  • This I know will be an unpopular and unpleasant topic but needs to be addressed. On January 31st The ATF published the ruling relating to pistol braced equipped firearms, there is up to an estimated 7 million of these. That is a large number that are all affected and could potentially make felons out of Americans who own these items legally, were purchased legally and are subject to this new rule. We talk about the rule, what it affects, and the remedies one has available.

    This is ridiculous. There are enough braced AR's in country to be considered "in common use".

      Your right. They make rules and regulations and are allowed to do that as Congress gave them that power through the Administrative Procedure Act (5 U.S.C. § 551). The rule or regulation carries the same force of law it was written to implement or interpret.

    If the EPA can’t do this, neither should the ATF. Allow this to stand and it opens up a way of circumventing Congress by other agencies. This is overreach by the executive branch.

    I just got back into firearm ownership this past year…various firearms, CCP, etc. This was the most informative discussion I have found on this ruling. I no desire to have a brace, but your point is valid for places that can’t have SBRs. I now live in VA. I have an MSR and want to get a 300 blackout upper (shorter barrel) and a suppressor. Probably this Xmas or next Spring. Thanks so much for the content.

    This rule is patently unconstitutional in light of NYSRPA v Bruen.
    It will be a historic miscarriage of justice if it is not vacated, or at the very least, enjoined.

    It’s just ridiculous. All these products go through an ATF letter process before they even manufacture them. I wish I could think of anything product wise, but I can’t.

    Deputies aren't the only law enforcement out there. Also, sheriff depts usually don't enforce federal law.

    Per the following court decisions I see alot of illegal laws. Congress does not have the power to pass laws that override the Constitution. (Marbury v. Madison, 5 U.S. 137)
    2. It is unconstitutional to require a precondition on the exercising of a right. (Guinn v. US 1915; Lane v. Wilson 1939)
    3. It is unconstitutional to require a license, i.e., government permission, to exercise a right. (Murdock v. PA 1943; Lowell v. City of Griffin 1939; Freedman v. MD 1965, Near v. MN 1931; Miranda v. AZ 1966)
    4. If the State tries to convert a right into a privilege, the citizen can ignore the license and fee and engage in the right with impunity. (Shuttlesworth v. City of Birmingham, AL 373 U.S. 262)
    5. It is unconstitutional to delay the exercising of a right. (Org. for a Better Austin v. Keefe 1971)
    6. It is unconstitutional to charge a fee for the exercising of a right. (Harper v. Virginia Board of Elections 1966)
    7. It is unconstitutional to register, i.e., record in a government database, the exercising of a right. (Thomas v. Collins 1945; Lamont v. Postmaster General 1965; Haynes v. US 1968)

    I also don’t realize why this ruling is even in place. I keep seeing these rules more impacting to legal firearm owners. We need better rules for who can/should have a gun and agree on what those rules should be.

    Wasn't the original like 293 pages? Sorry if you say it near the end. Were the pages in the announcement just pictures and those are separate from the total pages? Or did they remove a bunch of stuff from the published rule?

    none of the laws make sense. a brace is illegal but a regular stock is not? Whey do they care if a rifle is 16" or 14"? $200 in 1934 is = to $4200 now.

    Hey Dave, I may have missed it, but did they say anything about just a buffer tube with a foam sleeve?

      The buffer tube is currently in debate as it is still “readily” able to accept a stock or brace

    If one was to go the route of Form-1/SBR-ing their firearm, would this SBR would have to be owned "individually" or as part of a "trust" like suppressors or other NFA items. Correct??

      I’m not a lawyer, so don’t take this as legal advice, but there is mixed information. My best suggestion would be to use the E form application and try to proceed as a trust if that is something you are interested in.

    how do you find out how many hand gun extensions were sold? did you really think millions? I cant imagine that while short rifles are considered illegal a handgun made into a short type of weapon would have a different result. why would someone think that?

    If it's illegal to make a pistol out of a rifle, isn't it illegal to make a pistol out of an SBR (rifle) by removing the brace? ATF makes no sense!

    Why the ATF thinks they need to regulate the length of barrels on a firearm and what kind of stocks they can have or not have is a mystery to me anyway.

    If you read the document... the department disagrees with every objection... and makes it a felony... These rules were made without a vote of the people... Or their elected representatives... Taxation without representation.... 2nd amendment shall not be infringed...

      Check the Yankee Marshals videos and the Texas gun vault videos they explain it pretty well. Basically 922r applies to importers and there's really no way they can determine exactly how many US made parts you have so you should be able to. But do your homework and consult a firearms atty if you need to

    When the ATF makes laws, and congress agrees they make laws now because of some new bill they passed into law stating the ATF makes laws now, ill buy into it. Till then, they can GTH.

    Yes we all know about the brace but let's talk about the vague language involving buffer tubes and the surface area issue or having the ability to shoulder the firearm in their wording so where does this leave AR pistol owners who never owned a pistol brace but just have a buffer tube

    Question for you: you are a police officer, or a former police officer based off of the patches behind you, so would you not have backed up an ATF agent who is executing a warrant based off of these kind of things? Would you have refused to comply with a superior police officer in your organization who ordered you to arrest someone for having an unregistered NFA item?

    I think as far as firearm dealers go I think they'd be better off getting a bunch of cheap yet alright quality 16 inch barrels and paying someone to change out all the barrels. I may be underestimating the cost of labor to change all those though. I feel like the AR pistol market is going to be much less lucrative after this. I just don't get what the point of an SBR law is since if criminals want an easily concealable firearm they'll just buy a handgun. I doubt this law will make a single bit of difference in anything other than restricting law abiding citizens.

      @@bryansloan8417 from another video of someone who went to a seminar the gun needs the buffer tube to operate it is not a support piece so removing the brace makes it legal. BUT do not store the brace anywhere near the gun or it will be considered a SBR that was taken down.

    I live in a 2nd amendment sanctuary state!!! And 15 year veteran police officer and no SD or PD is going to assist and fed bois taking firearms from law abiding citizens!!!! PS in the state I live in a private citizen can use deadly force against any LE attempting to make an unlawful arrest, just saying. Semper Fidelis and SI VIS PACEM PARABELLUM!!!!!!

      Not a lawyer but I would say unless you already have a braced firearm they're gonna want the 200 and you can't build it until they give you permission like the normal rules.

    Luckily this doesn’t apply to people in Oklahoma. Oklahoma is a second amendment sanctuary!!! No law enforcement agency in Oklahoma will enforce this unlawful rule from the ATF.

      This will be first major test for the Oklahoma 2A sanctuary law. Some sheriff agencies including Oklahoma county and Tulsa County have said they won't enforce it.

    All you have to do is take the brace off that's all that needs to be done and make sure the barrel is not over 10 1/2 inches or fill out your form 1 and then you can put on whatever type of stock you want. You have 120 days to file form and the fee for the tax stamp waived. Supposedly there's stuff in the court that was filed to overturn this ruling as well as some other b*******. If I were you I would take advantage of the free tax stamp so then that way you can have a short-barreled rifle legally and comfortable for you to shoot. I'm registering three of mine and helping a buddy register his cuz the tax stamp is free right now

    Braces do not have to be destroyed! Braces are legal. Dealers will not be able to sell the brace with the firearm. This would be intent. Again, braces will have to be removed but not destroyed.

      Yep, same as buttstocks. You only brake the rules if you put them on without the stamp. You can have 100s of them as long you dont get COUGHT with either in a shorted barrel.
