BOISE - Judge Steven Boyce sanctioned a Mountain Home lawyer Thursday afternoon for filing a late night error-filled motion asking to intervene in the murder case of Chad Daybell.
Boyce told attorney Terry Ratliff he was angry when the motion was filed “and I think I’m angrier now” during the tense 20 minute hearing in Ada County.
Ratliff filed the motion to intervene and continue the trial on Friday, March 29 at 11:42 p.m., just two days before jury selection was set to begin in the case. Several words were misspelled - including “motion,” “continue,” “proceedings” and Ratliff had the case number wrong, according to Boyce. He also claimed three times in the motion that he represented Daybell as his defense attorney, but that was not true.
The filing was entered into the iCourt system on Sunday, March 31 - hours before potential jurors were scheduled to arrive at the courthouse. Boyce, his staff and attorneys have spent the previous week going through juror questionaries in Boise.
“On Easter Sunday, my staff attorney, who had an opportunity finally to travel home and spend Easter with her family after a very long week, was interrupted out of her church services,” Boyce said. “She contacted the court and said we had an emergency. The emergency was we had a motion to continue the trial.”
Boyce had to contact the prosecution and defense and work with court clerks to deal with the motion. He immediately sealed it and a hearing was later scheduled for Thursday. The motion was still sealed as of Thursday afternoon when Ratliff showed up with his attorney, Michael Bartlett.
“While I appreciate the time and research Mr. Bartlett has put into the case, we don’t have a party appearing in this case before me. You are not the defendant, you are not the state, you are not the prosecutor, you are not the defense attorney,” Boyce said to Ratliff. “You are an attorney with a license who filed something asking me to stop this trial when I don’t think you had legal standing to do that…I’m going to tell you Mr. Ratliff, I was angry then and I think I’m angrier now about what you did.”
Boyce told Ratliff he had some questions for him - not his attorney - because he was the one who filed the motion on his official letterhead. Ratliff said he made an error in claiming to be Daybell’s defense attorney.
“This is a template form and I simply forgot to take it off,” Ratliff said. “In the body of the motion, I say I am filing it without permission of the defendant or his counsel.”
Boyce asked who he was representing. Ratliff responded he should have signed the motion as “citizen.”
“You’ve got your name, your Idaho state bar number, your Ratliff Law Office and attorney for defendant. You’re telling me you mistakingly filed something as a citizen and not an attorney?” Boyce asked. “Why were you doing that on a Friday night at almost midnight?”
Ratliff responded that he needed to do something to slow the case down to which Boyce replied, “This trial is scheduled for how many years and you wanted to slow it down the day before it started?”
Ratliff told Boyce he had received calls from defense attorney John Prior about possibly helping in the case but admitted he was never retained as counsel. When Ratliff mentioned he wanted to intervene as “citizen at large,” Boyce asked why he filed as an attorney. Ratliff responded that it was semantics, to which Boyce interjected.
“Whoa - let me stop you there. It absolutely is not. A bar-licensed attorney filing something with their bar number is completely different than a citizen. That is not semantics,” Boyce said.
When asked to explain the misspellings and errors, Ratliff said he was nervous, it was late at night and he “didn’t take this lightly.
“You didn’t take it lightly but you used the wrong form, you misrepresented if you were an attorney or a citizen and you signed three times you were an attorney for the defendant,” Boyce said.
The judge ruled Ratliff violated the Idaho Rules of Civil Procedure and sanctioned the attorney. He was ordered to reimburse the defense, prosecution and court for time spent working on the motion.
As Bartlett asked to interject at the end of the hearing, Boyce said, “You may not. I’m done with this issue and I’m done wasting time on this issue in the middle of a capital case. We’re done. We’re in recess. Period.”
Bartlett and Ratliff had no comment.

Judge Boyce was not playing around, my respect for him just went up 10x
💯 THIS!!
Same
He is not a good judge, look at the delays, about time he actually gets serious about this case, everything is sealed, secret, the public has a right to know....even his broadcast is pathetic, not to mention the sound quality.....
@@LiberaTeTutemetExInferis have you watched his speech during sentencing for mrs Daybell Cox? he was good. He never gets emotional during trials, he makes sure everything'll stand during appeal. That sentencing and the closing at this hearing are the only two times I've heard him emotional. You're totally right they do sound via potato, it's terrible.
I was extremely proud of the judge the way he handled it.
I thought solicitors and lawyers had to be intellectual what happened to this man.
Surely attorney Ratliff was intoxicated when he filed this motion…
Ya think? 😂🍸😉
Exactly.
Too many bong rips last Friday night fer sure!
No wonder there were so many mistakes!
Perhaps intoxicated when filed and in court? What the heck was that crazy?
So nice to see a judge control the courtroom. Clear, concise and authoritative.
He should help Judge Judge in Moscow
What in the Sarah Jessica Parker is going on with him?!?!
Was it a late night drunken stuper???
And he does it with calm respect for everyone. No temper tantrum like some Judges.
anyone feeling like a failure at work today, I present to you a new benchmark.
Lmao!!
Right!! It was a complete fail!!

Too true!
And I present to you, one of my new fave RUclips comments of all time. 🏆
Absolutely wild. My respect for Judge Boyce just tripled.
He’s authentically PISSED, enough to call out all the spelling errors! 😂. I absolutely love this judge!

Ratliff doesn’t have a chance against judge Boyce. Notwithstanding his stupidity.
Just a useless old drunk

The audacity of that man! SMDH
"A civil person who is an intervener?" Seriously?! Pryor must have got Ratliff drunk first and then let him sign this error-ridden nonsense...
I thought he only had Prior with no money for any other lawyers
Notwithstanding?
"Judge, if I may-"
"You may NOT."
Drop the mic, Boyce! He needs a vacation asap 😂
Ha, that was my favorite part. 😂
I would personally donate to this cause!
WHY would he file this stupid ass motion?? He's not even affiliated with this case!
Hoping to delay the case and cause chaos. Judge isn't having it.
Trump Lawyer tactic.
I keep wondering if Prior is behind it.
Some people probably think Lori Vallow is a martyr and Chad Daybell is a God 🤢
Early onset Alzheimer’s.
And the award for America's Dumbest Attorney goes to...............
That would be hard, trumpos attorney's surely have won for the most numerous disillusioned silly motions. Trumpos trying for the 10th time to have his case dismissed is surely in the running.
You need to amend this to "the 4th dumbest...." theres 3 trump ones ahead of him, Habba, Keise and the other one. 😂
This is why I couldn’t work in a courtroom. There is so much waiting around , then hours of people who don’t know how to follow rules , both people, and lawyers!
This guy ( lawyer ) must have been drunk & got what he thought was a great idea to slow the trial down for his friend Pryor. I wonder if he did this on his own ,or had someone tell him what to do . This is crazy !
this is one for Scott Reisch.
Bad speller on ordinary words too.
The Judge gave Terry Ratliff heck. And didn’t let him get away with nonsense
The guys a NUT! Im not a paranoid conspiritor, but this could be a set up by Chad's attorneys or a family member as a last ditch effort to delay the trial. How much was this guy paid to make a complete ass of his self??

This attorney, Ratliff, said Daybell's attorney consulted with him? Wow.
He all but said, "DUDE! Were you drunk when you wrote this????"
I know! That's what I was thinking!
And his response was that he was nervous? 😂 what the… ?
@@kateashby3066 Bizarre!🤪
He could have said that and maybe he should.
That's my thought. He might have been drunk
This is one of the best pieces of judge vs ‘attorney’ that I have ever seen. Judge’s actions and comments are perfection.
In Feb 2020 Atty Ratliff received a State bar reprimand. Admitted he violated Idaho rules of professional conduct 1.7 (conflict of interest) and 1.4 (communication)
Not surprised there. What does being nervous have to do with making all those errors? Because he knew he was barking up the wrong tree!
Why does the standard form contain so many typos but already have your name tied to it?
@@ExcrementalDisplaySurprised he didn’t come up with someone fraudulently submitted this on my behalf. 🤣
@@ExcrementalDisplay LOL
He has it as a template on a computer, when creating and submitting the attorney doesn’t need to create the “form” to file a motion. Auto signature functions automatically listing BAR number etc.
Can’t hear Ratliff but heard the Judge loud and clear… CONGRATS
You can’t hear him because he was crawling under a rock to hide from the judge 😂
Unfortunately, the portion muted was the explanation for the motion. For those of us who don't follow every minute, it's disappointing.
I think it's Bartlett speaking when it's muffled.
How annoying that we can't hear the argument properly. I had to put subtitles on but it said he was singing and music playing 🤦♀️😏
Ratliff has no standing to submit and argue a motion on this case. Ratliff was blathering about his dang motion, as if his motion in and of itself somehow gave him standing. Judge was not going to allow that garbage into the record.
I could NOT be more impressed with this Judge and how well he expressed himself
love how he read the spelling mistakes into the record
@@bumblebaa2327 and then he added into the record that he had the wrong case number as well😂
I’ve never heard of something so bizarre! And how freakin’ important do you feel you are that you basically appoint yourself as an intervener in a matter that has absolutely nothing to do with you?!?
but my friend Prior said the judge was a meanie, I had to protect him. Also alcohol on a Friday night.
Judge Boyce just schooled both of these clowns. Play stupid games win stupid prizes. Judge Boyce is savage and I’m loving it.
It will take a savage judge to control what could easily turn into a circus for a trial. What Daybell and Vallow did is clear enough. Why is where the real crazy comes in. Lori has had her day in court. To the best of my recollection, Lori was never present or even close by when her husband was murdered, when her children were murdered, and when their remains were desecrated by Daybell. And Daybell had a direct hand in the death of his wife.
WE ARE DONE! PERIOD!
So who is this clown? He was seeking simply to slow the very slow trial down even further?!? It reeks strong of this attorney is actually a Daybell supporter, one of his fringe followers.
I agree😂 He definitely drank the cool aid.
@@sophiesimonesolomon6427 nah more like vodka or 78 beers 🤣
@@backwardscarrotthat’s the thing that is a bit unusual. The brief appears to have been written while intoxicated, but if he is a Daybell follower, he’s almost certainly a Mormon who doesn’t drink.
Or a Prior tatic
I smell a trick from Pryor. This guy did not do this out of the blue.
John Prior was definitely squirming while Judge Boyce was dealing with this seemingly ridiculous filing.
Ratliff mentioned that he was contacted by Mr. Prior.
What is their connection?
Whackadoodle should be disbarred.
This was so bizarre. I'd bet anything that motion was filed after lots & lots of liquor was consumed.
Yep. And who know, maybe more than just alcohol! This would require one to be completely blitzed.
he looks like it...
Hats off to the Judge! it was embarrassing to listen to this attorney.
Just a useless old drunk
The professionalism and patience of Judge Boyd against the clown standing and stuttering before him is mind blowing! 👏🏻
That was crazy!! Judge Boyce was so patient.
I don’t understand why this was even allowed to proceed to court.
Because it’s a death penalty case and it was filed as an emergency motion by a certified lawyer, so the court MUST take it seriously, specifically bc a man’s life is at stake that this case be done 100% by the books. And it all turned out to be a ruse! Dummy just out his license on the line. He won’t lose it BUT it will go in his record and if he keeps doing this crap he could if the BAR takes it up
@@kateashby3066 Thank you for that reply. I agree. On another matter however, may I please ask your opinion as to why he even did this in the first place. I'm at a total loss as what he's trying to gain. Thank you for any input. Signed, Dumbfounded. 😅
@@peachespavalko1980dont even try to understand. There is not a logical reason why the heck this Looney lawyer did this. Thats why the judge is so mad
He said that he had spoken to the defense attorney. It wouldn't surprise me if Prior put him up to this to hold up the trial, it back fired, and for whatever reason, he's not implicating Prior.
The judge had to respond because this goofball signed it as an attorney for the defense. That just couldn't be ignored or we all know it would be in the inevitable appeal Chuckles and his attorney will file after his conviction.
Good job making a complete fool of himself and guessing the bar will be notified...
Bet they have watched and did take full notice of what happened there
This guy should have reconsidered this motion until his blood alcohol returned to 0 !
Yes exactly! This screams drunk text… but it’s not a text, it’s a legal document you uploaded to a court website.
Right! This was so out there and he will reap the consequences 💰
He should've just texted an ex like a normal person, instead he filed an entire motion!

I wonder how many drinks Ratliff had before writing the motion. What an embarrassment.
Now we know what Judge Boyce does when his patience is exhausted by a fruitcake masquerading as a pretend attorney!
He’s a very real attorney tho, just not in THIS case 😂
poor judge was steaming while researching case law he knew he had to throw at these guys. Knowing he couldn't scream at them irl.

Sleazy, Unethical Lawyers. Ratliff should be JAILED.
And that goes for Ann Taylor too!!
Yikes!?!?! Is this guy really a lawyer? He doesn’t seem like he knows how laws and courts work.
Scary he is and he actually has other sanctions...I'd imagine business is really going to take a turn for the worse for him as you have taken to a national stage and a Judge called you out on so many egregious acts along with not even being able to present to the court a more eloquent way of why he filed under his bar number. No way would I want to hire him because apparently he seems to not understand motions or protocol

This was amazing to watch
Wow, so I can randomly file motions to disrupt cases and piss off judges and get sanctioned? I did not know that.
Nope! YOU can’t because if some rando did this they’d toss it in the garbage. But if a certified lawyer does it under an EMERGENCY MOTION with their bar number on the letterhead, they can do it and then take a beating for it by judge B later 😂
Doofus Ratliff filed under emergency motion, which he declared on the filing, the court (Judge, court staff, law clerk etc.) have to respond to the motion. That’s under proceedings and statute blah blah blah. Not responding would give the filer (Ratliff) or the defense (Prior and Daybell) cause to get attempts for recusal or mistrial or disqualification. Ratliff was backpedaling cause he filed as an attorney ( under his BAR number ) representing Daybell, which he was not the attorney of record, that it was an emergency filing, and the filing was an unmitigated mess. If he had filed as a private individual, hey “I’m Blah-Blah Ratliff” the it would have been addressed and 99.99% denied.

judge Boyce is a bad ass
What in the hell is he trying to pull? Is Prior trying to pull something nefarious, or is Ratliff just crazy? The whole thing is just bizarre.

I bet you’re right on that one. He had to have been pretty out if his mind to try to insert himself in this trial. I still don’t get what his deal is. But I thought that the judge handled it very well. I would probably be yelling at the guy, which isn’t a good look in court! I thought that the money sanctions were very fair. They ALL do this crap, remember, they're practicing 😆
This isn’t enough to get disbarred. Wasting the courts time on its own isn’t egregious enough. Judge is pissed, rightfully, but handed a pretty reasonable sanction of him paying everyone’s fees whose time he wasted. Probably should’ve had to pay more than just lawyers fees, but still.
The thing is, the lawyer doesn’t appear totally incompetent. He’s received some awards. But then he’s also received some disciplinary action for handling of defense cases. I really want to know more about this guy, because I feel like you could find real dirt that should get him properly disbarred, but also maybe he’s just made a couple really egregious mistakes and is normally an ok attorney. Or maybe he’s just good at trial advocacy and should never be allowed to draft motions on his own. But yea, this, on its own, probably shouldn’t make a dude lose his entire job and ability to practice law.
It WILL go in his permanent record. But if this is a first time he’s not gunna lose his license. If he keeps it up… yes
