“Interim Democratic National Committee chair Donna Brazile sent information to a top Clinton campaign official about an upcoming a question she got "in advance" one day before a very similar question was asked at a CNN Town Hall, according to hacked emails published by WikiLeaks.
On March 12, Brazile - who at the time was DNC vice chair and a CNN and ABC contributor - wrote Clinton Communications Director Jennifer Palmieri an email reading "From time to time I get the questions in advance."
"Here's one that worries me about HRC," Brazile wrote.
"DEATH PENALTY 19 states and the District of Columbia have banned the death penalty. 31 states, including Ohio, still have the death penalty. According to the National Coalition to Abolish the Death Penalty, since 1973, 156 people have been on death row and later set free. Since 1976, 1,414 people have been executed in the U.S. That’s 11% of Americans who were sentenced to die, but later exonerated and freed. Should Ohio and the 30 other states join the current list and abolish the death penalty?"

Okay, so now I'm in the position of defending CNN and Donna Brazile. It's not something that I particularly like doing, but as you guys yourself say, we're here for the truth, regardless of who it serves or who likes it.
Now, unless I've misinterpreted this clip, the charge of giving Clinton the townhall questions rests on the similarity of the sentence that begins "since 1973." The problem is that 1973 is the universal starting point for modern death penalty statistics, and anyone talking about innocent people on death row typically starts with "Since 1973, 1XX people on death row were found innocent/exonerated/set free" with the 1XX number being updated to reflect the most recent number. So why 1973?
In 1972, the US Supreme Court struck down the kind of capital punishment cases in use at the time (where sentencing was not a separate procedure) with Furman v. Georgia (1972). For a brief period in time, there was no death row as all inmates sentenced to death had their sentences reduced (extended?) to life in prison. The first of the modern death penalty statutes was passed in 1973. These took the form of either the separate trial and sentencing procedures that we are familiar with today, or a mandatory death sentence concerning specific crimes. The former was upheld in Gregg v Georgia (1976) and the latter struck down in Woodson v North Carolina (1976).
If you're going to be arguing against the death penalty, you're essentially going to argue (setting aside the morality of killing) some combination of a) it doesn't do what it intends to do, b) it costs too much, and c) innocent people are in danger of being executed by the state. Basically, you can't frame a question around innocents on death row without some construction of "since 1973, 1XX people have been exonerated..."
So am I saying that Donna Brazile didn't give the question to the Clinton camp? Not necessarily. Depending on the nearness of the date of the email and the date of the town hall, in addition to the fairly specific grounds upon which the death penalty is argued against, it could be argued that any mention of the death penalty by Donna Brazile in an email to the Clinton camp could be construed as a tip-off that the subject would come up in the townhall. Putting on my conspiracy hat, an intentional inclusion of the question with its mention of released persons could indicate that the question would be asked by one such exonerated person--which is something you'd want to know if you were crafting a response.
Conspiracy hat back off, though, if you're basing your judgment on the similarity of the "since 1973" sentence structure found in both questions, well, that evidence is a lot shakier than it appears at first glance. It's less smoking gun and more bog standard. To put it another way, if I asked you to pick a year to frame a question about the Great Recession with, 99.99% of the time you're going to go with 2008; "Since 2008, something something something and now something something something." 1973 is the same thing for death penalty exoneration.
You indeed misinterpreted the clip. The evidence is largely in the subject of the email Brazile sent: "From time to time I get the questions in advance". It's OK that she gets questions in advance? Regarding any appearance? NO! Makes the idea it's all a coincidence far more farfetched an idea. See my two posts a few minutes before yours.
But that's not what Cenk cited when he compared the two questions. And "from time to time I get the questions in advance" is not damning if you're talking about a roundtable discussion. As Cenk points out "can you send her answer on death penalty?" lends further support to Donna Brazile's claim. The idea that it is never appropriate to get questions ahead of time--that's your judgment call and I can't agree with that. There are plenty of circumstances where you want the people involved to know what it is that they are going to be talking about, because no one is keeping score and tallying winners/losers in a discussion. It's about informing the audience.
Again, the point Cenk zeroes in on in the video is the wording of the question. I've argued against the death penalty in a number of forums over the years, and citing the number of exonerated death row inmates is par for the course. I've written lines like "since 1973" or "from 1973 to ". That's why it caught my attention.
Now, in my previous message I stated that the respective dates of the email and the townhall could make the exchange suspicious--and indeed, they are basically a day apart. Donna Brazile did participate in a roundtable the next day, as well, but it was ABC's This Week and the discussion was firmly Donald Trump. If Donna Brazile received those questions for a different roundtable discussion, she should be able to produce the name of the program, the email, or some other correspondence that would show it was a coincidence--even if said discussion was later changed or fell through. As I said again, earlier, I'm not claiming she didn't give Clinton's camp the question early--just that the point Cenk put forward as the bridge too far to consider it a coincidence is, in fact, a very common way to phrase the question.
I would consider the dates more questionable. If Donna Brazile could produce documents showing that she was legitimately going to be asked that question on some show or discussion, then the case could be made that it was at best a coincidence. If not, then it is definitely questionable. But my response was to Cenk's emphasis on the wording of the question, which would seem suspicious if one were not used to reading some permutation of the same sentence in dozens of different places over the years.

"He could not explain how Brazile could have had the same exact language of a proposed question a day before he submitted them to CNN producers. CNN, in turn, is pointing the finger at TV One."

I use google news feed and not once since the last slew of emails has that topic been in the top bracket. I had to search for it in the search bar by topic and then I found it. But it seems that a topic of this gravity would take top slot if indeed news journalism is what we're seeing in the news marketplace.
Where is the smoking gun? I would be surprised if you didn't think people in these news organizations are not connected to politicians. I am more concerned that a foreign government, worst Russia, is trying to throw this election in favor of Trump and it seems people are comfortable with that.
