- The plaintiff was hired by the defendant to revamp his business site. He argues the defendant stopped paying, so he’s suing for what he’s owed. The defendant says the plaintiff is charging him a monthly maintenance fee, which he never agreed to pay. He doesn’t think he owes anything. He’s countersuing for the money he originally paid the plaintiff.

Sounds like he didn't have access to the domain records. You can move the site anywhere you want if you can access the DNS records. Wordpress sucks. I had the same issue he did. A previous person set up sites that were failed. And understand that plugins are third party so wordpress doesn't support the plugins. Sadly this guy didn't articulate well the problem.
correct, I understood what the guy was about the plugs in and updated. Its hard to move a website when a third party plugs in is not compatible with the new update.
That’s what I’m saying! He is a tech not a software engineer writing/creating plug-ins. If there was an upgrade, the code has changed 🤷🏾♀️ you can find something kinda close but might not find that exact one.
I’m not in tech and even I understood what he was trying to say. I play SIM4 I’ve easily spent four hours trying to just fix shit and get frustrated

As a techy person who has ran his own website, this case is hard to listen to. Plaintiff seems to be semi-knowledgeable on website building and everyone else is not and he is struggling so hard to explain things yet I think he fumbled this whole situation and trying to blame things that doesn't make sense.
yes I think he should have just explained it and let her ask questions afterwards. He had me lost and I have created a few websites. Defendant really do not understand what he needed. He will need someone to maintain the website not just create it and leave it alone
It sounds like an old Magento site. It’s the only one I can think of that has plugins with individual passwords
Agreed, this was painful. Plaintiff knows a LOT, but has a few gaps in his knowledge and (like many tech people) has a difficult time explaining things to non-tech people. The Defendant is pretty lacking (take a drink every time he says "secured"). Judge Milian is SO super smart but she also struggled to understand the Plaintiff's explanation. Bottom line, the Plaintiff should have backed up the site before he did anything to it, then shut OFF all auto-updates to Wordpress and plug-ins. Then if he upgraded and found that it broke the site, he could restore the back-ups and go from there. Also, shout-out to Namecheap and their fantastic Ukrainian tech support!
Why didn't he just recreate the website on another platform that he could manage instead of trying to fix the old one?

The 1st guy created a password for an additional user but he can still block access to certain things. He has the master password. And since he is being sued he isn't giving them the right access.

Sounds like he "designed" the site through sites that enables the so called designers to drag and drop contents, not having to actually write codes for the site. That's why the plug-ins affected the site. In short, he's not a web designer/developer.

When a plugin updates you may need to reinstall it, he simply deleted it like it wasn't his problem yet he charged for monthly upkeep of the site so he took on that responsibility. He clearly has only a very basic level of knowledge yet presents himself as an expert.

Seriously. I use wordpress all the time and he's talking out of his ass the whole time. "It automatically updates, it was beyond my control". Plugins don't update without you telling it to. I work on a site that someone else built with two dozen iffy plugins; haven't updated those things in a year. Sounds like he has a very basic knowledge and uses the overly complicated terms in hopes he can sound like an expert. When a site breaks, it can be quickly fixed, especially if you have access to the hosts tech support who will do the majority of the work or pinpoint the error and how to fix it.
@@Fribee83 Just for the record, you can set (most) Wordpress plugins to automatically update now. I don't know if that's what happened here, but you are most likely right that he just doesn't know what he's talking about.

Lol. neither do you. Most upgrades dont support the old version of an interface so I dont know what you are talking about. tech companies have been doing that for the past ten years .
He is absolutely right that they might have phased out the support for the old plugins due to iterations. I have seen companies like amazon leave developers who are smarter than you and myself stuck for months trying to figure out how to run the new interface and if you are not on one of their expensive premium business accounts they will not provide any support but then again you should know that because you are so smart.

The guy that was supposed to do the website, was NOT someone who knew what he was doing, as he was just using what existed. All he had to do was CREATE a completely different site instead of using what was already existing.
Thats not what he was hired for. The defendant literally hired him to restore it to the previous version. Yes it would have been easier but that’s not what he was hired for.
Especially if he was forced to use Wordpress. You can get a great template for like $20 and customize it while removing all the pointless plugins he said were so broken.

I have never been more confused on the definitions of the words STORED and SECURED in my life
As a longtime computer programmer, to me, "stored" == "backup" but not "secured" Securing the website would mean, among other things, regularly and proactively protecting it from hackers, a much different job from simply being able to recover the site from a hardware disaster.
So what could the programmer have done differently to make it right for the customer?

I think the Defendant expected a lot more without understanding how these jobs and websites work. It's not a one time job if you want ongoing maintenance and security. Plaintiff should have been able to do a site from scratch but it's a lot easier to just use what's already there. Old website dude probably didn't give the password because for whatever reason he didn't want someone taking credit for his original work. Wordpress sites are always updating its plugins, totally feasible that the plugins no longer worked with the older parts of the website. It's not difficult to understand..

I think 'stored' means backed up, and 'secured' means not at risk of failing, both of which the plaintiff didn't do...

Word press plugins are generally developed by third parties. And to know whether a plug-in is compatible, you have to install and test it. Installing the wrong plug in can break your site and cause security breaches.
The plaintiff was in over his head, he's not a developer he just knows how to install plugins and apparently not even that well. He struggled to explain what WordPress is and how plugins and themes are independent from it. He needed to explain to the judge that he isn't liable for fixing anything that may go wrong if site functionality is lost due to updates either to WordPress, a plugin or the theme. If that were the case everyone would get a free website build under a maintenance contract.
I had this exact issue with a Wordpress website. They update your plugins, which breaks them. Then you cannot restore them to a previous version. Your entire website gets borked and they say "You're welcome!"

I'm not a tech but this isn't very hard to understand. He doesn't want to pay because the site is not a secured site. Which means a hacker can go in and mess with the data or steal important info. That's what secured means. If you look at any site you go to you'll see whether its a secured site or not. So the issue here is that the guy he paid was not able to do his job. Especially if there is an understanding that he wanted a secure site. The judge doesn't even have basic knowledge of technology to understand what secure means so she can't have a good base to make a decision on this matter.
The plaintiff has a "non profit organization". I'm other words, he's so bad that he can't actually get people to pay for his skills cuz he doesn't have any skills.

Seems like the plaintiff got in over his head with this contract. He might have relevant technical expertise and possibly some issues stemming from the previous guy and the plugin issues but he should have done some extra research to assist in locating the appropriate plugin.
