That’s cold that he’s doing that to customers. I’m a mechanic and would never cheat someone like that or any other way. If anything I’ve been told many many times I don’t charge enough.
This guy seems to "think" that he does not have to listen to a small claim's judgement. He knows that his victims will not seeks attorneys to enforce those judgements because of the legal costs to his victims. In my opinion, if the county can see a pattern of fraud, which the over 100,000 in judgements would be strong evidence to support this pattern. The county district attorney's office should have enough probable cause to file criminal fraud charges against this person (depending on the state's penal code laws). This is a very sad story of a criminal who is taking advantage of people. However, each state does have their own rules regarding civil procedure. I am certain that there are ways of enforcing judicial judgements like writ of execution or liens, exc. I hope his victims get justice. Disclaimer: this is not legal advice.
I've put one DA out of a job and am now going to have to go after judges... judges are literally working for a corrupt Private Operating Foundation, a mere Trust with SAM Identification number to contract with states as a governing body to uphold the constitution, though they operate in treason to profit through corruption. Courts now have a pander bias checking council that can alter and or erase judgements however.... everyone knows that Money is king in Court. ask any lawyer, ask any judge worth his or her salt and they'll agree.. the only way to stop the corruption is to hunt and expose the money flow and distribution thereof to "stake holders" within the trust organization...dissect their fee schedules and then whoop ass publicly.
Who pays for auto repairs up front? When I was a mechanic I did a lot of side work for cash. But I didn't expect payment until the car was finished. Maybe once in awhile on a big job I would ask for some money to cover the parts or have them get the parts themselves.
We had a similar problem. We got out 2017 Kia Sorento from the repair shop after it was in an accident but then I noticed that the crack that was the windshield was fixed and were forced to pay $500 to the mechanic just to get our car back. Our Car Insurance is looking into what went wrong.
According to estimate law they are supposed to give you an itemized estimate and log of repairs for anything exceeding $20 and are not allowed to exceed that estimate by more than $10 or 10%, whichever is lower yet most of them think that it means whichever is higher and that's not the case. An example would be if you had an estimate bill for $75 they can legally only charge you an additional $7.50 or 10%; if your estimate bill is over $150, they can only charge you $160 because it is 10% or $10 and since 10% would exceed the $10, they can only charge $10, same if your bill is in the thousands. If they give you an estimate for $3,000; unless they call for your consent to do any other repairs than what they estimated, they may only charge you $3, 010. They also cannot force work to be done and refuse to release your car; you will have had to give them consent for any additional repairs. If you did not authorize that windshield repair; they had no right to fix it or bill you for it. And they definitely not going to be able to keep your car for it. You have a lawsuit my friend. It's also illegal for them to put a lien on your vehicle or property for unauthorized repairs either. they can only have a lien on your property for authorized repairs within their estimate if you refuse to pay. And even if you did refuse to pay they cannot hold your vehicle hostage as the value of the vehicle is worth more than what you owe them. They would have to go after you in court just like you would have to go after them in court. They cannot willfully hold your property from you. Yes you would have to make a police report and then take it to court to get a signed judges order for them to return your property which could be a pain in the ass, but legally they have no right to hold your vehicle. When you go in for repair you are not signing over ownership of your vehicle and if they try to have you sign an agreement alluding to such it should already tell you that that's a red flag and you shouldn't do business there
Gonna go thru this soon. Took a truck for a ticking and misfire issue. 5 month and 3000$ later got it back with a ticking and misfire issue. What helps is that I never signed or was given any paperwork whatsoever
I have a question, I'm live in Delaware and went to a car shop for a repair...I need a new bumper for my 2013 buick lacrosse, the mechanic charged me $550 to place a order for a new bumper and to have it painted, once it would arrive he said within a week all I'd need to pay was the labor fir them to install my bumper, that was 8 weeks ago...all I have is my bank statement of the $550 payment and a text message from him on April 11th stating he was expecting my bumper in a week.
