    Well justice has finally been served on these two thieves! Heather Schwab was sentenced to six years in prison in Colorado and her husband William received a five year prison term. Now the home owners need to finish it. Every single landlord needs to file civil lawsuits while Colorado has them in custody. They should be paying back what they owe for the rest of their lives.

    • @xajaso
      @xajaso 5 лет назад +20

      Former CPS worker here. Lousy as their crimes are, CPS addresses dangers to children only. If the kids are healthy, fed, sheltered, clothed, educated appropriately, and not being abused or neglected, not much can be done. The foster system in every state is overwhelmed 24/7 - 365, with few emergency and/or longer term placements available. Those placements go to the kids in the absolute worst circumstances: extreme physical/mental/sexual abuse, neglect, or imminent danger. (Danger meaning living with hard drug dealers, gang members, meth cookers, sex offenders, violent criminals, infectious/toxic environments, etc.) We see parents turning tricks while kids are present, or pimping the children themselves. Kids get taken if parents/guardians use them to commit crimes as well.
      Aside from these folks uprooting their kids, changing their schools & exposing them to cons/criminal activities constantly, they look to be clean and physically healthy people. Their kids are probably the same. Shady as they are, if the kids are not neglected, abused, or otherwise at extreme risk, there's probably no grounds for removal. CPS doesn't take children from parents in extreme poverty, with little to eat, wear, or living in rickety dwellings if we can avoid it. Less damaging to everyone if we can provide emergency aid & then help parents get into better housing, jobs, etc. Breaking up families is a last resort, which is as it should be. Children love their parents and want to stay with them 99.99% of the time, even when they are desperately poor, addicts, constantly moving, and yes, even criminals. As bad as these people are, they are NOWHERE near the worst I've seen. Kids live in situations that would lose you your lunch and steal your sleep. Social services like CPS need far better funding & more decent people to provide placements. Until then we can only address the absolute worst cases we find.

    The easiest addition to the law that could prevent this whole thing from happening is that someone who signs a lease is placed on a probationary period in which they are afforded no protections unless there is documented proof that they have paid rent for at least 4-6 months. So when these people don't pay their first months rent, the renter doesn't have to go through a lengthy eviction process, they can void the rental agreement and demand they vacate within 48 hours of being given notice, or be charged with trespassing

      I think that is an absolutely terrible idea because it leaves good tenants completely unprotected from unscrupulous landlords. And while you may not believe it, a tenant is far more likely to be mistreated by their landlord than the other way around. There is a reason why landlord-tenant laws tend to favour tenants. Because the landlord is usually the one with all the power in the situation and often misused it in the past.

    Looks like they basically take their chances with the law: If the bad check is written for an amount between $750 and $2,500, it is a Class A misdemeanor, and the potential fine and jail term increase. The penalty can be up to a $4,000 fine and up to a year in county jail. If it was over $2500, it is a felony first class. So they've been keeping it under.
