Unfortunately, In the states the FDA is in bed with these companies. I received a letter 2 weeks ago from Phillips. No date on the letter and it only urged me to register my device, which I had done within a couple days of the recall. This is just another stall tactic. This week I received an email from the FDA asking me to fill out a questionnaire. Imo it’s another stall tactic. Aussies are a step ahead of us in the U.S.A.

I registered my 2 recalled Philips CPAPs as soon as it was possible, and I have heard nothing. I am in the US. I bought an Airsense 10 - out of pocket of course, because the local medical equipment company is at least as bad as Philips.

My wife and I have had quite the opposite experience. We registered our recalled devices shortly after the recall and both of us received brand new DS2 replacements within 3 1/2 months. Many others I know have also received theirs as well.

@@temperamentaltiger5097 This is very interesting. I wonder if you used an ozone type cleaner device on your DS1. If so, it may be that Philips is replacing those that were subjected to ozone treatment first. If not, there is some other reason. I have no idea what it could be.

@@bobaldo2339 I never used ozone or even humidification on my US DS1 and received my new DS2 a month ago, I still haven't returned my DS1. I don't know how they are working distribution and never expected my new device so soon.

Hey Nicko it turns out I took your advice before you gave it here for us Aussies . My Dream Station was purchased through a Pharmacy here in WA that is partnered with CLM Sleep . After email chatting with them and mentioning my consumer rights they offered me a refund or replacement. I went for replacement with a Lowenstein Medical cpap. Very happy with it.

Hi Nick. Aussie consumers who have purchased their Philips CPAP DS1 from places other than Philips Sleepeasy are to go to point of purchase eg CPAP Australia/Resmed. Bring back your device and you will get an on the spot full refund. My device was 3 years into 5 year warranty. No issues. Full refund in August. As you said Aussie consumers fully protected via Australian Consumer Law. Happy sleeping.

Thanks Nick and Andrew. I have an AS10 so not affected. Am an Aussie so good to have the reminder of the process.
But by sending the old device back to Phillips, isn’t the consumer then losing the potential proof of their, down the track, cancers and lung issues?
The lawyers will be the winners, Phillips denying and the victim saying their problems came from a device they can’t produce.

    • @andrewancilleri6623
      @andrewancilleri6623 2 года назад +2

If one guy gets cancer/lung issues after using the machine for a couple of years then you can guarantee that thousands of others will too. At that point you wouldn’t need “the proof” proof of owning the machine imo would be enough by that stage.

It’s great that this gentleman got his refund, but a little bell went off in my head when I heard the sneaky little things these companies do when it comes to giving refunds ,.. what I’m referring to is “ we will call you on a PRIVATE number to get your banking information “ … they do this because they figure a very small percentage of people will be giving their banking info over the phone from a call that comes in from a “ private “ number , and even a smaller percentage will even answer a call from a “ private “ number .
I think another sneaky little thing they did is deciding to make people wait 12 months for a replacement ( they know a large majority of people are gonna go out and get a new one before that 12 month date and they are hoping most, or at least some will cancel the replacement )

I have two machines that are eligible for replacement. I registered both, but have only received one replacement. I am at least thankful for that. They insist that you said the old back to them, but I do not feel obligated to do so. They're not going to come knocking on my door and demand to repossess it, and they do not have any of my banking information, etc., So it's not like they're going to debit my bank, nor would they have any grounds to do so because my machines are fully paid for. I even spoke to a representative after I received the new machine to ask a few questions. He told me that I have to send that machine back. I'm over here like says who? I don't think I'm going to send them back. I would like to figure out how to replace the foam in them, and have them as backups, or even give them to someone who can't afford a new one. Do you have a video on replacing with new foam?

I didn't know of recalls until November 2021. No one sent me a letter not even my medical company I bought it from. My medical company said they didn't even know about the bad machines until July 2021. They have tryed to work with getting out of their contract with Phillips and getting different machines. This company is only after their billions of dollars. They don't care about the people using these bad machines. I saw where the FDA said the new filter in the new machines is having issues. I don't trust Phillips because they come first and we are just mice to them to play with.

Hi Jack it depends where you are to be honest. I think the standard is 2 years but in some places they extend it out to 5 years. I have had a few people write to me and tell me even if it's out of warranty you can still get a refund if it's within 5 years as that is apparently the 'serviceable life'. Cheers

I have 2 PHILLIPS Remstar Pro's, 1 for home and 1 at FIFO job. Both are around 5 yrs old and have registered both for recall. I haven't heard from PHILLIPS as yet, but wondering if because all the talk is around dreamstation and newer machines. I paid $1575 for 1st machine and $795 for 2nd, I take the humidifier from 1st machine to work with me, less weight to carry. Am I entitled to a refund same as newer machine owners?

Hi Ian, probably not with Pro's mate as they are probably not within the serviceable life (5 years). Cheers. Nick

Yeah it's certainly a tricky one mate. Difficult decision although i'm about to do a video that might make that decision a bit more clear cut!
