*UPDATED! Dodge Charger flees from Trooper, but is spotted moments later. Same Charger?

    UPDATE 08/14/2023: The report has been released:
    I observed a matte gray Dodge Charger traveling at a high rate of speed westbound on U.S. Highway 412. I activated my front
    antenna of my radar and the speed quickly climbed from 92 to 98 miles per hour (MPH). I entered the median to turn around
    on the vehicle and as I was turning around in the westbound lanes the vehicle accelerated and I called pursuit. The vehicle
    continued at speeds over 100 MPH and I attempted to keep the vehicle in my sights. When approaching the light at Sonora
    Rd. I lost sight of the vehicle and continued westbound in case the vehicle took a side road. Sonora Rd. and Hewitt Springs
    Rd. both are paved county roads that lead back to Butterfield Coach Rd. in Springdale.
    As I approached Butterfield Coach I never saw the vehicle ahead of me again on U.S. Highway 412. As I approached the light
    there was a gray charger that looked exactly like the vehicle that fled turning left on U.S. Highway 412 from Butterfield Coach
    where Hewitt Springs would have came out. Having enough reasonable suspicion to believe this was my suspect vehicle I
    initiated a traffic stop. Upon making the stop I made contact with the driver and there was a strong odor of marijuana omitting
    from the vehicle. I placed the driver into custody for the marijuana and continued the investigation for the pursuit.
    The driver stated she was not fleeing from me and claimed to be coming from
    Bentonville. There was an ounce of marijuana in the vehicle and it was seized as evidence and she was transported to
    Washington County. A bystander who witnessed the pursuit and called into headquarters. Once I left booking at Washington
    County jail, I called the caller back who advised me that my suspect vehicle had turned south on Habberton Rd. but then they
    had observed me stop another Charger that was identical to the one that was running at the Walmart, and they felt compelled
    to call and inform me that I had stopped a different vehicle than the one that ran.
    Driver was not charged with Fleeing and booked in only under the misdemeanor narcotic
    charge.

      @@straightforward The charger that was fleeing was a RT hemi because you can see the glare from it's "HEMI" emblem on the fender as it passes the cop. The charger the cop pulled over was a GT, not a RT. The GT does not have a emblem on it's side fender. Also you might want to get your eyes checked, the first car looks dark grey, the 2nd victim looks to be a much lighter color grey. Color blind or just blindly back the first line of defense against freedom? Hmm

      @@straightforward Trooper Elkins radioed in that the charger that he was in pursuit of was "Battleship Grey" , they kind of looked the same to me.

    As a ex law enforcement officer once you lose sight of the vehicle it’s over, any judge will throw the charge out cause the officer can not say under oath that he saw who was driving

      I agree, you lose sight, it's over. This case proves exactly why because he was wrong. But, because he did and found weed, they can't just give it back because she was found to not be the driver. But, they shouldn't be able to charge her for the pot since the traffic stop should never have happened once he lost sight. That's what it would argue if I were her.

      #1-she's not very bright, meaning the bulb between the ears isn't getting full voltage. #2-When you're driving at 100-130mph while meeting a ASP in the median going 6-10mph in the opposite direction, in an SUV unit, it tends to give even stupid people confidence. #3-Why flee on a box store drive street with a unit 2' off your bumper, when your dimly lit bulb has you believing you're so smart you've tricked the popo?

      @@shikamaru281281 replay the video and look at his speeds. This trooper didn’t floor it once. Most of the pursuit he was doing approximately 102 mph. All I am saying in this comment is that she pulled over peacefully and was cooperative throughout the encounter, contrary to his statements to the other officers. Also of note is that two or three times he shows his prejudice by lumping this woman in a class of people “like they all do.” He made this stop grasping at straws. He had no cause to make the traffic stop, as all he had was a car that resembled the car he saw up close for just a minute.

    Fun fact - if he pulled her over falsely, the narcotic charge is moot. He had no basis for stopping the car, and only after he did it illegally did the discovery of the weed occur.

      She will be charged for the weed, it’s the same car. Time will tell. And the dealership will have proof if she was there. Even warranty work is written up, besides that it was close to 3 hrs from the time she was at the dealership

      Dashcams aren't necessary so long as your phone is with you. All current cell phones have active gps logs recording your every move.

      @@TheGadileck they provide no visual record of events including accidents. If someone cuts you off and slams on their breaks causing a collision there is no GPS evidence that will help you. Accident investigators that are skills and take pride in their job can figure something like this out but do you really want to rely on the police who may be over worked or simply not interested to make a defense for you?

      I don't think it's ego, high speed chases you get pretty jacked up, especially when they get away, that would even be you if you were in his shoes. She'll get off on the felony fleeing, unless a forensic search of the cars computer show differently, but I don't think the DA is going to go for that. He did have probable case stopping her and she did have a large amount of weed, which is illegal in Arkansas, maybe they can get her deported.

    The first car the officer witnessed was a Dodge Charger Scatpack with the front snorkel grille and 6.4L SRT Engine. The one he pulled over was similar in build, but was a Dodge Charger GT (No Snorkel Grille) with the Pentastar V6. They were separate cars. The Destroyer Gray (Matte Gray) is a very common color now for Dodge Chargers.

      Well I can tell you my work consisted of interviewing applicants for admission into the US both foreign and domestic travelers. Body language, hand and eye movement etc. and I learned that even late 80's old people men and women trafficked drugs and smuggled children and initially even I was skeptical at first but being immersed in these situations made a believer out of me. I could tell you stories that would blow your mind. For instance lets say you were this girl, or if you were in her place and got pulled over and you know that you are innocent, Would you be strongly voicing your innocence or just sit there waiting to see what happens next. She on the other hand is in the police cruiser not putting up much of a ruckus. But like I said this case and some that I experienced in a similar manner would not fly in court if you don't have a confession or you have solid proof. Is she guilty? I would put it at a definite yes but if she does not confess this cop has nothing. Also weigh in the marijuana she was carrying not much but??? @@lewisarmstead3271

Also the car he was looking for has an emblem on the side fender just in front of the drivers door.. screen record both times the officers dash cam is on each cars front end and then slow it all the way down and watch it then pause it. You'll see everything. She isn't the person he's looking for. So shitty job coppers.. Go to the track and get some more driving practice lol.     Those gray chargers are super common. I see them everywhere I go. He lost line of site, and without video recording of the license plate he technically has no case against her. All evidence obtained from the unlawful stop will have to be thrown out in court.

      Nah she got pulled over on suspicion (legal) and then during questioning (prior to any search) admitted to having an ounce in the car.
      1) Don't ride dirty, even if you obey the road laws you could still be pulled over like this.
      2) If you're riding dirty then don't admit to anything because the subsequent search might be deemed as unlawful later.

      @@nobody-ly9efthe problem is the officer absolutely had probable cause to make the stop. The car matched the description of one involved in a crime (fleeing). It was a totally legal stop. Then he smelled weed and she admitted having it. Now he can search because her admitting having weed in the car is probable cause for a search. Then he finds the weed…. Now he has probable cause for arrest. Shitty luck if it wasn’t her fleeing but it was all still legal. Had she not had the weed, and still got arrested only for fleeing, then you could argue that the criteria for probable cause for arrest was not met… That argument would be a good one given he lost the car for a while and the car wasn’t significantly distinct. Had it been neon yellow with purple wheels or something… then yea… but a stock Dodge is not bespoke.

Pause at 0:11 there's a badge on the first vehicle behind the frint driver-side wheel. At 08:36 there is no badge on this vehicle. It's a different car with a very similar appearance.

    I am not a licensed attorney in Arkansas, but am in NC. This trooper is dangerous. Also, as for trying to charge for felony fleeing, that's ridiculous, at least in NC. He never got anywhere near the car with lights and siren to where the driver failed to stop for such and instead fled. Maybe speeding and reckless driving, but absolutely not felony fleeing. And he doesn't have enough to even successfully have speeding/reckless conviction.

      @@shaunb93291 depends. The probable cause wasn't illegal. That is, it isn't illegal to stop someone or a vehicle that looks exactly like the one you are searching for. And just because it is a case of mistaken identity doesn't automatically mean anything that was found that is illegal automatically gets tossed out. At most all the charges would get dropped except for the possession. A good example of the fruit of the poisonous tree in where it doesn't apply regardless is if the officer pulled someone over and illegally searched their vehicle and found a dead body. No matter how illegal the search was that person will still get charged with murder and no it won't get tossed out either. I point this out because people believe that the concept of the fruit of the poisonous tree is some concrete thing and it isn't. It is mostly circumstantial and ultimately up to a judge.

      The troopers comments may just have earned himself on a Brady list. Between "they all lie" to "You have to prove it wasn't you". I sentence Trooper Elkins to read the Constitution in it's entirety and pass a test.
      There are thousands of Battleship gray Chargers and Challengers. I bet just in Arkansas there are more than 5,000. It was a special edition color for a few models.

      @@costco_pizza Jacob Byrd is a pretty knowledgeable trooper. Once he lost sight of the car, he would have stopped the pursuit, but kept an eye out for the vehicle.
      I've got no issue stopping the woman. Car matches the general description, run wants and warrants, as well as driving record. Where trooper Elkins failed IMO, was accessing the car performance data center. Again IMO, this data is no different than requiring a search warrant for downloading the black box.

      I wish the cops didn’t get more money and promotions from ticketing and locking up more ppl than other cops cause that makes it to where we are at right now where cops aren’t out to help ppl and keep ppl safe they are only out to get money from ppl and get themselves higher up in the cop shop. The cops that help ppl the most and are the most human and respectful ppl should be the ones that move up. I’m glad videos of them acting ridiculous are getting put out on RUclips tho cause if enough ppl speak up against cops that act this way something is gonna have to be done. Probably still won’t tho but hopefully it starts happening

It’s not far fetched, I’ve followed a story where the trooper was flying down a road and a another driver could not judge his high rate of speed and turned in front of him. He t-boned and killed the driver. This trooper used the suicide lane to dodge vehicles who didn’t have time to see him and pull to the right. He lost the guy he was chasing. He should’ve given up for the safety of everyone. Troopers are not immune to criticism and prosecution when they really mess up. This trooper was recklessly pursuing a Charger who was long gone. Should’ve cut it off right there. How many levels of poor judgement can we stack up on this one? Thanks for allowing room for my opinion. I appreciate yours.

    Girl, I got you if you can’t get proof. First of all the original car had matching gray side mirrors and was an RT. If you zoom in on the first car, you can see that it not only had the RT emblem on the driver side grill, but it also had the emblem on the side door. Along with those emblems, there was also something hanging from the rearview mirror. When I zoom into your vehicle going around the corner, you can see that you have black side mirrors, nothings hanging in the rear view, and that your car is not an RT with emblems. Get yourself a good lawyer, because you can get everything thrown out, and then Sue. Pretty much an illegal search and seizure. And with his racist comments, the police department is going to look to settle out of court quickly so that they’re not shamed.

      Dont know how the law works do ya. Same description of vehicle and matched what ran. Gives him reasonable suspicion to pull them over. Then the smell of weed allows him to detain her in handcuffs and search the vehicle. Either way going to jail for weed. Maybe learn how the law works before throwing comments out there 😄😅
