      I was 70% + TDIU but I filed for an increase and now I am 100% Scheduler.
      My automated award letter still says:
      "'You are being paid at the 100 percent rate because you are unemployable due to your
      service-connected disabilities: Yes"
      Does 100% have that or is it because I was TDIU?

    Filed for aid and attendance and got my neck rating from 40, and 30% to 0%. Still 100% but now have to fight for neck again. Shouldn't never mess with it.

      @markmacaroni7 filed for care taker for my wife since I am 100% p&t. VA told me to file aid and attendance instead, so I did, and VA wanted to do the c&p exam and I refused the neck exam at the time due to pain, and they reduced my claim.

    At 240 total, 100 p&t. The only reason I would file another claim is if my dr found another condition that could be terminal so that my spouse could be more likely to get the benefits when I pass.
    BTW CC, thank you for all you do. I'm glad you are in a better headspace for right now.

      Thank new for everything you do and keeping our better and is updated. Your information is invaluable. Most veterans don't take the time to research study and just depend on the vso. Luckily for me I had a good one. That got me 100% permanent and total they made a mistake and he jumped right on it the day of the finally came in he called for an increase and got me from 90 to 100 but then 10 days of the VAs erroe so keep doing what you doing sir.
      And thank you for keeping us informed about all these acts and bills and how it affects us and changes again the normal veteran doesn't take time to research or study.
      Sad today's veterans populations you got veterans fighting other veterans over benefits then you got ones that don't file.
      Christmas calendar out and we all come from different walks of life and every claim is different doesn't mean we shouldn't help out our fellow man

      Like u say every claim is different every file is different but a set of veterans fighting each other been doing the eyeball test of who's 90 to 100% we should be fighting for each other and encouraging each other sad that only one third of the veterans in the United States are compensated. Cuz the other half don't bother the file because of a lot of misinformation out there and that's where you start coming in. Lots of scare tactics out there too especially those veteran claim sharks

    Had my latest C&P last week. They said it was to be a 7 hour exam. It lasted an hour & a half. Seemed to go good with the examiner. I didn't make any small talk & told them I was having a bad day which I was. The trick is getting a favorable from the regional rater.

    I want that SMC!!! That extra couple hundred dollars will outweigh that reduction to 90%! Do the math folks and don't poke the VA bear!! Stop being greedy otherwise you may be in a world of hurt financially. Love ya brother 🇺🇲💪

    What about the 55 yr old rule ?? All my claims are about 2 years old but I just went over 55 this year. Can they still give me a reevaluation?

    SMC isn't the only reason to file for an increase after getting 100% P&T. It helps for those who choose to live overseas via FMP.

      Those folks who reside overseas, under the foreign medical program (FMP), can only be reimbursed for care for disabilities that they have ratings for. For instance if you live in England and require surgery for a back injury without ever having a rating, the VA will not be paying for any of it regardless if you're 100% or not.

    I filed for the VA 100% 6 mo. temporary post stroke process program n Sept. 23. And have now endured 2 C & P examinations. And as of today I have yet to receive My decision. I challenge anyone to endure a stroke At the severity I endured and be able to Work in the 6 mo. Following the Stroke. It took 3 months to get back to being able to wal again much less Work.

    I’m paralyzed from going to VA. I wake up in the middle of every night going back to Iraq. I sleep in a separate bedroom from my wife because I’m disruptive. But don’t want to be honest about how f-ed up I am.

    Might be worth adding what causes reductions? Meaning random or mostly due to filing for new claims/SMC. What would trigger a static rating to decrease if not for opening a new claim?

    I'm 100% P/T, I'm applying for SSDI and have to see the judge. My VA psychologist will not fill out a questionnaire from my law firm. She says she can't fill it out since it's for social security. That doesn't make sense to me. Anyone else deal with this?

    My claims are all considered "Static", but I'm at 80%. I'm at that scary region. I have additional claims to file because I believe I was underrated for several conditions, and there are several that I haven't made claims for. By the end of it, I believe I should be at 100% service connected; but I'm scared of the risk of filing new claims. Hopefully they won't "find a reason" to reduce me.

      At 90% , hired a law firm for TDIU 100% , law firm filed for higher level review of four compensation decisions - hope they know what they are doing .@@cmrncrick

    Presently 100% P&T with total ratings of 460%. SMC would be the only reason to look at additional claims.

      Tdiu doesn't take into account age. Are you to broken to work? If so, apply for tdiu

    I am 100%pt 100% ptsd. But 2019 I was denied for anxiety n depression but requested a board hearing so I finally got it January 2024 some 5 years later did the hearing I wasn’t at 100%yet. Than I got 100%an March 2024 hearing on the board made a decision in sent my claim back down to the VA I don’t know if they won’t me to have another cnp exam are what are they have all the information they need!! Cause it could be some serious back pay !! What should I do. Sir?

    It just does not make since. I also am at 100% P&T and when I received my letter I was upset concerning my PTSD that they gave me a 0% for. My wife said the same thing CC said. Why? what is there to gain. 100% was the goal and I achieved it.

    I’m 100p&t however I wanted to get a sleep apnea machine if I do get it through the va examination without filing a claim does that open up a claim by itself . Please be kind. I don’t wana file a new claim by the way

      I’m at 90% as well (94% to be exact). Look at possible increases/secondaries man. The magic number to reach is 95%. Google Hill & Ponton VA calculator. Input all your disabilities. It will say your exact %. Then you’ll know how much more you need. Message if you got questions man.

    I’m “only” at 70% for PTSD and what I describe as “every podiatry condition known to man.” I recently asked the VA for a cane because the food conditions are deteriorating. I’m wondering, how long should I wait before going for an increase?

    I'm currently at 91% and it took less than 5 yrs to get here. The bad is I need 40% more but my Allsup attorney said I should wait until my disabilities are past the 5 year rule before looking to file another new claim etc as it would possibly put my other ratings in jeopardy of reduction. So I guess I'm stuck for about 24 months before I look to explore the final leg of the race to the 💯 % hondo club.

      Static means that you typically won't be scheduled for re-evaluation(s). It means too that the VA views the disability as more likely than not to not improve in the future. But the ONLY SAFETY point is after the 20-year continuance of the rating you hold. 20 is really the only protection. Anyone without 20 years is subject to re-evaluation if under the 20-year rule. The VA can review anyone at any time, otherwise.

      If your 90% is solid and whatever you want to claim will get you to 95% or higher then go for it.

      Google Hill & Ponton VA calculator. Input all your disabilities. It will say your exact % you’re at. The magic number is 95%. Which gets rounded up to 100%. Remember every 10% at 90 is treated as “1 point”. Say you’re at 90% exactly. You would need 50% more. Look at increases/secondaries. I’m sitting right at 94%. Good luck you got this man.

    I'm 100% p&t,+ smc- s as of march 2024. Examiner failed to give DTA and lied about not finding planter Fasciitis, clearly recorded in STR's, although they agreed i have it. I cannot walk more than 40 - 50 feet. 3 dr's confirmed. If i file HLR will it expose my current rating to another c&p exam?

    Only last week I was granted 70% for PTSD. Now, I am getting ready to file sleep apnea secondary to PTSD (with obesity as an intermediary). Am I poking the bear by doing this? Does the VA get skeptical when someone files a back to back claim like that?

      That's what I did and it worked fine. The sad part is the extra 50% still won't push you over the top unless you have some other ratings not mentioned.

      I’m in the same boat, I got 2 claims at the very end should be getting up to 80%, I’m about to file 3 more for increase and a new claim. It’s not like they will say hey you PTSD has gotten better in the last 6 months since we rated you.

    I'm thinking and hoping CRSC reconsideration due to rating increase does not count as opening up a claim. I did not fill out a VA Form and it seems to be between HRC Army Command and DFAS.

      Same situation/hope here. 100 P&T and been putting off filing for CRSC since 2018… in my case, the 6 year back pay deadline is approaching in July and I’m still not sure about it. So stupid this is even an issue. Unreal. I also don’t want to go through a whole arm wrestling match with the DoD to prove combat. I have my OER, CAB, and VUA. The 3 year medical board was worse than combat. Monday, I really have to decide what I’m doing. Good luck.

      @@thecptschannel I dont belive filing for CRSC would open up your claim with the VA. Since your application would be done through your service department, it shouldn't affect your VA rating. The service department would just mirror the VA's ratings and award CRSC based on which of your dsabilities are considered combat-related. I understand though why people might want to file new claims when they are at 100% P&T because all of their current claims may not be considered combat-related and anything that is could help in getting a higher CRSC rating.

    I just got screwed on allergic rhinitis. I applied for headaches secondary to AR, but instead, in between the time I filed and my C&P exam, the VA diagnosed me with Migraines secondary to sleep apnea at 30%. That took me to the very important 95%. But guess what? They reduced my AR from 10% to 0%, dropping me back to 94%.

      ​@@jaybrown2348 So did I, but I found out that's not true. Apparently, they can lower it to 0%. The odd thing about it is that they posted the effective date as 1 July 2024.

      Go for secondary conditions like GERD or other things you might suffer from due to long term medication use to control pain or other conditions. This is what it took for me to go from 90% to 100%.

      @@pimpnorris2097 I’ve been waiting on my GERD to get rated for nearly a year now. First they denied me, then on a HLR they found a DTA error. I had my C&P after that nearly a year ago and it’s still sitting waiting on a rating. I call about once every two weeks and they always tell me, “it should start moving soon”, but it never does.

    I thought after you are 55 they leave you alone because unemployable age or something it was reasoned

      They typically won't scheduled re-examinations after you turn 55 but if you file additional claims your file becomes subject to review.
