- Alex Jones's lawyers sent two years of their client's text history to his legal adversaries during a defamation trial. Lawyer Mark Bankston asked Jones if he knew how he had got hold of the texts.

'No,' Jones responded with a shrug of his shoulders. 'Your attorneys messed up and sent me a digital copy of your entire cellphone, with every text message you’ve sent for the past two years,' Bankston said. He added that Jones's lawyers were made aware of the mistake but did not take any steps to label the texts as privileged information and keep them out of the trial. This is an example of lawyers planning toward a mistrial.
They can’t declare mistrial for attorney incompetence. This hearing is for damages only.

He was not aware of any text on phone of a few years ago about Sandy Hook. Search function only goes so far back in messages typically month or less.

What it means to be caught and strangled by your own BS.
The plaintiff's satisfying grin is unfettered, dopamine-filled glory.
Considering a lawyer faces disciplinary action, up to suspension or disbarment when they condone their client lying under oath...and fail to address it...I'd say the lawyer was abiding by the ethics of his profession and the law.

Jones' lawyer has potentially breached client/attorney privilege and highlighted that he had material it was thought and that he previously suggested Jones couldn't find or which only existed in partial form. He actually sent a small mountain of mixed material.
He also managed to send medical and psychiatric records, which the plaintiff's team immediately recognised as confidential over and above privilege and destroyed.
Jones' lawyer is either totally incompetent or trying very clumsily to trigger a mistrial by using his own stupidity to accuse his opponent of misuse of material, a lot of which he should have handed over in the Discovery phase anyway, but didn't.
I don't buy that because if Jones' attorney knows that he lied, they can simply inform the court. There is no need to release a mountain of evidence "accidentally". However, the release of such evidence only shows that the attorney knew he lied but failed to inform court directly. There is now more of a case for disciplinary action.
@@ginskimpivot753 he cannot trigger a mistrial in a civil case. Nor would he be able to sue for malpractice either. Civil cases are different from criminal.

I don't think the attorney mess up, I think he purposely violated attorney client privilege just to get back at his client, there's not way a error like that is going to happen by mistake.

Lawyers have a duty to let courts know when their client has lied under oath, but a lawyer could simply inform the court without breaking privilege.

While this is hilarious, Jones may be able to go for a mistrial and sue his lawyers for malpractice
A mistrial only happens if a witness is discovered to have lied. Other events can lead to a retrial, but given he's under oath, the disclosure is factual, it's his testimony to the contrary which perjures, and that's entirely of his own doing. And he can't even sue, or every loser of a civil case would.
Nah, I’m pretty sure because it’s all fact it can’t go to a mistrial. Not 100% sure but I’m going by UK court practices.
He could theoretically sue for malpractice, but there’s no practical benefit to him doing so. Plaintiff’s attorneys have already indicated they intend to go after any judgment he might win as assets to pay the damage award for this trial
