      It all reflects on the leadership, or lack thereof. The same when an officer spews BS for 10 minutes, then the sergeant comes out and let’s everyone know they have done nothing illegal. Why do the managers keep that info to themselves? It makes them feel more valuable, regular officers are on a need to know basis.

    I've never heard a cop admit its a slow day and that's why several units respond. I bet supervisors flat out tell them to never say that kind of stuff, makes it hard to justify officers and their bloated budgets.

    Another reason not to talk to cops! He was trying to get you to admit that you had been asked to leave so he could arrest you for trespass. He was asking you for information that he could use against you.

    The officer was attempting to use Grahm vs Connor (1989) as an excuse to force you off the property. The Grahm decision was made to give LEOs some safety in determining legal actions while in the field and in a time-sensitive situation. This encounter was in no way time sensitive and the officers should have deferred making any judgment without consulting the DA’s office.

    Seen a lot of these by auditors now. I've never noticed anyone recognize that the common denominator for ID'ing a return trespasser could be/should be the property agent that demanded they leave. Police do not need to ID a person, if the agent onsite can ID that same person at a later date for the 2nd or criminal trespass.

    Gray had no interest in a conversation or an education. He wanted that ID and was going to twist the verbage of the sign to get it. Luckily the other cop stepped in and said, "Gray, we have that ID we confiscated last week still in the evidence room. We'll go back to the station, cook it up, and get you that fix you're craving. You don't need to get Captain Awesome's ID."

    Unfortunately, some jails in the US are privately owned. Is it the case for this one ? We don't know for sure.
    More research into it would have been necessary. Maybe only the parking lot is privately owned and operated. We don't know. By the way, you were about to give up your ID without the clear threat of arrest. All the cop said is "it's a possibility, I am trying to avoid that".

      @allemander just my opinion, but a bartering system or volunteerism would solve a good majority of the issues.
      A 3 part Apologies or Discipline system would also help.
      "time out" until they can express:
      1: What they did & why it's perceived as wrong?
      2: How & what they can do to "repay their debt"?
      3: What options or actions can they take next time if they want or need the same things or end up in a similar situation?
      Only after these 3 steps are completed; can the offenders apology really mean anything.

    The property is owned BY the People. The property is also funded by both State AND Federal funds. Officer/Tyrant/ Bullschidter Gray needs an entry in his Jacket(Personnel File) at the very least.

    I don't know about the rest of you, but I am getting extremely worried about so many foreign cops in this country! These people don't know about nor do they care about US rights. Usually, when they bring in imported cops, they have no skin in the game when it's time for the BIG SHOW.

    A "reasonable person" would conclude the first officer is halfway decent. I figure he'll likely be fired before long if he has to work around tyrants like Pig I mean, officer Gray. I love how he's trying to set up his court case with this "reasonable person" language. I have a sneaky suspicion, Pig, I mean officer Gray is a dangerous one. Or, at least a "reasonable person" would believe so.

    I think what that sign means by "Private Parking" is that the parking lot is only for vehicles that are visiting that building.
    Not for a vehicle to be parked there and the people who parked the car leave the property to go someplace else like a neighboring business. Not for it to be used it as a public parking lot.

    If you take them to civil court and file a lawsuit against the City , the Department and most importantly the officer himself for violating your rights (cause for forfeiture of qualified immunity) he will learn . . .the hard way. But even more importantly the rest of the officers in that department and maybe other departments will hear how one of their fellow officers had to personally write a check to a law firm or had a lien attached to his pension , the more officers that hear that hopefully they'll be more careful with trespassing on public property in the future.
    Hopefully officers will learn from other officers mistakes.

    Wow I didn’t know there is a such thing as “private PUBLIC” property. I know on public property, one CAN NOT be trespassed unless a law has been broken or if one caused a disturbance. On PRIVATE property, the owner can trespass anyone he/she wants at anytime for anything. Big differences of the law between the two.

    I enjoyed your encounter with Officer Shipana. He had a common sense and a good sense of humor (7:10). Up until Officer Grey came in and took over Mr. Shipana's investigation. Even though he was wrong about the sign, he kept fishing. Kudos to the mysterious officer that pulled Officer Grey to the side and put him in his place (13:20). Lastly, well done Captain Awesome!

    A reasonable, although ignorant on the subject, person could indeed infer that a "Private Parking Only" sign means it's private property. Reasonable people can infer incorrect things sometimes. That is NOT private property. It's government owned PUBLIC property that WE THE PEOPLE have decided not to allow public parking upon.
    And that's the ONLY thing we have decided about it. We have NOT decided that we can't walk upon it, or that it is in any other way inaccessible or restricted to us, the public. A No Trespassing sign has to say No Trespassing. The notices specifically required by Trespassing statutes do NOT include posting signs that might be inferred to mean this or that. Trespass warning is when an owner or his authorized agent notify somebody else to leave. WE THE PEOPLE own that property, and WE don't request any of ourselves to leave, and WE do not authorize anybody else as our agent to do it for us either.
    Do you get it now? Does the above make any sense to you? If you're a good cop, you won't pull that bullshit again. Actually, if you were a GOOD cop, I wouldn't have had to explain it to you.

    First cop was ok, Gray was very poorly trained on the meaning and importance of signs, the reasonableness standard, the nature of public property, and he was WAY off on the false belief that he had any authority to breach your 4th amendment. His partner saved his ass.

    The fact it takes 1 year as a FULL time student to get a Cosmetology License doing HAIR and it ONLY takes 9 months (some academies less) to supposedly "enforce" the law when many MANY Government, County and City Enties know NOT One Amendment.
    Officer Geay comes over with that TRADITIONAL line, Ah okay this is whats gonna happen BULL. Trying to sound like he knows what hes talking about (Intimidate) by saying more then once the sign says Private parking.
