, and this is most likely why, when threatened with a class action suit, they caved. If a class action suit ever made it to the SCOTUS, civil asset forfeiture would probably be found to be unconstitutional. That would mean that all the crooked law enforcement departments would lose their cash cow.

That alone destroyed the balance of power between the states and the federal government and turned congress into essentially two lower chambers. There’s no accountability to the state when senators are not subject to being recalled by state legislatures.

    The real problem with civil asset forfeiture is that no charges have to be filed against anyone or anything. I get it that the government seizing the assets AFTER a conviction and appeals is ok, but this is nothing more than the government stealing your property and you have to spend a lot of money on attorneys to maybe get it back.

    Civil asset forfeiture desperately needs to be reformed, as the current practices often violate due process. The onus should not be on the property owner to prove that their property is "innocent." (In some cases, the government doesn't even have to charge the owner with a crime.)
    This practice is especially hard on low-income people who don't necessarily have the means to fight the seizure. (Victims of civil asset forfeiture do not have the right to an attorney to help them challenge the seizure.)

      This is what they do in Colorado. They take property without charging the owner with a crime, then insist that you prove your innocence; as opposed the the burden of proving guilt being that of the usurper.

    Border Agents need to be ONLY at border crossings. I personally have never been through a checkpoint. Allowing checkpoints up to 100 miles from the borders must stop.

    A similar circumstance happened to me 25 years ago while entering Pittsburgh, New Hampshire from Canada. It was horrific. It is not something I, to this day, can take lightly. Sorry for you Mr. Serrano. This is a true disgrace.

    This also affects a lot of other US law enforcement agencies who use civil seizure. The concept of civil seizure started with seizing assets of organised crime leaders but has evolved into a ridiculous situation. The laws for seizure of assets should be changed to require a full court hearing and proof of them being proceeds of crimes before the seizure can go ahead with a court order.

    I witness boarder patrol agents stop vehicles in the middle of the desert miles away from a Californian entry fruit Inspection station (where these vehicles were targeted) Is it a crime to detain people alone - away from anyone (in the middle of the desert) for being precived different or some other State allowed bias (I never knew Boarder patrol could take property) this New's adds light on what I've witness!

      No. The U.S. border patrol can set up checkpoints or conduct stops within 100 miles of both north and southern borders

      and yes, of course the border patrol can seize property if it's determined to be suspected illegal goods, involved in smuggling, human trafficking, etc. etc..
      It's taken as evidence in an investigation and after that investigation either seized permanently, destroyed, or returned depending on the outcome of the investigation.
      And quite possibly some less than honest CBP agents will take their pickings out of seized goods and keep them for themselves, after those goods mysteriously disappear from records. But hopefully that doesn't happen too much.

    Many years ago our family was crossing into Canada in our RV. The Canadians searched it. My dad had two long guns, which they allowed him to keep, but they found some fire crackers (about 5) and we thought it was funny that they took those.💖
