    If any kayaker has flares they “prefer” please comment. It’s a wet sport and something packaged water tight from factory preferred.

      Thought same at first but at time of safety stop she claiming EVF was 3.1 off shore. If she can prove, she 's "clear" to issue summons, as EVF said as much, needs to be within 3. What I didn't understand is why the "no" on permission to fish the wrecks inside 3 that EVF asked about (2.1, 2.5). That should have been a yes by the regs, but Coastie could have preferenced with its ok but really prefer you to just have the flares. When she said no to fishing inside 3 without the flares she wasn't being nice, she was being wrong. All for service, safety and compliance but get your sh!t straight darling.

      I use the orion waterproof marine flares. You can get them at walmart, bass pro, cabelas, etc. Found some that were 12 years old in my old sea pro and they worked perfect still. Def a trustworthy brand. The coast guard can be pricks but for good reason, they are just looking out for you.

      I've got a three-pack of the Orion flares that I keep in a dry box. They'll survive a dunking, and will work if you need to fire them while hanging on the side of the 'yak... or floating along in your PFD.

    Crab ? Well where I am from , we would catch Blackfish.. Flares are probably one of the most important things you can have .They can show your location RIGHT NOW ! years ago, the Coast Guard could recommend but not say anything to Kayakers. Matter of fact, no license fees, nothing, it was like you were absolutely free to recreate the way you wanted. If you paddled twenty miles out with just yourself, you could do it. Nobody cared.

I’d bet she’s awesome most of the time and it was “one of those moments” she would never want to be a part of a performance review.
      I’ve never needed the CG, but absolutely rely on the knowledge that they will brave the worst conditions that Mother Nature can dish out...especially when we foolishly blast through the Oregon Inlet with a Small Craft Advisory in effect, or run personal watercraft over to the Bahamas, or go to the back side of Catalina to hunt lobsters when SwellWatch shows a big purple blob headed our way from the Southern Hemisphere. We don’t always make the wisest choices, but they’ve always got our backs, so Thank You to all who serve.🤙

      Oh, and YES I’m going to get a couple flares from West Marine, seal them in a foodsaver bag, and toss them in my yak sack gear bag. Tip, write the expiration date in BIG black sharpie so you don’t a) get hassled or b) shitouttaluck when/if you actually need the flares. Also, snip one side of the bag just a wee bit and maybe put blue tape there so you have a quick-tear spot in an emergency (those bags are tough). The tape keeps it from ripping open by accident and shows you right where to rip too, which is a big deal in low light conditions.

    One time fishing with my dad, had a similar incident. He asked them to show him the regulation. Of course that is hard to do from another vessel so he said he would step on board. They were not happy about that, so my father ended the conversation by pulling out his ID and making it an order... Capt. USCG. One of the coolest things I’ve seen him do.

      He is required to carry serviceable VDS. What I'm aware of is within two miles in inland waters you don't need them and anytime you go offshore.

    • @andrewhearing923
      @andrewhearing923 4 года назад +13

      Kevin Maguire
      Kevin - he is not required to carry VDS, he is a manually propelled vessel it is exempt from the requirement where VDS is required during the day time. The two mile requirement is very often misinterpreted, especially by officers, the two mile applies to a vessel operating in coastal waters, coastal waters can included water that are consider inland. The 2 mile references the opening or shore to shore distance of an inlet or entrance to a body of water considered to be coastal. So basically when a vessel enters the ocean (unless exempt) VDS is required its inward from the ocean that confused people and officers too because you could be in a bay or harbor that requires VDS because shore to shore is greater than 2 miles, but if you pass an area where shore to shore is less then 2 miles VDS is no longer required no matter how large the body of water opens back up to (San Francisco bay is an great example).
      I was in CG for thirty years and an LE instructor for 13years teaching this exact subject matter. I don't wish to show but pass on information, those officers were incorrect in the application of VDS for that vessel as it was operating at that time.
      Thanks for your reply, it always great to have discussions, enjoy your weekend.

My daughter got me a kayak safety kit that included flares from a Gander Mountain Store as a Christmas gift...the flares were purchased new, already past their "shelf-life" (normally 3-1/2 years) and you couldn't tell until opening the package. Can you recommend a good VHF radio? Seems like there's some cheaper Chinese ones with decent specs and features, but lack quality in build (according to reviews).

    The coast guard member, the woman, was not being "nice" as she claimed, seeing as she refused to tolerate any questions at all, and only was okay with an automatic acceptance of obedience to her dictation. Acts like she's a major power holder or something. Feels like she'd be the kind of CG member to criticize someone they're trying to save for "not being fast enough to the rescue device/divers". Nevertheless, that was a fantastic haul and day of fishing, even if cut short by a authoritarian type person.

    I never heard of a 3-mile flare requirement. Will someone explain that one? What I do find is 33 CFR 175.101 "Vessels operating on U.S. coastal waters, the Great Lakes, and territorial seas...must be equipped...", and, "Vessels owned in the United States and operating on the high seas (is that the 3-mile reference) must also be equipped..." (From what I read, the equipment required is the same.) Followed by, "The following vessels are _not_ (my emphasis) required to carry day signals, but must carry night signals when operating from sunset to sunrise:
    Recreational boats less than 16 feet in length (how long is that kayak?).
    Boats operating in ...races, etc.
    Open sailboats etc.
    Manually propelled boats." I suppose there would be an interesting discussion with lawyers whether the kayak is 'manually' propelled.
    Anyway, why is he required to carry flares? Even if the 'day signal' rule applies, doesn't the orange distress flag meet the rule?

Merrit Island, FL area here. Looking fwd to the cobia run that's just starting to fire up. Live bait I prefer blue crab but those muds look like great cobia bait! C'mon down to Merrit Island sometime...Kayak, a Scout 162sf and a Dusky 252 twin Suzuki 200's...C'mon get in!....

    The USCG crew in this is absolutely wrong as others have said. Nighttime in coastal waters would require flares for the kayak. It’s dangerous when the people entrusted to enforce the regulations just try to make it up as they go along.

    As others have already said, make that call to HQ and talk with the CO. Don't let them ruin other fishermen's day on the water.
    As for the Bottom Sweepers Jigs, I would target Sheepshead, Drum and Tog. But if it bends my rod i am not going to cry if it is something else.

    I'm 62. My Grandfather was a life long commercial fisherman My Dad was in the USCG when they were relevant & nice guys. My Grand dad was an offshore Captain who took folks party fishing in the 40's into the 60's for tuna, swordfish, Sailfish, Mako sharks, Marlins etc. So basically a fishing family outta Connecticut. I feel entitled to say the following . If you take time off from work to go fishing be it on your own vessel or a charted vessel once the USCG Googans or the DEEP get involved in your day the day is usually spoiled by them. I know they do "some" good usually in dire circumstances , but I resent having any of them spoiling a good or bad day of fishing by their unwanted & harrassing presence . I've been harassed by them. With my 2 younger children on my boat whilst wearing brand new life vests and plenty of floatation . The "Boss" of the googans stepped into my boat and did a quick passive aggressive look at my reaction. If I'd shown any resistance he would have arrested me in front of my kids. You know what kind of man would do that don't you . I knew his games and just smiled with an extended hand. Instead of insuring safety they are out to mostly antagonize sportsman, their friends & family. And Yet they wonder why lots, not all, of the boating public has ill feelings to those empowered bully's on the water. They try to create issues instead of helping.

    I really hate it when someone is given a bit of authority and then tries to exercise it without knowing what they're doing. Maybe she was at 3.1 but she was also a long way from him. Was teh boat driver incompetent and the Coasties couldn't get closer? The Coasties I know from a different era though, were far more competent. And then the answer about the 2.5 mile wrecks.
    She had zero on you (you're exempt from needing the flares) and thinks she "did her job" when in reality she screwed up and failed miserably. At least deserves a call to the command.

    Sucks you didn't have a gun to legally shoot them.
    "Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State,
    136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S.,177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”
    Daniel Szabo shot at coast guard members trying to board him and was only charged with failure to stop since the boarding was illegal.
    "A federal jury has found a man accused of firing at a U.S. Coast Guard crew not guilty of both weapons charges handed down in an indictment by a grand jury in September.
    Daniel Michael Szabo, 41, was facing a possible life prison sentence for charges of trying to kill a Coast Guard officer during a boarding and using a firearm while committing a violent crime.
    But jurors on April 6 only found Szabo guilty of failing to stop his vessel when ordered to do so by the Coast Guard.""

    Visual Distress Signals (VDS)
    A Visual Distress Signal (VDS) is any device you can use to help others locate your boat quickly in the case of an emergency. Visual distress signals include day signals that are visible in sunlight, night signals that are visible in the dark, and anytime signals that can be used both day and night. VDS are either pyrotechnic, which use smoke and flame, or non-pyrotechnic, which are non-combustible. There are a wide variety of signals that can be carried to meet federal boating regulations.
    The law states that no person may use a distress signal under any circumstances unless assistance is needed because of immediate or potential danger to the persons onboard.
    In other words, never use a VDS unless it’s an emergency. Breaking the law can come with serious penalties!
    All recreational boats operating in U.S. Coastal Waters or the Great Lakes, or bodies of water directly connected to U.S. Coastal Waters or the Great Lakes---up to a point where those waters are less than 2 miles wide---are required by law to be equipped with visual distress signals.
    U.S. owned boats must also carry visual distress signals when operating in international waters.
    There are some exceptions. During daytime hours the following boats are not required to carry visual distress signals:
    Boats less than 16 feet in length;
    Boats participating in organized events, such as regattas;
    Open sailboats that are less than 26 feet in length and not equipped with an engine;
    And manually propelled boats, such as canoes.
    These boats are only required to carry visual distress signals approved for nighttime use when operating at night in the above listed waters.
