This. Lying in court should get you the sentence the person you tried to get locked up would have got. Exceptions obviously for misremembering (it happens) but people like that lady who know they saw nothing and even had it proven to them still sticking to their guns and the other 'witnesses' should have trials and be put in for life when found guilty.

Our justice system is not about proving innocence, it is about proving guilt. The judge who said there wasn’t sufficient evidence to prove innocence has his head on backwards.

@@noahjones9833 Once you're convicted of a crime, you're considered "guilty" no matter what the evidence is. Yeah, morally, he's not guilty, but legally he is. Once you're convicted and therefore (no matter the evidence) "proven guilty," the only way to get out is to prove your innocence.
EDIT: To clarify for those who have responded, I mean people who INTENTIONALLY lie for the sake of money, attention, etc. about being a witness deserve to be punished. People who lie with the intent to ruin or harm someone in a court of law deserve to be punished. I’m sure there are laws that punish these people, I don’t know them specifically though. I think that witness testimonies shouldn’t be admissible as evidence by itself. Witnesses should be used to support evidence such as “John shot and killed a man and left the gun at the scene of the crime. The gun is registered in his name, his fingerprints are on the gun, AND a neighbor saw the whole incident.” Anything else and you end up just leveraging witness testimony against witness testimony.
Poor man was robbed of his child's entire life and that's the real crime here. Those witnesses should be serving life sentences in his place that is terrifying and heart breaking

Unfortunately this happens far more often then anyone is willing to accept. There's never any true justice in cases like this which is horrible. And from the very start when I told my public defender I wanted to plead innocent in the Preliminary Hearing, she said, "if you don't plead guilty, *I will not help you.* I have too many cases to take yours to trial." I will never forget these words from the judge and public defenders office. Because after serving my time, I came back home to an eviction notice on my door and someone replaced me in the 1 of my 3 jobs that was paying most of my bills. *... It's not about if you're innocent or not. It's about law enforcement and the court not willing to admit that they made a mistake.*

NO it's not. Once you are assumed guilty, the burden of proof is on the prosecution to provide evidence, sometimes that evidence is only a so called 'witness' (who COULD be lying). But it works like this (for an example) Hypothetically lets say, IF you are suspected of a crime, and enough evidence can be found/created/presented to arrest you (could be a witness on the spot), you are taken to jail to wait for a hearing. The taking to jail part is your fist clue you are guilty and must prove your innocents. Now they give you the information that they have that they are using to PROVE your guilt so YOU can PROVE it's not true in order to get out of jail. So, in actuality you must prove your innocence before you can be released. .. I want to add a couple of things I use to work on some years back.. to entertain one's thoughts. #1 is your Miranda Rights. I have asked many people including police officers if they "know" what their Miranda Rights mean. I had an officer of 12 years who was in trouble call me, I asked him the question during our conversation. Funny, but neither him nor any could answer, all they could do is recite them. they mean: You have the right to remain silent BECAUSE everything you say WILL be cut up and used against you in a court of law! Anything you SAY that they can use against you they will, anything you say that can be used as a defense is for your attorney to defend. And there were examples I used. If you had a court hearing on Monday at 8am but got into an accident on the way and was rushed to the hospital, then explained later to people of substance, "I was unable to make it because ..." the petitioning party will only tell the Judge "You said you were UNABLE to make it".. the rest is your defense. So the Judge is deceived. It would also be your job to notify the Judge they intentionally deceived the judge and then prove that. #2 NEVER EVER PLEAD "NO CONTEST". No Contest not a plead that can be appealed without EXTREME circumstances and you have 30 days to prove and 'request' an appeal, so.. a No contest plead is explained that you may NOT ever for any reason except proven extreme circumstances reversible and it IS used as a guilty plea. "Nolo Contendere" which translates as: you do not with to contend or argue against the complaint. In actuality you are stating to the court that you are incompetent (as a 2 year old child) to take a plea on your own, and therefore you are allowing the court to do so for you; which because of your own incompetence you will never appeal, because.. well.. you are incompetent. (that's not exactly what it means, but it is about the equivalence).

In America there is only 1 situation in which you are innocent until proven guilty, that is a wealthy, powerful, and very much white person with no priors, and maybe on a very rare occasion just plain lucky. An actual aspiring lawyer wouldn't fall for a cartoon youtube video. This video, like so many others leaves out key facts and only nitpicks evidence they don't like. There is a lot more to this case. This video forgets to mention that Spencer being with Mitchell in the hours leading up to the crime is proven. Mitchell even said Spencer was there. Even if the trial were started all over today I would have enough to convince the jury that he did it within the first 10 minutes.
U guys know you can be released after being convicted it has happened before. This is just a very rare case. Also the judge didn’t decide if he was guilty it was a jury. The jury may have had bias that the Defence didn’t realize when selecting the jury. Also this guy probably had a public defender for his case which may be why he lost an easy case.
The thing is he was convicted of being guilty. So now he has to provide undeniable evidence he's innocent. Despite how he never was undeniably proven guilty.

Wrong, there was enough evidence to Convict no matter how bad or tainted that evidence might be. The Jury determines what is factual not the Judge unless it is a trial with no jury.
This is because the common law system that America use, in Common law system there is only one guidelines and it is the judge faith in the Court. No matter how innocent you are, if the judge say you are wrong then you are wrong

@@mrluigi9923 if it isn't a for profit prison, the parole board will look at things like anger management, compliance with mental health medications, educational achievement, etc. If he spent all his time proving his innocence and didn't do any of that, the parole board will reject it. If it's a private prison, they will reject just to keep their numbers up and ensure profitability.

Human society operates based on different principles than nature. In the real world it would be almost impossible to convict members of mafia/criminal organizations of something without witnesses/snitches. "Scientific" approach would actually totally ruin the justice system. Also, forensic science is proven to be very unreliable.
i know a man who was accused of a horrible crime by a girl and sentenced for 32 years. the girl said that she was lying but he still has to finish his sentence. he is the nicest man i’ve ever met, with a loving wife, some people are just looking for someone to blame

But that's the problem, he was found guilty. Once found guilty the burden of proof required to prove innocence is generally far higher than it was to get convicted. Given the amount of people (and government bodies) that would likely get sued if he was deemed innocent it's clear the courts don't like declaring anyone of being wrongfully convicted.

Just new laws stacked on top of the old ones, inconsistency and conflict is inevitable. Too much power, not enough accountability.
You talk like the judges have to pay him out of their own pockets. They have laws and rules they have to follow. They are not allowed to just overturn another judges decision without following the law. If the law is flawed, in your opinion, contact your representative and start a process to have it changed. As of today March 12, 2021 Benjamin Spencer is free. When I heard the news I knew I heard it here on the infographics show.

It's not Spencer's job to prove his innocence. It's the courts job to prove his gult. They did not prove anything beyond a reasonable doubt.

I think that witness testimonies shouldn’t be admissible as evidence by itself. Witnesses should be used to support evidence such as “John shot and killed a man and left the gun at the scene of the crime. The gun is registered in his name, his fingerprints are on the gun, AND a neighbor saw the whole incident.” Anything else and you end up just leveraging witness testimony against witness testimony.

It’s really messed up of a judge to say “probably are innocent but you have no new evidence to prove it so I’m keeping you in jail.”
I had CCTV footage that proved my innocence in court and the judge literally said word for word "well seeing this video, *You're clearly telling the truth.* However I'm going to have to take the police officers word for it." Then denied my appeal. And from the very start when I told my public defender I wanted to plead innocent in the Preliminary Hearing, she said, "if you don't plead guilty, *I will not help you.* I have too many cases to take yours to trial." I will never forget these words from the judge and public defenders office. Because after serving my time, I came back home to an eviction notice on my door and someone replaced me in the 1 of my 3 jobs that was paying most of my bills.

NO it's not. Once you are assumed guilty, the burden of proof is on the prosecution to provide evidence, sometimes that evidence is only a so called 'witness' (who COULD be lying). But it works like this (for an example)
Hypothetically lets say, IF you are suspected of a crime, and enough evidence can be found/created/presented to arrest you (could be a witness on the spot), you are taken to jail to wait for a hearing. The taking to jail part is your fist clue you are guilty and must prove your innocents. Now they give you the information that they have that they are using to PROVE your guilt so YOU can PROVE it's not true in order to get out of jail. So, in actuality you must prove your innocence before you can be released.
.. I want to add a couple of things I use to work on some years back.. to entertain one's thoughts.
#1 is your Miranda Rights. I have asked many people including police officers if they "know" what their Miranda Rights mean. I had an officer of 12 years who was in trouble call me, I asked him the question during our conversation. Funny, but neither him nor any could answer, all they could do is recite them.
they mean: You have the right to remain silent BECAUSE everything you say WILL be cut up and used against you in a court of law! Anything you SAY that they can use against you they will, anything you say that can be used as a defense is for your attorney to defend. And there were examples I used. If you had a court hearing on Monday at 8am but got into an accident on the way and was rushed to the hospital, then explained later to people of substance, "I was unable to make it because ..." the petitioning party will only tell the Judge "You said you were UNABLE to make it".. the rest is your defense. So the Judge is deceived. It would also be your job to notify the Judge they intentionally deceived the judge and then prove that.
#2 NEVER EVER PLEAD "NO CONTEST". No Contest not a plead that can be appealed without EXTREME circumstances and you have 30 days to prove and 'request' an appeal, so.. a No contest plead is explained that you may NOT ever for any reason except proven extreme circumstances reversible and it IS used as a guilty plea. "Nolo Contendere" which translates as: you do not with to contend or argue against the complaint. In actuality you are stating to the court that you are incompetent (as a 2 year old child) to take a plea on your own, and therefore you are allowing the court to do so for you; which because of your own incompetence you will never appeal, because.. well.. you are incompetent. (that's not exactly what it means, but it is about the equivalence).
Where I live its innocent until proven guilty, but the American system is different (and so so unfair)

An actual aspiring lawyer wouldn't fall for a cartoon youtube video. This video, like so many others leaves out key facts and only nitpicks evidence they don't like. There is a lot more to this case. This video forgets to mention that Spencer being with Mitchell in the hours leading up to the crime is proven. Mitchell even said Spencer was there. Even if the trial were started all over today I would have enough to convince the jury that he did it within the first 10 minutes.

U guys know you can be released after being convicted it has happened before. This is just a very rare case. Also the judge didn’t decide if he was guilty it was a jury. The jury may have had bias that the Defence didn’t realize when selecting the jury. Also this guy probably had a public defender for his case which may be why he lost an easy case.
The thing is he was convicted of being guilty. So now he has to provide undeniable evidence he's innocent. Despite how he never was undeniably proven guilty.
Should take it to the supreme Court claiming innocent before guilt wasn't properly applied and that he was denied a basic American right.

If you go to a group of scientists and say “THERE WERE ALIENS IN MY BACKYARD! I SAW THEM!” Saying you saw something absolutely does not make it true, and it’s so ridiculous that the court cares about witness testimonies.
I really dont remember who had said this, and I'm mostly paraphrasing, but they said, "Eye witness accounts are the weakest form of evidence in science, but the strongest in the court of law..."

Human society operates based on different principles than nature. In the real world it would be almost impossible to convict members of mafia/criminal organizations of something without witnesses/snitches. "Scientific" approach would actually totally ruin the justice system. Also, forensic science is proven to be very unreliable.

But that's the problem, he was found guilty. Once found guilty the burden of proof required to prove innocence is generally far higher than it was to get convicted. Given the amount of people (and government bodies) that would likely get sued if he was deemed innocent it's clear the courts don't like declaring anyone of being wrongfully convicted.

It's full of bureaucratic holes and dead ends.
Vestigial remnants from old legislature mixed in with the more modern one that it's not compatible with.
Just new laws stacked on top of the old ones, inconsistency and conflict is inevitable.
That, and the court today is pretty much the clergy from way back when; few know exactly how they go about deciding the outcome, but their word is law so shut up.
Too much power, not enough accountability.
You talk like the judges have to pay him out of their own pockets. They have laws and rules they have to follow. They are not allowed to just overturn another judges decision without following the law. If the law is flawed, in your opinion, contact your representative and start a process to have it changed. But that takes effort. Much easier for you and your 251 "thumbs up" people to just say its "cause the money" then go back to you reality TV.
