This is old news. This is still happening?? Recent was just an old man, now a hyperactive teen that shouldn't drink high caffeine beverages. Good grief, I thought they removed this already.

I actually feel bad for Panera. Although I cannot say this for all locations, there are several notices and labels amongst these drinks notifying the consumer of the amount of caffeine they may consume. The odd part is that the college girl knew she had a heart condition, knew her body would have a high sensitivity to caffeine, and knew that the right thing to do was to stay away from a drink called, "Charged Lemonade" or even to at least ask about the product before consuming the entire thing. Do I believe Panera could've done more to advertise the amount of caffeine they were offering? Sure. Do I hold them 100% responsible for the two reported deaths? Absolutely not. Accountability needs to be held not only at the production level, but at the consumer level as well. The college girl was a fully grown adult who could make her own decisions. The fact that she lacks the common sense to check what she is drinking is a shame, since from a legal standpoint, Panera unfortunately cannot form a legal binding rebuttal and unfortunately will more than likely have to forfeit the lawsuit for a specified payout. I also don't blame the families for suing. At this point, with such a rare occurrence, the only thing TO do is to sue the company.

It will FAIL, and these drinks WILL be back, and that law firm had better realize the pressure is soon to be on THEM. ALL these lawsuits WILL fail and the drinks WILL be back in the future in full, original form AND protected, as well as legal elsewhere as well. These cases are setting NO precedents, and FORGET IT if you think such beverages will EVER be banned, now, or in the future, or at the FDA or anywhere else. These drinks WILL BE BACK, and there is nothing these people opposed can or will be able to do to stop it, the demand, or the future. Lawsuits will go NOWHERE with regards to that, and oh YES, these beverages WILL be back in full content and form as well. Sorry to burst their BUBBLES but those are the FACTS, and they are non-negotiable. That is all, and that is FINAL. / . END. /. > . And this comment goes to all those liking and supporting this ban that will NOT stand, pull, as well. Here and everywhere else, as does this post to all stories about this matter. End. /.

FDA is also responsible for this
because they could've put some special warning to prevent this from happening.

those regulations will come when these drinks come BACK, and they WILL, and it will be BY the restaurant. These lawsuits will change nothing, the drinks will be back, with extra precautions, in the future to come and BY demand, too. End.
